Duggan and Members of the City Council DATE: December 14, 2004 RE: Claim Against the City of Dubuque by Randel J. Roy Claimant Date of Claim Date of Loss Nature of Claim Randel J. Roy 12/10/04 12/08/04 Vehicle Damage This is a claim in which the claimant alleges that as he was unloading his 2004 Ford Truck at the Landfill, a landfill driver ran over some nearby boards, causing the boards to flip up and dent the tailgate of claimant's vehicle. According to the report of Don Vogt, Operations & Maintenance Manager, Landfill Supervisor Tom Driscoll investigated this incident and reported that the incident and damage cited by the claimant are accurate, and the estimate appears to be reasonable. It is therefore the recommendation of Don Vogt to approve this claim for the amount of the submitted estimate of $344.39. The Legal Department concurs with this recommendation. BAL:tls cc: Michael C. Lindahl, Corporation Counsel Don Vogt, Operations and Maintenance Manage~ SUBJECT: Randel Roy Claim INTRODUCTION The purpose of this memorandum is to respond to the the claim filed against my department by Mr. Randel Roy. DISCUSSION I have consulted with Landfill Supervisor Tom Driscoll regarding the Roy claim. Mr. Driscoll is of the opinion that the incident and damage cited by Mr. Roy are accurate. He also feels that the cost estimate for the repair of the cited damage seems appropriate.
