INTRODUCTION
This memorandum is to request the execution of a Budget Increase Request for
Continued Environmental Consulting Services between MWH America's, Inc. (MHW)
and the City for the Water Pollution Control Plant (WPCP) Modifications Project. This
proposal request relates to the continued environmental engineering services
necessary for the mercury spill and the former petroleum product underground
storage tank (UST) at the WPCP site.
DISCUSSION
This change order request in the amount of $25,000 provides for the following
mercury- related, clean -up activities:
$ 4,000 Complete the final reporting for the mercury remediation in the trickling
filter basins; provide associated support and interaction with the Iowa
Department of Natural Resources (IDNR) as requested.
$16,000 Review report and estimates being provided by Exponent, Inc for
mediation preparation, attend mediation for the City and the site
contractor and prepare cost estimates for MWH's time and expenses
relative to the investigation and remediation of historic mercury releases.
$ 5,000 Review and provide comments to the City on the Tier 2 Site Cleanup
Report prepared by Seneca, Inc. to the IDNR; provide associated follow -
up Report activities as proposed by Seneca and /or the IDNR.
BUDGET IMPACT
This fourth request brings the contract total to $174,600. (Note: The previous
increases were $57,500, $48,700, and $23,400.) The increase will be paid from the
contingency funds of the construction project, with a current balance of
$1,378,202.28.
ACTION TO BE TAKEN
The execution of a budget increase request for continued environmental consulting
services with MWH Americas, Inc. in the amount of $25,000 is requested.

Dear Mr. Sampson Brown:
MWH Americas, Inc. (MWH) appreciates the opportunity to submit this proposal to provide
continuing environmental engineering assistance to the City of Dubuque, Iowa (City) relating to
the mercury spill and the former petroleum product underground storage tank (UST) at the
City's water pollution control plant (WPCP) site. This proposal is intended to include 1) final
preparation of the mercury remediation report, and submittal of the report to the Iowa
Department of Natural Resources (IDNR) and others; 2) assistance to the City regarding
potential cost allocation, and mediation for remediation costs between historic mercury releases
and the recent spills; and 3) general consulting assistance associated with the closure reporting
for the former on -site UST and other tasks as requested by the City. More detailed descriptions
of the proposed activities for these three general tasks are outlined below.
Task I — Mercury Remediation Sampling and Reporting
Activities to be conducted under this task are intended to complete the final reporting for the
mercury remediation in the trickling filter basins. The final report will be prepared in hard copy
and in an interactive electronic pdf format. MWH will also continue to coordinate with the
remediation contractor, North Shore Environmental Construction, Inc. (North Shore), as needed,
to address any additional comments received from the IDNR. No additional on -site time is
anticipated; however, MWH will also provide support and interaction with the IDNR, as
requested by the City.
Task II — Cost Allocation Assistance
Under this task, MWH will prepare cost estimates for MWH's time and expenses relative to
investigation and remediation of historic mercury releases and the September 2010 spill. MWH
will also attend the mediation between representatives for the City and the site contractor.
MWH- understands the purpose of the mediation is to assign costs related to historic spills

versus those resulting from the September 2010 spill. It is assumed the mediation will be held
for one day in Dubuque, Iowa and will be attended by Randy Kronemari of MWH's Des Moines,
Iowa office. MWH will also provide support to the City, as requested, to review the report and
estimates being prepared by Exponent, Inc.
Task III — UST and General Assistance
MWH will review the Tier 2 Site Cleanup Report (Tier 2 SCR) report to be prepared and
submitted to the IDNR by Seneca, Inc. (Seneca), for the leaking UST formerly located northeast
of the WPCP administration building, and provide comments to the City. Based on the
analytical results of sidewall soil samples collected by Seneca during the over excavation of
impacted soil, the site failed to meet the IDNR Tier 1 screening levels; therefore, a Tier 2
evaluation is required. MWH will also provide comments on any other related activities
proposed by Seneca or requested by the IDNR. MWH understands an extension for submitting
the Tier 2 report was requested and granted by the IDNR. The Tier 2 report is due January 1,
2012. The proposed activities will be conducted under the supervision of an Iowa - Certified
Groundwater Professional; and in compliance with requirements of Chapter 135 of the Iowa
Administrative Code (IAC), and associated IDNR guidance documents.
Under this task, MWH will also provide general consulting services for the WPCP, as requested
by the City. These activities are assumed to include collection of up to six sediment samples
from drain traps in the WPCP on -site laboratory. The samples will be submitted for analysis of
total mercury and results provided to the City. Other activities may include recommendations
for disposal or management of materials generated or discovered during the WPCP renovation.
ESTIMATED COSTS
The tasks will be completed on a time - and - materials basis in accordance with the October 18,
2010 Consulting Services Agreement (CSA) and MWH's current "Fee Schedule," attached. The
estimated cost to complete the tasks identified above is approximately $25,000, as indicated in
the following table:

• Other Out -of- Pocket Expenses, including travel expenses and shipping expenses (UPS /FedEx for reports,
materials, supplies, and laboratory samples), will be invoiced at actual cost plus ten (10) percent for general and
administrative expenses.
• Health & Safety, Field and Construction Equipment will be invoiced according to MWH AMERICAS, INC.'s
standard unit rates. A partial list is available upon request.
• Leased and personal vehicle usage will be invoiced as follows (rental vehicles will be charged at actual cost
plus 10 %):

• Associated project expenses, including telecommunications (equipment, local and long distance charges),

5 copies) will be invoiced at $10.40 per total labor hour, in lieu of detailed invoicing of the specified items.
• A surcharge of fifty (50) percent will be added to hourly rates for expert witness testimony, participation,
preparation time, hearings, depositions, etc.
• Rates for Computer -Aided Design and Drafting equipment, when required, will be invoiced at the rate of $15.00
per hour.
• A surcharge for Contractors Pollution Liability Insurance coverage on Remediation /Construction activities will be
negotiated for each contract where required.
• The above rates are subject to change January 1 of each year.
• A service fee will be added to the unpaid balance after 30 days at the rate of eighteen (18) percent per year.
