Duggan and Members of the City Council DATE: February 3, 2005 RE: Claim Against the City of Dubuque by Eric Wilson Claimant Date of Claim Date of Loss Nature of Claim Eric Wilson 12/15/04 12/14/04 Vehicle Damage This is a claim in which the claimant alleges that the control switch for the power seats of his vehicle was broken while City of Dubuque police officers searched claimant's vehicle during a traffic stop. According to the report of Kim Wadding, Chief of Police, Dubuque Police stopped claimant's vehicle for a traffic violation while investigating suspected drug information in the area of 18th & Jackson Street. A canine unit was brought to the scene and the canine indicated the presence of illegal substances in the vehicle, so therefore, an interior search of the vehicle was performed. After the traffic stop, officers did not observe any damage nor were any comments made by the claimant or his passenger indicating any vehicle defects occurring at the time of the traffic stop. Chief Wadding reports that based upon these indicators, there is no indication that any damage occurred as a result of the officers' actions, and it is therefore his recommendation that this claim be denied.
