SUBJECT: FY 2005 Annual Action Plan - Amendment 2 l~l
Housing and Community Development Department Director David Harris is
recommending City Council approval of changes in the City's Community Development
Block Grant (CDBG) FY 2005 Annual Action Plan. These changes will allow CDBG
funds to be used to meet citizens' needs and facilitate the timely expenditure of funds,
as required by HUD. The recommended changes reallocating the contingency funds
and the FY 2005 encumbrances and carryovers are as follows:
o $200,000 for the Washington Court Project, which involves the adaptive reuse of
the Dubuque Casket Company Building at 1798 into 36 affordable rental housing
units;
o $78,000 to the Dubuque Area Labor Harvest for the acquisition of 423 West
Locust for their food distribution program, which needs to be relocated from 1159
White due to new downtown school;
o $13,000 for the creation of a Bishop Block Community Room at 90 Main;
o $8,264 for the Community Partnership (cp2) program;
o $5,800 for Housing Rehabilitation for computers and printers;
o $3,300 for CDBG Administration for computer and printers; and
o $2,467 contingency.

INTRODUCTION
The purpose of this memorandum is to request the City Council's approval of the
attached resolution approving an amended and restated Fiscal Year 2005 Annual
Action Plan for the City's Community Development Block Grant (CDBG) program.
BACKGROUND
Housing and Urban Development (HUD) regulations require that each year a city must
prepare and file an Annual Plan prior to receipt of its CDBG entitlement. The Annual
Plan is adopted following a public participation process that includes a published
notice, a public comment period, and a public hearing. A city must follow its adopted
plan as it expends entitlement funds. If its revenues or activities change, the city must
amend. This requirement applies to plans for previous years as well as the current
year.
The City of Dubuque has been allocated CDBG funds that have been programmed for
specific uses as per the adopted Annual Plan for Fiscal Year 2005. Since the funds
from FY 2004 have not been completely expended, the previously adopted plan
remains in effect unless amended to reflect the change in projects, activities or funding
need.
DISCUSSION
The proposed amendment to the FY 2005 plan combines the allocations from the
previous year with the current program year. These changes will allow us to respond to
the needs of the community, improve community understanding ofthe programs and
facilitate the timely use of funds as required by HUD.
The current FY 2005 adopted Annual Action Plan allocated $2,115,086 to programs.
The FY 2004 HUD balance as of July 1 2004 was $2,022,668. Also as of this date, the
City had a remaining balance of $68,042. Together, these funds total $4,205,796,
which is now available for reprogramming.

A contingency of $293,467 was initially shown after the encumbrances and carryovers
from FY 2004 were reallocated into the FY 2005 plan. The Commission directed
requests be taken for new proposals for public facilitiesl improvements or housing
projects. The following proposals were received at the November 22, 2004 public
hearing:

The Community Development Advisory Commission held another public hearing on
January 12, 2005. At that time, the Commission approved the following additional
projects:
o $200,000 for the Washington Court Project, which involves the adaptive reuse of

The Commission also reallocated the FY 04 encumbrances and carryovers into the FY
2005 Annual Plan, plus provided additional funding for the following activities:
o $8,264 for the Community Partnership (cp2) program to reflect additional funding
allocated by the Annual Plan Amendment #1 but not previously added to the FY
2005 budget;
o $5,800 for Housing Rehabilitation for computers and printers previously
proposed for FY 2006;
o $3,300 for CDBG Administration for computer and printers previously proposed
for FY 2006;
o $2,467 contingency
Public notices regarding the proposed changes were published prior the public
hearings in the Telegraph Herald and Dubuque Advertiser. These notices advised to
the public of the intent of the amendment, invited comment and noticed the public
hearing. This initiated a 30-day public comment period as required in the Citizen
Participation Plan.
RECOMMENDATION
It is recommended that the City Council approve the amendment to the FY 2005 Annual
Plan as shown an Exhibit A for the use of Community Development Block Grant funds.
These changes will allow CDBG funds to be used to meet citizens' needs and facilitate
the timely expenditure of funds as required by HUD.
ACTION STEP
The action requested of the City Council is to approve the Mayor's execution of the
attached resolution, approving an amended and restated Fiscal Year 2005 Annual
Action Plan for Community Development Block Grant activities.

RESOLUTION NO. 29-05
RESOLUTION APPROVING AN AMENDED AND RESTATED FISCAL
YEAR 2005 (PROGRAM YEAR 2004) ANNUAL PLAN - AMENDMENT 2
FOR COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) FUNDS.
Whereas, the City of Dubuque prepared and filed Annual Action Plans for Fiscal
Years 2004 and 2005; and
Whereas, the City of Dubuque now desires to amend said Annual Action Plans
by incorporating them into one amended and restated plan as per the attached Exhibit
A; and
Whereas, said amendment is a substantial amendment as provided in the City's
Citizen Participation Plan and must therefore be approved by resolution of the City
Council after a public hearing by the Community Development Advisory Commission;
and
Whereas, the City advertised public comment periods beginning October 20,
2004 and December 6, 2004; and
Whereas, the Community Development Advisory Commission reviewed the
proposed amendment at a public hearings on November 22, 2004 and January 12,
2005, and has voted to approve said amendment and to recommend approval by the
City Council.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the Annual Action Plans for Fiscal Years 2004 and 2005 are
hereby rescinded and the balance of funds from these plans is incorporated into an
Amended and Restated Fiscal Year 2005 (Program Year 2004) Annual Action Plan -
Amendment 2, attached hereto as Exhibit A.
Section 2. That said Amended and Restated Fiscal Year 2005 (Program Year
2004) Annual Plan - Amendment 2 attached hereto as Exhibit A is hereby approved.
Section 3. That the City Manager is hereby authorized and directed to submit a
copy of this resolution to the U. S. Department of Housing and Urban Development.

Chairperson Maloy called the meeting to order at 6:30 p.m. following staff assurance of
compliance with Iowa Open Meeting Law.

FY2006 Revised Annual Action Plan
Community Development Block Grant (CDBG) Program
Commissioner Pregler moved to open the public hearing. Commissioner Shaw
seconded. Roll call. All present in favor. Motion passed.
David Harris stated that the revised Plan reflects the $82,000 shortfall of the entitlement
CDSG funds for FY2006.
Chairperson Maloy noted that the objective of the Commission now is to send a
balanced budget to the City Council. She stated that since wages have not yet been
reflected, an amendment will have to be done at that time, along with other changes if
need be.
Commissioner Isenhart moved to re-distribute the shortfall under each line item for
Public Services Activities, rather than taking it all from the Community Partnership
Program. Motion died from lack of second.
Commissioner Pregler moved to close the public hearing. Chairperson Maloy
seconded. Roll call. All present in favor. Motion passed.
Commissioner Pregler moved to approve revisions to the FY2006 Annual Action Plan
as follows and forward it to City Council for approval. The re-allocations were: Planning
Services $98,215 (decrease of $14,294); Community Partnership Program $77,000
(decrease of $13,000); Neighborhood Recreation Program $123,297 (increase of
$1,072); Homeowner Rehab Program $271,000 (decrease of $49,000); Housing Code
Enforcement $114,766 (increase of $536); Housing Rehabilitation Services and Staff
$275,332 (increase $221). Commissioner Neustadt seconded. Roll call. Isenhart-nay.
All others present in favor. Motion passed.
Tri-State Community Health Center
Request to Extend Community Partnership (cp2) Grant
Commissioner Neustadt stated that he supports the project, however, would like to see
the waiver granted only until December 1, 2005. That way if their application is not
funded, the Commission would be able to reallocate the $50,000 set aside for the Health
Center.
Commissioner Neustadt moved to approve the extension of time to expend Tri-State
Community Health Center's cp2 grant until December 1, 2005. Commissioner
Gukeisen seconded. Roll call. All present in favor. Motion passed.
Information SharinQ
Marcia Sola, representing Catholic Charities, spoke to the Commission regarding an
encounter that she had experienced with the Dubuque Area Labor Harvest on Saturday,
January 15, 2005. She stated that she, along with several immigrant families that she
brought to their food give away, was treated rudely by some of their volunteers. She
stated that she was misinformed as to the time of the food give away. She said that she
was told that they would be open until a certain time, only to come back and be told that
they were closed, with the volunteers leaving with boxes full of food. Ms. Sola stated
that she will request a meeting be held with Catholic Charities and the Dubuque Area
Labor Harvest regarding this issue. She felt that the Commission should be aware of
this type of behavior from recipients of CDSG funding. Chairperson Maloy stated that
this issue would be referred to staff for review.
Commissioner Wainwright stated that Labor Harvest volunteers deliver food boxes to
those not able to get to the site in explanation of Ms. Sola's observation of volunteers
leaving with food boxes.
Chairperson Maloy stated that she signed a letter to the Mayor and City Council
requesting their support for the delegation going to Washington, DC on February 9-11,
2005, to support continued funding of the CDSG program as a priority issue that will be
presented in the annual information sharing discussion with the Congressional
Delegation.

There being no further business to come before the Commission, Commissioner
Gukeisen moved to adjourn. Chairperson Pregler seconded. Motion passed by voice
vote. Meeting was adjourned at 7 p.m.
