Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request.
The application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request reviewing the proposed lot layout.
Staff reviewed the submitted plat of survey, noting that Lots 1 and 2 do not have frontage on
a public or private street. Staff also indicated that the subject property lies outside any
future annexation area that is current being studied.
There were no public comments.
The Zoning Advisory Commission discussed the request and recommended approval
subject to waiving the lot frontage requirement.
Recommendation
By a vote of 6 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request subject to waiving lot frontage requirement for Lots 1 and 2, and
waiving Article IV, Design and Improvement Standards of the Subdivision Regulations,
except Section 42-19(b), Lots and Blocks.
A simple majority vote is needed for the City Council to approve the request.

RESOLUTION APPROVING THE PLAT OF SURVEY OF LOTS 1 & 2 OF
FLYNN ADDITION IN DUBUQUE COUNTY, IOWA
Whereas, there has been filed with the City Clerk a plat of sUlvey of Lots 1 & 2 of
Flynn Addition in Dubuque County, Iowa; and
Whereas, said plat of survey has been examined by the Zoning Advisory
Commission and its approval endorsed thereon; and
Whereas, the survey plat has been examined by the City Council and they find
that it conforms to the statutes and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That Section 42-19(b) of the Subdivision Regulations is waived to
allow Lot 1 and Lot 2 to have 0 feet of lot frontage, where 50 feet of lot frontage is
required.
Section 2. That the plat of survey of Lots 1 & 2 of Flynn Addition is hereby
approved, and the Mayor and City Clerk are hereby authorized and directed to endorse
the approval of the City of Dubuque, Iowa upon said plat of survey.
Section 3. That the City Council hereby waives Article IV, Design and
Improvement Standards of the Subdivision Regulations, except Section 42-19(b), Lots
and Blocks.

SUBJECT: Plat of Survey of Lots 1 & 2 of Flynn Addition
Introduction
The submitted plat of survey of Lots 1 & 2 of Flynn Addition subdivides an existing 25.4
acre lot into two lots. Both lots are located within the two mile jurisdiction of the City of
Dubuque in Dubuque County. Lot 1 will be approximately 21.4 acres and be accessed
from an existing easement across Lot 2 of Flynn Furseth Place to Schloth Road. Lot 2
will be approximately 4.0 acres and will be accessed from an access easement across
Lot 1. Neither lot will have frontage on a public or private right-of-way.
Discussion
The submitted plat of survey facilitates the construction of a new home on Lot 2. During
joint review of the plat of survey, the County Zoning Administrator indicated that County
regulations restrict the number of houses accessed from a lane to a maximum of two.
The submitted plat of survey will not comply with that regulation. The plat is in other
respects in compliance with County and City regulations.
Recommendation
Planning Staff recommends that the submitted plat of survey be approved subject to
waiving lot frontage requirements for Lots 1 and 2 subject to the plat of survey being
revised to comply with Dubuque County regulations for access.
