Utility Relocate Costs Old MainRESOLUTION NO. 149-00 RESOLUTION APPROVING FINAL PAYMENT TO INTERSTATE POWER COMPANY, NOW KNOWN AS ALLIANT ENERGY, US WEST COMMUNICATIONS, TCI OF IOWA, INC, NOW KNOWN AS ATT CABLE SERVICES, AND STEVE ULSTAD ARCHITECTS FOR THE OLD MAIN FREEWAY FRONT AGE IMPROVEMENT PROJECT AND REQUESTING FINAL REIMBURSEMENT OF INTERMODAL SURFACE TRANSPORTATION EFFICIENCY ACT (ISTEA) ENHANCEMENT FUNDS. Whereas, the City of Dubuque, Iowa has received federal Intermodal Surface Transportation Efficiency Act (ISTEA) funding from the Iowa Department of Transportation under the Statewide Enhancement Funding Program for the Old Main Freeway Frontage Improvement Project; and Whereas, the Old Main Freeway Frontage Improvement Project consists of placing underground the overhead wires in a four block area of downtown Dubuque adjoining U.S. Highway 61-151; and Whereas, Utility Relocation Agreements between the City of Dubuque and Interstate Power Company, US West Communications and TCI ofIowa, Inc. to relocate their above ground facilities underground between 4th Street and the Locust Street connector were approved by the City Council on July 7, 1997 by Resolution No. 276-97, and Whereas, the project has been completed and the City concurs with the final audit completed by the Iowa Department of Transportation ofthe project costs. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1.That the Utility Relocation Agreement between the City of Dubuque and Interstate Power Company, now known as Alliant Energy, is hereby approved as complete for a total final cost of$413,619.39. Section 2.That the Utility Relocation Agreement between the City of Dubuque and U.S. West Communications is hereby approved as complete for a total final cost of $31,036.85. Section 3.That the Utility Relocation Agreement between the City of Dubuque and ATT Cable Services (TCI ofIowa, Inc.) is hereby approved as complete for a total final cost of $24,341.90. Section 4. That the Construction Management contract between the City of Dubuque and Steve Ulstad Architects is hereby approved as completed for a total final cost of $43,168.69 for project management of the Old Main Freeway Frontage Improvement Project. . . . Section 5. That the City Treasurer is hereby directed to make payments to Alliant Energy, US West Communications, ATT Cable Services and Steve Ulstad Architects in the above stated amounts. Section 6. That the City Manager be and he is hereby authorized to request reimbursement from the Iowa Department of Transportation for the Intermodal Surface Transportation Efficiency Act (ISTEA) Enhancement Funds in the amount of $375,198.51 for the above project. " CITY OF DUBUQUE, IOWA MEMORANDUM April 11,2000 TO: FROM: SUBJECT: Old Main Freeway Frontage Improvement Project Utility Relocation Final Payment Introdnction This memorandum presents for City Council approval the acceptance of the utility relocation costs for the Old Main Freeway Frontage Improvement Project. The attached resolution would authorize final payment to Interstate Power Company( Alliant), US West Communications and TCI ofIowa, Inc(ATT Cable Services) and request reimbursement from IDOT for ISTEA funds. Backeround The City of Dubuque received a ISTEA grant from the Iowa Department of Transportation for Intermodal Surface Transportation Efficiency Act funding to improve the Old Main district's tTontage along u.S. Highway 61-151 by removing overhead wires. The grant provided for 80% funding up to $403,950 for the project. The local match for the project was funded with tax increment financing tTom the Downtown Urban Renewal District as authorized by the City Council The project was primarily reconstruction of public utility systems and the work was completed by each utility or by contractors working for them. For this reason, utility relocation agreements were used in place of construction contracts. The utility relocation agreements with Interstate Power Company, US West Communications and TCI ofIowa, Inc. were approved by the Council by Resolution 276-97 on July 7, 1997. Discussion The project was completed in February, 1998. It provided an underground utility system in a four block area of downtown Dubuque tTom 41h Street to the Locust Street connector and removed overhead utility lines. The cost of the project was estimated at $477,349. The City was approved for 80% of the project costs in Intermodal Surface Transportation Efficiency Act (ISTEA) Enhancement Funds tTom the Iowa Department of Transportation, with 20% local match being provided tTOI;n City Tax Increment Finance funds. " . . . The original utility relocations agreements provided for estimated costs of $477,349. The Iowa Department of Transportation has completed an audit of the projects and has certified a utility cost of$468,998, with reimbursement ofISTEA funds of$375,198. Separate from this amount is a project management expense of $43,168.69 paid to Steve Ulstad Architects. The chart below identifies the difference in the actual versus approved costs for the project. Recommendation I recommend that the City Council approve the attached resolution authorizing final payment for the Old Main Freeway Frontage Improvement Project to Interstate Power Company, now known as Alliant Energy, US West Communications, and TCI of Iowa, Inc, now known as A TT Cable Services. Upon final payment, reimbursement for the ISTEA grants will be requested from IDOT. Action Step The action step is for the City Council to adopt the attached resolution.
