Planning Services Manager Laura Carstens is recommending approval of two plan amendments required by the Iowa Secretary of State prior to final State approval of the plan submitted by the City. The Redistricting Plan must be submitted by September 1, 2011. Dubuque ktittild All- America City 1 111 1' 2007 DISCUSSION At the August 1, 2011 City Council meeting, the City Council approved the 2011 Redistricting Plan for Wards and Precincts for the city of Dubuque. This plan included an Ordinance with the metes and bounds description of the wards and precincts, a Map indicating the new ward and precinct boundaries, and a Joint City /County Precinct Agreement for those precincts that transcended the city limits and included unincorporated portions of Dubuque County. Shortly after approval, the plan was submitted to the Secretary of State for the State of Iowa via their electronic submittal website. The Secretary of State has reviewed the plan and recommended two changes that are required for approval of the plan. The changes are as follows: 1. The metes and bounds description of Precinct No. 15 and the Joint City /County Precinct Agreement referenced Julien Township as part of the legal description. The state informed Planning staff that Julien Township has been eliminated and is no longer a valid township. They recommended that the township name be replaced with a Census Block No. 190610101031004. This change has to be made in both the Joint City /County Precinct Agreement and in the metes and bounds description for Precinct No. 15 in the Ordinance and resubmitted. This change does not require a public hearing as there is no change to the ward or precinct boundaries or to the population numbers. 2. Staff provided annexation history for the City of Dubuque from January 1, 2010 to the present as part of the required submittal for the redistricting plan. Secretary of State Staff noticed that the two -acre annexation of the Knepper property along Amendment to 2011 Redistricting Plan for Wards and Precincts August 17, 2011 Creekwood Drive transcended a census block boundary, therefore, bisecting the block. Secretary of State Staff have asked that the City excise this lot, placing it in a County precinct. There are no residents in this property. This change must be included on the Joint City /County Precinct Agreement. City Staff has made the recommended changes to the metes and bounds description for the census block replacing Julien Township and the boundary changes for Precinct No. 1, as shown in bold in the enclosed Ordinance. Staff has made the recommended boundary changes on the enclosed Ward and Precinct Map. The Dubuque County Auditor's Office has revised the enclosed Joint City /County Precinct Agreement to reflect the census block change and to reflect the placement of the two -acre Knepper annexation parcel into a County Precinct 45. State Code requires a public hearing be held approving the change. State Code requires that the County Auditor review and comment on the 2011 Redistricting Plan. City Staff has worked closely with the Auditor's Office and Secretary of State on the amendment to the 2011 Redistricting Plan, Ordinance, Map, and Agreement. The revised plan must be submitted to the State by September 1, 2011. RECOMMENDATION Staff recommends that the City Council approve the modified 2011 Redistricting Plan Ordinance, Ward and Precinct Map and Joint City /County Precinct Agreement. After review, this Office has found issues with the plans which obligate us to reject them and return them to you. ■ Because Dubuque has an annexation (Nepper annexation) that does not follow a census block, the city and county need to enter into an agreement for a joint city- county precinct involving that annexation and a portion of Table Mound township. The annexation divides census block 190610101053004 of 104 people. The agreement should pull that census block into Dubuque 1 precinct. The precinct population will still be below 3,500 and it will not affect the ward variation. • The current joint agreement and city's ordinance for precinct 12 refers to Julien Township. The Census Bureau does not have a Julien Township on record, so our office cannot verify that area. Please revise the joint agreement and ordinance for precinct 15 to refer to the area in another method. This Office suggests using the census block number: 190610101031004. Please resubmit the plans with a corrected worksheet with the unincorporated population changes due to the annexation, map, and corrected joint agreement. Definitions and rules of construction For purposes of this chapter, unless the context otherwise requires, the following definitions and rules or construction shall be applied. Points of the compass are approximate unless otherwise stated. All names, boundaries, lines, features and fixtures are to be construed as they existed on the effective date of this chapter. Annexed territory means territory annexed to the City after the effective date of this chapter. City includes all territory within the corporate limits of the City of Dubuque and all annexed territories. Commissioner of elections means the County Auditor of Dubuque County. Corporate limits mean the corporate limits of the city on the effective date of this chapter. Street or similar language means the centerline of the right -of -way and a straight extension of that centerline. Section 1 -8 -2. Correction of errors. (a) Correction of errors. If this chapter fails to place any part of the city within a precinct or ward established by this chapter, the Commissioner of Elections shall assign the omitted area to an adjacent precinct or ward within the same legislative district. If this chapter places any of the city in more than one precinct or ward established by this chapter, the Commissioner of Elections shall assign that territory to an adjacent precinct or ward within the proper legislative district. The Commissioner of Elections may also correct obvious clerical errors in this chapter.
