NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That the City intends to dispose of its interest in real property by clarifying the leased limits of the Lease Agreement as shown by Lease Area A on the exhibit attached to the Third Amendment to Lease Agreement. Section 2. That the City Clerk be and is hereby authorized and directed to cause a notice of intent to dispose of said real estate to be published in the manner as prescribed bylaw. Van Milligen, City Manager Mike Koch, Public Works Director #t ¡(~/; A r Laura Carstens, Planning Services Manager ~~ Reconfiguration of the Dubuque Yacht Basin Lease SUBJECT: INTRODUCTION Over the past year, Legal, the Planning and Engineering staffs have worked with Mr. Don Shanley and his attorney, Mr. Art Gilloon, to resolve outstanding lease issues regarding the Dubuque Yacht Basin lease property on Chaplain Schmitt Island. DISCUSSION . The Dubuque Yacht Basin was initially issued a violation letter by the Planning Services Division for: 1) expansion of the marina beyond the lease area; 2) expansion of the marina into a HI Heavy Industrial Zoning District that does not permit pleasure craft harbors; 3) fencing of a portion of City property that lies outside of the leased area; and 4) accumulation of junk and salvage material on the lease property. After subsequent meetings, City staff and Mr. Shanley agreed to redraw the lease boundary to encompass the area currently being used for the marina and to allow enough space for expansion and realignment of the docks within the new boundary. The attempt was not to increase the acreage of the lease, but rather to clarify the intended limits of the lease, and thus avoid the need for future interpretation. If the amended lease boundary and amended language is approved by the City Council, and Mr. Shanley submits an application for a rezoning from Heavy Industrial to Commercial Recreation along the new boundary of his leased area, all of the outstanding issues will have been resolved (the junk and salvage material has been removed from the lease property). RECOMMENDATION . I recommend that the City Council approve the amended lease boundary and amended language for the Dubuque Yacht Basin lease. Enclosed are three resolutions adopting the lease amendments as outlined above. . . . I received the attached letter from Mike Koch dated May 1 regarding the Yacht Basin's )' Lease Amendments, and I have had Don sign all three Amendments. I am sending these to you rather than Mike only because I discovered one small typographical or scrivener's error. I knew it would be too good to be true if we did not have at least one. Resolution 156-00 refers to the Amendment to Lease Agreement dated 11/23/87, which had been amended twice before. We have executed the Third Amendment. Unfortunately, Resolution 156-00 is a "Resolution Approving First Amendment to Lease Agreement Dated November 23, 1987." The body of the Resolution correctly refers to the Amendment being the Third Amendment, but the heading for the Resolution says it is the First Amendment. I guess I do not think this is a big deal if you don't, but perhaps an Affidavit regarding the scrivener's error would be wise to file with the Resolution. Let me know what you think. Don Shanley has signed the Lease Amendments, and I have sent them on to Barry Lindahl with the enclosed letter so that Barry would be alerted to the typographical error in Resolution 156-00. Perhaps you have run across this in the past, and maybe an Affidavit is a good way to fix It, or you might have a better suggestion. I would also note that with your letter of May 1, I did not receive "certified" copies of the Resolutions, they were just plain ordinary copies. I did receive originai Lease Amendments signed by the Mayor, and those are the ones I had Don sign and which I have forwarded to Barry Lindahl.
