RESOLUTION OF INTENT TO DISPOSE OF CITY INTEREST IN LOT 2 OF 6 OF
MINERAL LOT 322, DUBUQUE, IOWA
Whereas, Dubuque Stamping & Manufacturing has requested the purchase of a
portion of Lot 6 of Mineral Lot 322,
Whereas, IIW Engineers & Surveyors, P.C. has prepared and submitted to the City
Council a plat showing said portion of Lot 6 of Mineral Lot 322 and assigned lot numbers
thereto, which hereinafter shall be known and described as Lot 2 of 6 of Mineral Lot 322
in the City of Dubuque, Iowa; and
Whereas, the City Council of the City of Dubuque, Iowa has determined that this
parcel is no longer required for public use, except for utility easements as noted, and sale
of said parcel known as Lot 2 of 6 of Mineral Lot 322 in the City of Dubuque, Dubuque
County, Iowa should be approved.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That the City of Dubuque intends to dispose of its interest in Lot 2 of
6 of Mineral Lot 322 in the City of Dubuque, Iowa.
Section 2. That the conveyance of Lot 2 of 6 of Mineral Lot 322 in the City of
Dubuque, Iowa to Dubuque Stamping & Manufacturing be contingent upon the payment
of $1.00, plus platting, publication and filing fees,
Section 3, The City of Dubuque reserves unto itself a perpetual easement
including the right of ingress and egress thereto, for the purpose of erecting, installing,
constructing, reconstructing, repairing, owning, operating, and maintaining water, sewer,
drainage, gas, telephone, tv. cable, and electric lines as may be authorized by the City of
Dubuque, Iowa, as shown on the plat of survey of Lot 1 of 6 and Lot 2 of 6 of Mineral Lot
322, No structure shall be built over the easement area.
Section 4. That the City Clerk be and is hereby authorized and directed to cause
a notice of intent to dispose of said real estate to be published in the manner as prescribed
by law.

Disposal of Property
INTRODUCTION
This is in response to a March 24, 2000 request from Dave Spahn representing
Dubuque Stamping & Manufacturing for the purchase of Lot 6 of Mineral Lot 322 in
the City of Dubuque, Dubuque County, Iowa.
DISCUSSION
.
The attached plat prepared by IIW Engineers & Surveyors, P.C., shows the area
proposed to be disposed of which is legally described as Lot 2 of 6 of Mineral Lot 322
in the City of Dubuque. The abutting property is owned by the City of Dubuque and
utilized for the North End Trail.
Lot 6 of Mineral Lot 322 was obtained from the Chicago Northwestern Railroad,
formerly C.G.W.R.R., by Quit Claim Deed along with other lots and rights-of-way along
the railroad corridor. The North End Trail project was constructed on these parcels in
1999. The majority of the right-of-way on which the Trail is constructed is 50 feet
in width. The portion of the Trail adjacent to the proposed request of Dubuque
Stamping & Manufacturing is, however, 80 feet in width. An ingress and egress
easement previously had been granted to Dubuque Stamping & Manufacturing across
33 feet of the 80 foot-wide parcel. There are existing City utilities including sanitary
sewer and watermain in the areas to be disposed of.

Dubuque Stamping & Manufacturing has requested to purchase this ingress and egress
easement in order to construct loading docks. They have also agreed to relocate any
existing utilities that may be in conflict with future construction plans. The City will
retain an easement over the existing utilities for maintenance and reconstruction and
will prohibit any building over or within 10 feet of the existing utilities. The proposed
purchase area does not currently drain properly. Dubuque Stamping & Manufacturing
has indicated their improvements will correct this draining problem and improve the
aesthetics of the Trail corridor.

A purchase price of $1 .00 has been agreed upon, with Dubuque Stamping &
Manufacturing paying the cost of surveying, platting, filing, and publication fees and
the costs of relocating any City utilities if needed.
RECOMMENDA TION
The City has no plans for the utilization of the requested portion of Lot 2 of 6 of
Mineral Lot 322 in the City of Dubuque to be disposed of, except for reserving access
and utility easements as noted.
I would recommend that the requested portion of Lot 2 of 6 of Mineral Lot 322 in the
City of Dubuque be disposed of, and that a public hearing be set for the disposition of
the City's interest in the subject area on April 17, 2000. I would further recommend
that the purchase price be established at $1.00, plus surveying, platting, filing, and
publication fees and the costs associated with the relocation of any City utilities.
ACTION TO BE TAKEN
City Council is requested to approve the recommendation of the City Manager and set
a public hearing on the disposal of the property through adoption of the enclosed
resolutions.

RESOLUTION APPROVING PLAT OF SURVEY OF LOT 1 OF 6 AND LOT 2 OF
6 OF MINERAL LOT 322
Whereas, there has been presented to the City Council of the City of Dubuque,
Iowa, a plat dated March 28, 2000, prepared by IIW Engineers & Surveyors, P,C"
describing the division of Lot 6 of Mineral Lot 322 in the City of Dubuque, Dubuque County,
Iowa; and
Whereas, said plat conforms to the laws and statutes pertaining thereto,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the plat dated March 28, 2000, prepared by IIW Engineers &
Surveyors, P.C., relative to the real estate hereinabove described be and the same is
hereby approved, and the Mayor and City Clerk be and they are hereby authorized and
directed to execute said plat and on behalf of the City of Dubuque, Iowa.
Section 2. The City of Dubuque reserves unto itself a perpetual easement including
the right of ingress and egress thereto, for the purpose of erecting, installing, construction,
