The City of Dubuque Zoning Advisory Commission has reviewed the above -cited request. The application, staff report and related materials are attached for your review. Discussion The applicant was not in attendance for the public input portion of the meeting. Staff Member Hemenway reviewed the original amendment to the PUD proposed by Mr. Kluck, the recommendation made by the Commission at their June 1, 2011 meeting, including a 25 -foot north side setback. Staff reviewed the proposed changes to the latest conceptual layout, noting that Staff reviewed the proposed changes to the latest conceptual layout, noting the applicant is seeking a 20 -foot north side setback and that the Council remanded this case back to the Zoning Advisory Commission. There were several public comments in opposition because of the impact on light, air and visibility on surrounding property, density of development and loss of natural habitat and its impact on wildlife. The Zoning Advisory Commission discussed the request, noting that their original recommendation was for a 25 -foot setback and nothing has changed to warrant reducing the setback to 20 feet on the north side. Approval was granted for two 24 -unit apartment buildings and associated parking lots and a single -story clubhouse /office building. The Commission recommended approval of the PUD and the conceptual plan for the development, as submitted. At their June 20, 2009 City Council meeting, the Council approved the PUD, as submitted. At the June 1, 2011 Zoning Advisory Commission meeting Mr. Kluck asked to amend the concept plan for the development by enlarging the clubhouse /office building footprint, adding a second story to the building to accommodate three dwelling units and repositioning the building five feet closer to the north side property line, decreasing the setback from 25 feet to 20 feet. The Commission agreed to the request with the exception of the reduced setback. The Commission approved the amendment with the condition that the clubhouse /office building remain a minimum of 25 feet from the north side property line. Mr. Kluck subsequently asked the City Council at their June 20, 2011 meeting to decrease the building setback to 20 feet. At the meeting, the Council remanded the request to the Commission for another public hearing. DISCUSSION Mr. Kluck has constructed the first 24 -unit apartment building and a portion of the surface parking lot. He has now submitted a new concept plan asking to add a second story to the clubhouse /office building that will accommodate three residential units. Also, he has asked to increase the size of the clubhouse /office from 27' by 45' (1,215 square feet) to 35' by 60' (2,100 square feet) and reposition the building five feet closer to the north side property line. This would mean that the building is setback 20 feet Kluck University Avenue PUD Amendment Page 2 from the north side property line instead of the 25 feet that was originally indicated on the conceptual plan approved in 2009. The parking lot configuration will remain the same, with 86 total off - street parking spaces, 54 of which are located inside of the apartment buildings. By adding three residential units above the clubhouse /office building the total number of units will increase from 48 to 51. This translates to approximately 1.7 parking spaces per unit. A standard multi - family residential development is required to provide a minimum of 1.5 parking spaces per unit. The rest of the site, including the access from University Avenue, the location of the main apartment buildings, and the landscaping will remain the same as was approved on the original conceptual plan. The increase in density, demand on parking and traffic, if the three residential units are added, will be negligible. However, shifting the two - story building slightly further to the north may have more of an impact on the adjacent residential property at 2762 Beverly Drive. RECOMMENDATION Staff recommends that the Zoning Advisory Commission review the proposed changes to the Planned Unit Development and forward a recommendation to the City Council. f: \users \kmunson \wp \boards- commissions\zac \staff reports\zac staff reports 2011 \2763 university avenue amend pud (kluck) stf rpt 05_24_11.doc ("7 RrY? z: ,) _9 p ., ' '1.2,- rc.:) I -- ' t ri Lfl A 7 p Tril'y 712j r- Tj TT Tr Tr c \34 )ArrrO A y . I would like to encourage the City Council's opposition to rezoning the site for the proposed apartments above the recreation center. I feel that the developer has not followed up with concerns nor sought neighborhood buy -in as requested at the last City Council meeting. I do agree that the aesthetic of the completed building is excellent and I believe I have a good understanding and acceptance of phase II. I have even gone as far as to recommend the apartments to family who have recently relocated to Dubuque. But, I feel I have legitimate concerns and an overall lack of understanding of the developer's proposal.
