SUBJECT: Final Plat of Lots 1-4, Inclusive, and Lots A-B, Inclusive, of Block 5 of
Eagle Valley Subdivision
Planning Services Manager Laura Carstens is recommending approval of the final plat
of Lots 1-4, inclusive, and Lots A-B, inclusive, of Block 5 of Eagle Valley Subdivision.
This was previously approved by City Council on October 4, 2004, however, the
resolution had an incorrect lot designation for the storm water detention basin.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

Eagle Valley Subdivision
INTRODUCTION
This final plat was approved by the City Council on October 4, 2004. An error was
found in the resolution regarding maintenance of the storm water detention basin where
the lot designation for the public street was inserted rather than the lot designation for
the detention basin. The City Council is being asked to rescind the previous resolution
and adopt a new resolution with the correct lot designation.
DISCUSSION
The submitted final plat is a continuation of Eagle Valley Subdivision. The subject
property is being platted to provide four single-family building lots, the cul-de-sac
portion of Golden Eagle Drive (Lot B), and an easement for utility and access purposes
to Lot G of Eagle Valley Subdivision (Lot A). As stated previously, Page 2, Section 4,
the lot designation for the detention basin was listed as Lot B when it should have been
Lot G, Eagle Valley Subdivision.
RECOMMENDATION
I recommend the submitted final plat of Lots 1-4, Inclusive, and Lots A-B, Inclusive, of
Block 5 of Eagle Valley Subdivision be approved as it is in substantial compliance with
the City of Dubuque Subdivision Regulations.

RESOLUTION NO. 479-04
A RESOLUTION RESCINDING RESOLUTION NO. 386-04, AND APPROVING THE
FINAL PLAT OF LOTS 1-4, INCLUSIVE, AND LOTS A-B, INCLUSIVE OF BLOCK 5
OF EAGLE VALLEY SUBDIVISION IN THE CITY OF DUBUQUE, IOWA.
Whereas, there has been filed with the City Clerk a final plat of Lots 1-4,
Inclusive, and Lots A-B, Inclusive, of Block 5 of Eagle Valley Subdivision in the City of
Dubuque, Iowa; and
Whereas, upon said final plat appears a street to be known as Golden Eagle
Drive (Lot B), together with certain public utility easements, all in Eagle Valley
Subdivision, which the owner, by said final plat, has dedicated to the public forever; and
Whereas, the preliminary plat has been examined by the Zoning Advisory
Commission and had its approval endorsed thereon; and
Whereas, said final plat has been reviewed by the City Planner and had here
approval endorsed thereon, subject to the owners agreeing to the conditions noted in
Section 2 below; and
Whereas, said final plat has been examined by the City Council and they find
that it conforms to the statutes and ordinances relating to it.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the dedication of Golden Eagle Drive (Lot B), and the
easements for public utilities, sanitary sewer, storm sewer and water mains as they
appear upon said final plat and the same are hereby accepted; and
Section 2. That the final plat of Lots 1-4, Inclusive, and Lots A-B, Inclusive, of
Block 5, is hereby approved and the Mayor and City Clerk are hereby authorized and
directed to endorse the approval of the City of Dubuque, Iowa, upon said final plat,
provided by the owners of said property herein named, execute their written acceptance
attached hereto.
Section 3. Sidewalk installation shall be the responsibility of the owner
abutting the public rights-of-way, including lots with multiple frontages, as required by
City Code 41-161 through 41-164. The responsibility shall extend to all successors,
heirs and assignees. Sidewalk installation will not be required until the development of
the lot has been completed, except as required herein. In sparsely developed
subdivisions, sidewalks on developed lots will not be required until 50% of the lots
approved by the plat have been developed. All vacant lots shall have sidewalks
installed upon development of 80% of the lots approved by the plat.
Section 4. The developer will maintain erosion control devices constructed in
Block 5 of Eagle Valley Subdivision until it has been fully completed. Upon the City's
acceptance of the detention facility, the maintenance expenses incurred by the city off
Dubuque for the storm water detention facility (Lot G, Eagle Valley Subdivision) shall be
assessed against the lot owners of Eagle Valley Subdivision, in equal amounts, and the
City Manager shall certify such costs to the City Clerk, who in turn shall promptly certify
such costs to the Dubuque County Treasurer, and such costs shall then be collected
with and in the same manner as general property taxes in accordance with provisions of
law.
Section 5. That the final acceptance of all public improvements shall occur
upon certification of the City Engineer to the City Council that all public improvements
have been completed in accordance with the improvement plans and city standard
specifications and accepted by the City Council Resolution.
Section 6. That in the event Arnold van Etten and Fondell Excavating, Inc.
fails to execute the acceptance and furnish the guarantees provided in Section 2 hereof
within 180 days after the date of this Resolution, the provisions hereof shall be null and
void and the acceptance of the dedication and approval the plat shall not be effective.
