Van Milligen, City Manager SUBJECT: IIW Contract Amendments for the Dubuque Industrial Center West 3rd Addition Acting Economic Development Director Pam Myhre is recommending City Council approval of amendments #3 and #4 to the contract with IIW for design and engineering of the proposed 150-acre expansion of the Dubuque Industrial Center West. Amendment #3 for $41,000, breaks out the RISE-eligible costs for design of Chavenelle Road. Most of this work was included in the original contract, but has been moved to a separate contract because of IDOT requirements. Amendment #4, for $80,200, reflects new work involving design of a recreation trail (including incorporating the planned trail around Bergfeld Lake), Phase 1 Cultural Resources inventory, environmental mitigation requirements and design of a rail spur to serve the 3rd Addition. The City has also asked IIW to assist with conceptual development plans for an industrial prospect. The original contract for the new 3rd Addition was for $149,000 and Amendments #1 and #2 added approximately $17,600 to the contract. The new contract total is for $257,808.75. The original contract for the new 3rd Addition work was for $149,000. Since that time, two limited amendments, #1 and #2, were made to the contract for approximately $17,600 to plan for the extension of the sanitary sewer north to Middle Road and provide a conceptual design for the North Siegert farm. This memorandum seeks City Council approval of amendments #3 and #4 to the contract. Discussion As the City moved into design work with IIW on the development of the expansion to the DICW, additional work items were added to the consultants' scope of work at the City's request. The new contract total is $257,808.75. It is, overall, less than the standard 5% of construction costs considered reasonable for engineering fees. Amendment #3, for $41 ,000, breaks out the RISE-eligible costs for design of Chavenelle Road. Prepare a final statement of Engineer's opinion of probable construction cost. 6. Prepare regulatory review submittals with supporting documentation to make application for permits. 7. Provide copies of drawings, specifications, contract, and bidding documents to interested contractors. The Owner will distribute plans and maintain a plan holder's list. 8. Answer questions from contractors and suppliers, and prepare addenda. 9. Attend a pre-bid meeting if required by the Owner. 10. Assist the Ownet in evaluating bids, and making a recommendation for the award of the contract. C. SERVICES DURING CONSTRUCTION I. Project administration including meetings and project related correspondence. 2. Review shop drawings. 3. Periodically visit the project site at intervals appropriate to the stage of construction to become generally familiar with the progress and quality of the work, and determine in general if the work is being performed in substantial compliance with the contract documents. Inform the Owner of the progress and quality of work, and inform the Owner of defects and deficiencies. 4. Consult with and advise the Owner, and act as its representative as provided in the construction contract general, supplemental, and special conditions. 5. Review the Contractor's applications for payment and supporting data, determine the eligible amount of payment to the Contractor, and approve payments. By approving an application for payment, the Engineer shall not be deemed to have represented that he has made any examination to determine how, or for what purposes, any Contractor has used the moneys paid on account of the Contract Price. 6. Conduct an inspection to determine if the project is substantially complete and a fmal observation to determine if the project has been completed in accordance with the Contract Documents, and if each Contractor has fulfilled their obligations to approve final payment to each Contractor. Participate in correspondence with'-'to assist the Owner. 04119-09 Environmental Mitigation The scope of the project includes environmental mitigation of aquatic resources identified through wetland delineation and regulatory determinations provided by Mr. John Betker, U.S. Army Corps of Engineers, Rock Island. Based upon the preliminary submittal to Mr. Betker dated September 7"', 2004, the proposed project disturbs enough delineated wetlands and channel habitat to require an individual permit and an aquatic resources mitigation plan. Professional services will be provided by, or under the direct personal supervision of, a Professional Engineer licensed to practice in the State ofIowa. A. PRELIMINARY AND FINAL DESIGN I. Project administration including meetings and project related correspondence. 2. Research regulatory requirements. 3. Prepare an application for an individual permit to the U.S. Army Corps of Engineers. 4. Prepare an aquatic resources mitigation plan for activities disturbing wetlands and channel habitat. 5. Coordinate and include requirements for mitigation of 0.22 acres associated with the University Avenue Extension Project. 6. Prepare wetland mitigation design including grading, planting plans, and planting schedules. 7. Prepare channel mitigation design including channel stabilization measures, habitat improvement techniques, and channel re-alignment. 8. Prepare technical specifications for wetland and channel mitigation. ! 04119-10 Phase I Cultural Resources Investigation, McFadden Farm Chavanelle Road Corridor The scopc of the project includes providing a Phase I cultural resources investigation for the portion of Chavanelle Road extending through the McFadden Farm comprising approximately 5.8 acres. Bear Creek Archeology provided phase I investigations on the Bergfeld Farm (BCA #612), and the Siegert Farm (BCA #528), however a phase I investigation has not been performed on the McFadden Farm. According to Mr. John Betker, U.S. Army Corps of Engineers, Rock Island, a cultural resources investigation is required for disturbed areas within the project area. Professional services will be provided by, or under the direct personal supervision of, a Professional Engineer licensed to practice in the State ofIowa. A. INVESTIGATION AND REPORT I. Project administration including meetings, coordination, scheduling, and project related correspondence. 2. Phase I Cultural Resources Investigation by Bear Creek Archeology as follows: a. Review of archeological and historical records. b. Field investigations including shovel testing or bucket augering in locations with deep site potential. c. Geoarcheological assessments. d. This does not include advanced testing (Phase II) of archeological sites encountered during the investigation. 04119-12 Railroad Spur The scope of the project includes providing a rail spur from the Canadian National (eN) Railroad mainline tracks extending along the south edge of the project with a spur extending north as illustrated on the" conceptual plan. . Assist the Owner in evaluating bids, and making a recommendation for the award of the contract. 04119-13 Recreation Trail The scope of thc project includes providing two trail components, one around the Bergfeld pond and the other extending through the industrial park project area and terminating near Middle Road. This also includes providing a parking area adjacent to the side street near the location where the trail would cross Chavanelle Road, as illustrated on the preliminary plans for the mcw 3 project. Ms. Pam Myhre January 11,2005 Page 4 of 5 Based upon our meeting on site on December 27'" 2004, the primary objective for the trail around the Bergfeld Pond is to reduce the costs of the Phase I Preliminary Analysis and Concept Design prepared by WHKS & Co, dated July 7",1999. Subsequently, we've attached a photocopy of an exhibit to illustrate the extent of the trail around the Bergfeld Pond with a revised alignment to follow the existing terrain and significantly reduce grading costs. We will include evaluating a paved trail with two cross section alternatives. One which is 5 foot wide and meets ADA requirements with respect to grades, and the other alternative will investigate a I 0 foot wide trail which meets the requirements in the AASHTO Guide for the Development of Bicycle Facilities. Preliminary design will include an evaluation of an alignment that would also serve as a sidewalk for that portion of Seippel Road adjacent to the pond area. A cost estimate will be developed for each cross section alternative and design approval obtained before proceeding with final design for that portion of the trail. The portion of the trail around Bergfeld pond will be developed as a bid alternate to be let with the paving and utilities contract for the industrial park project. Based upon our meeting on December 27th, 2004, we discussed including the Whitewater bridge in the design of the trail around the Bergfeld Pond. We contacted Laura Carstens regarding the scope of work included in the grant, which we understand includes an assessment of how to move the bridge, design and construction of new abutments, and costs associated with moving and setting the bridge. It is our understanding the grant application included locating the bridge over the spillway near the southeast comer of the Bergfeld Pond. In developing a revised alignment for the trail, we've considered another possible location as illustrated to enhance the trail, and place the bridge in a more prominent location. Subsequently, our scope of services includes evaluating possible locations for the bridge as part of the trail alignment analysis however, this proposal does not include the services corresponding with the grant since the schedule for the relocation of the bridge is not compatible with the trail. The portion of the trail extending through the industrial park area will meet ADA slope requirements graded to a width to accommodate a future paved trail 10 feet wide with 2 foot wide shoulders meeting the AASHTO Guide for the Development of Bicycle Facilities. Professional services will be provided by, or under the direct personal supervision of, a Professional Engineer licensed to practice in the State ofIowa. A. PRELIMINARY; DESIGN I. Establish design criteria for horizontal and vertical alignment, grading, drainage for the trail extending through the industrial park area. Establish design criteria for the two cross section alternatives meeting ADA and/or AASHTO requirements for a paved trail connecting with the existing fishing pier at Bergfeld Pond and extending around the pond. 3. Alternative analysis of conceptual designs with consideration for earthwork, horizontal and vertical alignment, drainage, pavement design, and parking. 4. Perform a topographic survey along the trail corridor illustrated on the attached exhibit, including collecting data in areas where the Whitewater bridge may be located. 5. Provide preliminary design plans. 6. Provide a preliminary construction cost estimate. 7.
