Oak Meadow Sanitary Sewer AccepRESOLUTION NO. 144-00 ACCEPTING SANITARY SEWER IN OAK MEADOW SECOND ADDITION / Whereas, pursuant to Resolution Nos. 95-92 and 1-96, certain improvements / including sanitary sewers were installed by the developer of Lots 1, 2, and A of Block 1 an~ Lots 1, 2, and A of Block 2 of Oak Meadow Second Addition; and Whereas, the sanitary sewer has been completed and the City Manager has examined the work and has filed a certificate stating that the same has been completed in accordance with the plans approved by the City Council and in conformance with City specifications, and has recommended that the sanitary sewer be accepted by the City Council. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That the recommendation of the City Manager be approved and that said sanitary sewer in Lots 1, 2, and A of Block 1 and Lots 1, 2, and A of Block 2 of Oak Meadow Second Addition be and the same is hereby accepted. Section 2. That maintenance of said sanitary sewer shall be the responsibility of the contractor and the owner until April 29, 2000. Passed, approved and adopted this ~ day of Terrance M. Koch, Public Works Director ïrl¡(~1 SUBJECT: Acceptance of Sanitary Sewer in Oak Meadow Second Addition INTRODUCTION The enclosed material provides for City Council acceptance of the sanitary sewer which the developer, Stock Construction Co., completed in Lots 1, 2, and A of Block 1 and Lots 1, 2, and A of Block 2 of Oak Meadow Second Addition in 1991 and 1997. BACKGROUND . As a condition of subdivision plat approval through Resolution Nos. 95-92 and 1-96, the developer of Oak Meadow Second Addition was required to install certain improvements including sanitary sewers, and to dedicate the improvements to the City upon completion. The developer of Oak Meadow Second Addition has completed the improvements and has formally requested the City's acceptance of the public improvements which have been installed. DISCUSSION The Subdivision Ordinance requires that upon completion of all the required public improvements, the subdivider shall notify the City in writing of the completion of the improvements, requesting that the City either approve or reject the acceptance of the improvements, together with a statement of reasons for any rejection. On November 17, 1999, Stock Construction Co. requested City's acceptance of the improvements in Lots 1, 2, and A of Block 1 and Lots 1, 2, and A of Block 2 of Oak Meadow Second Addition. Upon inspection by the City, it has been determined that the sanitary sewer required by Resolution Nos. 95-92 and 1-96 has been completed in accordance with plans approved by the City Council and in conformance with City specifications. . . . . .. . RECOMMENDATION I would therefore recommend that the City Council accept the sanitary sewer. Maintenance of said sewer shall be the responsibility of the contractor, McDermott Excavating, and owner, Stock Construction Co., until April 29, 2000.
