the following described real estate:
The South one-half of the Middle one-fifth of Out Lot 479 in the City of
Dubuque, Iowa, according to the United States Commissioner's Map
thereof.
You are hereby notified that the Dubuque Community School District desires the
condemnation of the following described land:
The South one-half of the Middle one-fifth of Out Lot 479 in the City of
Dubuque, Iowa, according to the United States Commissioner's Map
thereof.
That such condemnation is sought for purposes of constructing a new school by the
Dubuque Community School District.
That a commission has been appointed as provided by law for the purpose of
appraising the damages which will be caused by said condemnation.
That said commission will, on the 3rd day of February, 2005, at 9:30 o'c1ockAM.,
convene at the office of the Dubuque County Sheriff, Dubuque Law Enforcement Center,
770 Iowa Street, Dubuque, Iowa, and immediately thereafter will view said premises.
They will then return to the Sheriffs Office and proceed to appraise and award said
damages. You may appear before the Commissioners, if you care to do so.

1. The Applicant, the Dubuque Community School District, does hereby make
application to condemn, in fee simple, title to the following described real estate situated
in the City of Dubuque, Dubuque County, Iowa, to wit:
The South one-half of the Middle one-fifth of Out Lot 479 in the City of
Dubuque, Iowa, according to the United States Commissioner's Map
thereof.
According to the public records on file in Dubuque County, Iowa, the party listed
below is the Record Title Owner of the above-described real estate:

2. The names and addresses of lien holders, encumbrancers and other persons
affected by this proceeding are as follows:

3. Attached hereto and marked as Exhibit "A" is a plat showing the location of the
real estate sought to be condemned.
4. The purpose for which the condemnation is sought is for purposes of
constructing a new school by the Dubuque Community School District. Efforts have been
made by the Applicant to negotiate in good faith with the aforesaid owners to acquire the
private property sought to be condemned.
5. The property described above is not agricultural property.
6. The real property sought to be condemned herein in conjunction with other real
property to be condemned or otherwise acquired by Dubuque Community School District
is the minimum land necessary to complete the downtown school project.
7. You are requested to appoint a Commission in compliance with Chapter 6B of
the Code of Iowa to appraise damages. Said Commissioners shall be six in number and
shall be residents of Dubuque County, Iowa.

NOW, on this ~day of December, 2004, the Application of the Dubuque
Community School District comes on before me pursuant to Chapter 6B of the Code of
Iowa, for the purpose of appointing Compensation Commissioners to assess the damages
sustained by virtue of the Applicant's condemnation and appropriation of the real estate
described in said Application, a copy of which is attached hereto.
It appearing that said Application complies with the requirements of Section 6B.3
ofthe Code ofIowa, and that the property to be acquired is not agricultural property, it is
hereby ORDERED that the following be, and the same are hereby appointed as
