Dear Mayor and City Council Members: The City of Dubuque Zoning Advisory Commission has reviewed the above -cited request. The application, staff report and related materials are attached for your review. Discussion The applicant spoke in favor of the request reviewing the proposed amendment that would allow the proposed chapel to be 15 feet from Wilbricht Lane. Mr. Gansemer noted that the original concept layout inadvertently left out the setback of the chapel, and if the chapel met the 25 -foot setback, it would encroach on the adjacent parking lot. Staff reviewed the revised concept layout for Hillcrest Family Services campus, location of the proposed chapel, the setbacks of other structures along Wilbricht Lane, noting that four existing structures are non - conforming for front yard setback, including the Flora Park maintenance building. There were no public comments. The Zoning Advisory Commission discussed the request, and had no objection to the amendment. Recommendation By a vote of 7 to 0, the Zoning Advisory Commission recommends that the City Council approve the request. A simple majority vote is needed for the City Council to approve the request. Kritz, Associate Planner F / • I -X ' SUBJECT: Hillcrest Family Services Institutional District Amendment Dubuque httd All-America City 1111r 2007 June 29, 2011 INTRODUCTION Hillcrest Family Services has requested an amendment to their Institutional District regarding the front yard setback of the new chapel. The Zoning Advisory Commission recently reviewed an amendment to the Hillcrest Family Services Institutional District in May 2011. The request at that time involved the same chapel as well as a new classroom /recreational facility. The Zoning Advisory Commission recommended approval of the request at the May 4, 2011 meeting. The City Council approved the request at their May 16, 2011 meeting. DISCUSSION Subsequent to approval of the Hillcrest Family Services Institutional District amendment and as part of preparing the detailed documents for building and site plan approval, it was found that the rendering provided for the chapel building did not reflect the actual location of the chapel. The Ordinance for the Hillcrest Family Services Institutional District requires a 25 -root front yard setback. The proposed chapel will be located 15- foot from the Wilbricht Lane right -of -way. Attached to this memorandum is a copy of the original rendering and then a revised diagram indicating the chapel in fact will be located 15 feet from Wilbricht Lane. It does not appear to be practical to comply with the 25 -foot setback without having to encroach onto the adjacent parking lot to the north of the proposed chapel or rotating the chapel in such a manner as to not be perpendicular to the existing curb for the adjacent parking lot. Planning Staff has provided an aerial photo of the Wilbricht Lane area and notes that several of the structures along Wilbricht Lane do not meet the current front yard setback requirement. Neither the existing non - conforming structures nor the proposed location of the chapel block visibility for motorists traveling on Wilbricht Lane. The existing front yard setback of existing structures or the proposed chapel will not create a visual obstruction for any of the access drives or street intersections along Wilbricht Lane.
