SUBJECT: Madison Avenue Sanitary Sewer Extension Project
(CIP 310837: Madison Avenue Sanitary Sewer Extension Project)
Acting Public Works Director/City Engineer Gus Psihoyos is recommending acceptance
of the construction contract for the Madison Avenue Sanitary Sewer Extension Project,
as completed by Top Grade Excavating, in the final contract amount of $90,484.50, and
approving the preliminary schedule of final assessments. The final assessments to
property owners are reduced by 13.61 %.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The enclosed resolutions provide for the acceptance of the construction contract
and the preliminary schedule of final assessments for the Madison Avenue
Sanitary Sewer Extension Project.
DISCUSSION
Top Grade Excavating has completed this sanitary sewer extension in the final
contract amount of $90,484.50, The final contract price is over the original
contract amount by $24.41. The final assessable portion of the contract was
$5,303,61 under the original project estimate, Therefore, as a result of the lower
overall assessable cost, the final assessments were reduced by approximately
13,61 %, decreasing the assessment from $95.43 per foot to $82.44 per foot.
The project provided for the construction of approximately 580 feet of gravity
sanitary sewer, 388 feet of forcemain to serve Madison Street and the
replacement of 65 feet of 8" sanitary sewer on Ellis Street.
The project provided sewer service to three homes and one apartment building
along Madison Street. An 8" diameter gravity sewer pipe was installed from Ellis
Street to the backyards of two homes at 1829 and 1849 Madison Street.
Sanitary sewer grinder pumps were installed for one home at 1910 Madison
Street and the apartment building at 1921 Madison Street and both were tied into
the Clarke Drive sanitary sewer, The pumps for 1910 and 1921 Madison Street
were needed due to the grade, existing retaining walls, and the lack of access for
equipment to tie those two properties into the gravity sewer.
To allow sufficient administrative time to process financial assistance payments
for low to moderate income families, the adoption of the schedule of final
assessments will be delayed approximately 45 days. In its place is a resolution
adopting a preliminary schedule of final assessments. Property owners may use
this period to apply for financial assistance that may reduce the amount of the
assessment payable by the property owner.
RECOMMENDATION
I recommend that the City Council accept the improvements, accept the final
contract be established at $104,057.18, and adopt the preliminary schedule of
final assessments.

The project will be funded with the Sanitary Sewer Construction Fund from a
Fiscal Year 2001 appropriation in the amount of $113,000,
Low- to moderate-income property owners subject to assessments will be eligible
for financial assistance ranging from 20 to 100 percent of the sanitary sewer
assessment for owner-occupied resident property, depending on family size and
income level. This financial assistance program is made available through the
1 % Local Option Sales Tax.
ACTION TO BE TAKEN
The City Council is requested to adopt the attached resolutions accepting the
improvements, establishing the final contract amount, and approving the
preliminary schedule of final assessments.

RESOLUTION NO. 440-04
ACCEPTING IMPROVEMENT
Whereas, the contract for the Madison Street Sanitary Sewer Extension
Project has been completed and the City Manager has examined the work and
filed his certificate stating that the same has been completed according to the
terms of the contract, plans and specifications and recommends its acceptance.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
Section 1. That the recommendation of the City Manager be approved
and that said improvement be and the same is hereby accepted.
BE IT FURTHER RESOLVED that the City Treasurer be and he is hereby
directed to pay to the contractor from the Fiscal Year 2001 Sanitary Sewer
Construction Fund in amount equal to the amount of his contract, less any
retained percentage provided for therein.

FINAL ESTIMATE
Whereas, the contract for the Madison Street Sanitary Sewer Extension
Project has been completed and the City Engineer has submitted his final
estimate showing the cost thereof including the cost of estimates, notices and
inspection and all miscellaneous costs.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
Section 1. That the cost of said improvement is hereby determined to be
$104,057.18 and the said amount shall be paid from the Fiscal Year 2001
Sanitary Sewer Construction Fund of the City of Dubuque, Iowa.
Section 2. That $33,657.74 of the cost thereof shall be assessable upon
private property and $70,399.44 shall be paid from the Fiscal Year 2001 Sanitary
Sewer Construction Fund.

properties within the District described as the Madison Avenue Sanitary Sewer
Extension Project, as been adopted and assessments confirmed and levied by
the City Council of Dubuque, Iowa, and that schedule of assessments has been
certified to the County Treasurer of Dubuque County, Iowa,
YOU ARE FURTHER NOTIFIED THAT ASSESSMENTS MAY BE PAID IN FULL
OR IN PART WITHOUT INTEREST AT THE OFFICE OF THE CITY
TREASURER, CITY HALL, 50 W. 13TH STREET, DUBUQUE, IOWA 52001
UNTIL
After unpaid special assessments of $50,00 or more are payable
in 10 annual installments and will draw annual interest at nine percent (9%)
computed to the December 1 next following the due dates of the respective
installments as provided in Section 384,65 of the Code of Iowa. Each installment
will be delinquent from October 1 following its due date on July 1 of each year.
Property owners may elect to pay any annual installment semiannually in
advance.
All properties located within the boundaries of the Madison Street Sanitary Sewer
Extension Project above described have been assessed for the cost of making of
said improvements, the amount of each assessment and the amount of any
conditional deficiency assessment having been set out in the schedule of
assessments accompanying the same, which are now on file in the office of the
County Treasurer of Dubuque, Iowa. For further information you are referred to
said schedule of assessments,
