City Engineer Gus Psihoyos recommends City Council approval to accept a Quit Claim
Deed for the stormwater detention facilities in North Grandview Estate No. 2.
On July 5, 2006, the City Council approved the final plat of North Grandview Estates
No. 2 (Resolution 308 -06). The City did not require the dedication of the lots to be used
for stormwater detention facilities at the time of platting due to concern for liability on the
part of the City.
Since the developer, North Grandview Estates, LLC, was unable to construct the
improvements for the development as required by Resolution No. 308 -06, the City
obtained the securities for the construction of the remaining improvements, including the
detention facilities. These detention facilities are to be constructed on Lots 10 and 12 of
North Grandview Estates No. 2. Construction of the remaining storm sewer, paving and
street lights will follow the detention facilities.
The quit claim deed from North Grandview Estates, LLC for Lots 10 and 12 are
designated for stormwater detention facilities. The City will assume the construction of
the facilities; however, per Resolution 308 -06, the costs of the future maintenance costs
will be assessed to each respective property owner within North Grandview Estates
No. 2.

INTRODUCTION
Enclosed is a resolution accepting a quit claim deed for the storm water detention
facilities in North Grandview Estates No. 2.
DISCUSSION
On July 5, 2006, the City Council approved the final plat of North Grandview Estates
No. 2 (Resolution 308 -06). The City did not require the dedication of the lots to be used

RECOMMENDATION
The Quit Claim Deed associated with the stormwater detention facilities in North

ACTION TO BE TAKEN
The City Council is requested to adopt the attached resolution accepting the quit claim
deed of the stormwater detention facilities in North Grandview Estates No. 2.

ACCEPTING A CONVEYANCE OF PROPERTY IN NORTH GRANDVIEW ESTATES
NO. 2 TO THE CITY OF DUBUQUE
Whereas, the City of Dubuque approved the final plat of North Grandview
Estates No. 2 by Resolution No. 308 -06 dated July 5, 2006, pursuant to which North
Grandview Estates, LLC agreed to convey Lot 10 and Lot 12 of North Grandview
Estates No. 2 in the City of Dubuque, Iowa, for detention facilities; and
Whereas, North Grandview Estates, LLC has executed a conveyance of said
property.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. The City Council of the City of Dubuque, Iowa, hereby approves of,
accepts and consents to the Quit Claim Deed from North Grandview Estates, LLC,
copies of which are attached hereto, as required by Iowa Code Section 569.7.
Section 2. The Mayor is hereby authorized and directed to execute and
acknowledge on behalf of the City of Dubuque any instruments in connection herewith.
