RESOLUTION DISPOSING OF CITY INTEREST in lOTS 7A AND 8A IN

Whereas, pursuant to resolution and published notice of time and place of
hearing, published in the Telegraph Herald, a newspaper of ~eral circulation
published in the City of Dubuque, Iowa on r-.;2/~ day of ~ . ~ ,2000,

Whereas, the City Council of the City of Dubuque, Iowa overruled any and all
objections, oral or written to the proposal to sell such real estate, except for easement
as noted.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCil OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That the sale of City of Dubuque real property described as Lot 7 A
in O'Neill's Subdivision in the City of Dubuque, Iowa to Wayne E. and Rita M. Reicher
be and the same is hereby approved for the sum of $1,224.25 plus cost of
publication, platting and filing fees. Conveyance shall be by Quit Claim Deed.
Section 2. That the sale of City of Dubuque real property described as Lot 8A
in O'Neill's Subdivision in the City of Dubuque, Iowa to Mark Laird and Shelley Cue be
and the same is hereby approved for the sum of $1,224.25 plus cost of publication,
platting and filing fees. Conveyance shall be by Quit Claim Deed.
Section 3. That the Mayor be authorized and directed to execute a Quit Claim
Deed, and the City Clerk be and is hereby authorized and directed to deliver said deed
of conveyance to Mark laird and Shelley Cue and Wayne E. and Rita M. Reicher upon
receipt of the purchase price in full.
Section 4. That the City Clerk be and is hereby authorized and directed to
record a certified copy of this resolution in the office of the City Assessor, Dubuque
County Recorder and Dubuque County Auditor.

Re: Request To Vacate City Alley
To the Honorable Mayor and the City Council of Dubuque, Iowa:
My neighbor, Wayne Reicher and I each own the land on either side of the alley running westerly off
South Algona Street (Lots 7A and 7B)" We are asking that the city of Dubuque vacate this alley so that
we can purchase the two lots and use them for personal development. Wayne and I are in agreement on
the division of the proposed vacated alley. I would like to construct a garage and driveway on the front
half and Wayne would like to expand his driveway on the back half of the proposed property.
The alley is currently not maintained by the city and is an eyesore to the community. I have talked to
"adjoining neighbors and all are in agreement for the purchase of the alley. The purchase of this vacated
alley would not impede the accessibility of the alley that runs north and south to the west of South
Algona S1.

SUBJECT: Vacating Petition - Alley at 61 South Algona
INTRODUCTION
This is in response to a request from Mark Laird and Wayne Reicher for the vacating of
an alley between 61 and 65 South Algona Street.
DISCUSSION
The attached plat shows the area proposed alley to be vacated. The abutting properties
are owned by Mark Laird and Shelley Cue and Wayne E. and Rita M. Reicher. The
purpose of the vacating is to allow off-street parking for the two petitioners.
The area to be vacated is divided into two lots numbered Lots 7 A and 8A in O'Neill's
Subdivision No.3 in the City of Dubuque, Iowa. This is an existing 19 foot wide alley on
which no public utilities exist. Therefore, no easement rights will be reserved on the lots
for maintenance or construction of utilities.
The property has been valued at $1.69 per square foot, for a total of $3,211.00. A
surveying and platting credit of $762.50 was deducted, making the purchase price
$2,448.50.
RECOMMENDATION
The City has no plans for the utilization of the alley to be vacated, and is not used for
refuse collection.
I would recommend that the areas indicated by Lots 7 A and 8A in O'Neill's Subdivision
No.3 in the City of Dubuque, Iowa, on the attached plat be vacated, and that a public
hearing be set for the disposition of the City's interest in the subject area on August 7,
2000. I would further recommend that the purchase price be established at $2,448.50,
plus platting, publication and filing fees.
. ACTION TO BE TAKEN
The recommendation of the City Manager should be approved and a public hearing should
be scheduled on the disposal of the property through adoption of the enclosed resolutions
and ordinance.

Whereas, there has been presented to the City Council of the City of Dubuque,
Iowa, a plat dated June 20, 2000, prepared by IIW Engineers & Surveyors, P.C., describing
the proposed vacated alley between 61 and 65 South Algona Street; and
Whereas, said plat conforms to the laws and statutes pertaining thereto.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That the plat dated June 20, 2000, prepared by IIW Engineers &
Surveyors, P.C., relative to the real estate hereinabove described be and the same is

Council a plat showing the vacated portion of an alley between 61 and 65 South Algona
Street and assigned lot numbers thereto, which hereinafter shall be known and described
as Lots 7 A and 8A in O'Neill's Subdivision NO.3 in the City of Dubuque, Dubuque County,
Iowa;
Whereas, the City Council of the City of Dubuque, Iowa has determined that the
alley between 61 and 65 South Algona Street is no longer required for public use, and
vacating of said portions of an alley between 61 and 65 South Algona Street known as Lots
7A and 8A in O'Neill's Subdivision No.3 in the City of Dubuque, Dubuque County, Iowa
should be approved.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
