CitY Hall Telephone: 589-4210 ORDINANCE NO. 31-00 AN ORDINANCE AMENDING CHAPTER 11 (BUILDINGS AND BUILDING REGULATIONS) OF THE CITY OF DUBUQUE CODE OF ORDINANCES BY AMENDING SECTION 11.58-1 BY ESTABLISHING A TWELVE MONTH MORATORIUM ON THE ISSUANCE OF PERMITS FOR WORK IN THE US. 20 CORRIDOR. Whereas, the Iowa and Illinois Departments of Transportation are conducting a U.S. 20 Mississippi River Crossing Study; and Whereas, the issuance of permits in the study corridor of U.S. 20 could impact the study negatively. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. Chapter 11 (Buildings and Building Regulations) of the City of Dubuque Code of Ordinances is hereby amended by amending Section 11-58.1 as follows: Section 11-58.1 Moratorium - for work in the U.S. 20 Corridor. The building official shall not issue any permit for any new construction or substantial enlargement, alteration, repair or remodeling of any structure, building, or sign in the U.S. 20 Corridor (Dodge Street), but not to include demolition, from the eastern corporate limits of the City of Dubuque westerly to the intersection of U.S. 20 (Dodge Street) with Cherðl(cc Drive/Cellins Street Bluff Street, as shown on the maps on file in the Office of the City Clerk, 50 W. 13th Street, Dubuque, Iowa, during the period from May 10, t999 2000 to May 1, WOO 2001, except where a vested right to the issuance of such permit accrued prior to May 6, 1008 May 1, 1999. I would like to ask the city to extend the moratorium for an additional year in the area Iowa DOT will require for our approach to the new Mississippi River Bridge on Highway 20. A map of the footprint is attached. Hopefully at the end of the year Iowa DOT will have a better idea of when we will be able to move forward with land purchases in this area. . At this time we have no interest in extending the moratorium beyond this area westward to Devon Drive. Van Milligen, City Manager SUBJECT: Extension of Highway 20 Moratorium March 29, 2000 At the request of the Iowa Department of Transportation, Planning Services Manager Laura Carstens is recommending that the City extend the moratorium on building permits for the Highway 20 from Bluff Street east to the city limits for 12 months. This is being done to reduce impacts to the U.S. 20 Mississippi River Crossing Study area. The building permit moratorium for the remainder of U.S. 20 would expire on May 1 . . Van Milligen, City Manager Laura Carstens, Planning Services Manager ~ Extension of Highway 20 Moratorium FROM: SUBJECT: INTRODUCTION This memo transmits a request from the Iowa Department of Transportation (lDOT) for the City to extend the building permit moratorium on Highway 20, in connection with the U.S. Mississippi River Crossing Study. A resolution and map are attached. DISCUSSION On May 4, 1998, the City Council established a six month moratorium for Highway 20 from Bluff Street to Cherokee Drive/Collins Street, for completion of the Highway 20 Land Use Plan for this area. On April 19, 1999, the City Council extended the moratorium to May 1, 2000, and expanded the area of the moratorium to include Highway 20 east from Bluff Street to the city limits. This extension in time and expansion of area were requested by the IDOT for the U.S. 20 Mississippi River Crossing Study. At this time, the lOOT has concluded that the moratorium for Highway 20 from Bluff Street to Cherokee Drive/Collins Street is no longer needed. The lOOT has requested that the City extend the moratorium for Highway 20 from Bluff Street east to the City limits for another twelve months, to reduce impacts in the study area. The lOOT has provided a map of the moratorium area for the U.S. 20 Study. RECOMMENDATION I recommend that the City Council extend the building permit moratorium for Highway 20 from Bluff Street east to the city limits for 12 months, as requested by the IDOT in connection with the U.S. 20 Mississippi River Crossing Study. I further recommend that the City Council allow the moratorium for Highway 20 from Bluff Street to Cherokee Drive/Collins Street expire. With approval of the attached resolution and map, the City Council will extend the moratorium from Bluff Street east to the city limits until May 1, 2001.
