of Liberty Subdivision.
Liberty Subdivision is located at the end of Liberty Avenue and subdivides
approximately three acres into 16 building lots. The Final Plat of Liberty Subdivision
provides for the construction of a new public street to be named Liberty Court. The new
public street will be built with a 27 -foot wide paving and 50 -foot right -of -way. Liberty
Court ends in an off-set cul -de -sac with storm water detention provided at the north end
of the subdivision. The 16 lots will be used for the State of Iowa's Single - Family New
Production Program to create affordable housing.
The Final Plat complies with the Unified Development Code's requirement for 40 points
of sustainability measures. The sustainability measures include:
• 27 -foot wide street (5 points)
• Concrete street (5 points
• Street trees (5 points)
• In -fill development (5 points)
• LED street lights (5 points)
• Infiltration of storm water in detention basin (5 points)
• Iowa Green Streets criteria (10 points)
The submitted Final Plat provides for the extension of City water and sanitary sewer to
serve the proposed single - family lots.
The City Council approved the preliminary plat for Liberty Subdivision in April 2011.

INTRODUCTION
This memorandum transmits the Final Plat of Liberty Subdivision for City Council review
and approval. The application, resolution, staff report, and related materials are
enclosed.
DISCUSSION

Conformance with Comprehensive Plan: This 2030 Future Land Use Map designates
the subject parcel for single or two- family residential. The submitted preliminary plat
involves the following Comprehensive Plan Goals: Land Use and Urban Design
Element Goals: 1.2, 1.5, 1.10, 5.3, 6.2, 7.2, 7.8, 9.2 and 9.4.

Impact of Request on:
Utilities: Existing City utilities are adequate to serve the proposed 16 -lot
subdivision.
Traffic Patterns: The proposed 16 single - family building lots will generate
approximately 153 additional vehicle trips. Access to and from the proposed
subdivision will be by way of Liberty Avenue.
Public Services: Existing public services are adequate to serve the proposed
subdivision.
Environment: Staff does not anticipate any significant impact to the environment
provided the sustainable measures proposed by the applicant are installed and
maintained appropriately, that appropriate erosion control is provided during all
phases of construction, and storm water control is provided in compliance with
adopted City Codes and regulations.
Adjacent Properties: Planning staff anticipates that the most likely impact to
adjacent property will be an increase in vehicle trips traveling on Liberty Avenue,
and an increase in the ambient noise and light levels.
Proposed Sustainable Development Tools: (1) 27 -foot wide street (reduced
impermeable area); (2) concrete street (reduce heat island effect); (3) street trees;
(4) infill development; (5) LED street lights; (6) infiltration of storm water in
detention basin, and (7) Iowa Green Streets criteria.
Recommended Conditions on Plat: None.
Staff Analysis: The submitted Final Plat of Liberty Subdivision subdivides
approximately three acres of property at the east end of Liberty Avenue into 16 new
single - family lots. A new public street will be constructed and will extend approximately
550 feet to the north from the existing Liberty Avenue.
The proposed public street will be built to a 27 -foot width of paving within a 50 -foot
right -of -way. Sidewalks will be constructed on both sides of the street as lots are
developed. Parking will be restricted to one side of the street. The majority of the 16
proposed lots will be just under 5,200 square feet in area. The proposed homes will
meet the City's setback requirements for single - family residential districts.
The new street will extend past an existing home on the property (Lot 16) that is owned
by the developers. The house will be made legally non - conforming in terms of its front
yard setback.

Water service is provided by an extension of the existing water main in Liberty Avenue.
Sanitary sewer will be provided from an existing sanitary sewer main that is available at
the north end of the site and will be extended to the south within the new proposed
right -of -way.
The proposed subdivision provides for a storm water detention basin, Lot B, to
accommodate the additional storm water generated by the impervious surface created
by the 15 new homes and proposed public street.
The Unified Development Code requires that each new subdivision utilize sustainable
development tools and achieve a 40 point score from a list of sustainable development
tools. The applicant will achieve the 40 point total by utilizing the following sustainable
practices:
1. 27 -foot wide street, which reduces the amount of impervious area in the
development. (5 points)
2. The proposed street will be a concrete street that reduces the heat island effect .
(5 points)
3. The applicant will be planting street trees within the parkway between the sidewalk
and the back of curb. (5 points)
4. The proposed subdivision is located on an infill lot. The City Planner has
determined that this is an appropriate sustainability measure . (5 points)
5. An LED street light will be used on the new cul -de -sac. Fifty percent energy
savings with twice the life span compared to the City's standard street light. The
City Engineer has determined this is an appropriate sustainability measures . (5
points)
6. Storm water will be allowed to infiltrate in the bottom of the detention basin. The
City Engineer has determined this is an appropriate sustainability measure. (5
points)
7. The proposed subdivision will be in compliance with State of Iowa Green Streets
criteria (10 points).
Total: 40 points.
Several issues were raised during the review of the preliminary plat for Liberty
Subdivision. The first issue was that Liberty Avenue will be the only access for existing
and new residents to enter and leave the area. The area surrounding and including
Liberty Avenue was annexed to the City in the early 1970s. The roadway was
constructed to serve the subdivision that was originally platted as Clark Subdivision.
The street is approximately 20 -foot in width within a 40 -foot right -of -way. The existing

street is 1,450 feet long. The proposed cul -de -sac street will add approximately 500
feet for a total length of approximately 1,950 feet. The Engineering Department has a
cul -de -sac standard of 1,300 feet. The City has had a policy of looking for a secondary
access when a street length exceeds 1,300 feet and /or more than 30 -40 housing units.
The City Council did not require a secondary access for two reasons. First, the total
number of residences after construction will be 30 homes, which is not unusual number
of residences to be served by a single access. Second, there isn't a practical
alternative for a second access. The surrounding area is fully developed and the only
roadway nearby is a private drive owned by Stonehill Care Center.
The second issue was the volume of additional vehicle trips generated. The 16
additional single - family homes can be expected to generate approximately 9.5 vehicle
trips per home per day based on the Institute of Traffic Engineers Trip Generation
Manual. This equates to approximately 153 daily trips. When combined with the
existing 14 single - family homes on Liberty Avenue (using the same ITE rate), an
additional 134 average daily trips is projected for a potential of 277 average daily trips
using Liberty Avenue. This traffic volume is not uncommon for a small roadway such as
Liberty Avenue.
A related concern raised regarding the number of vehicle trips is the lack of visibility
where Liberty Avenue transitions to an east/west direction. The Engineering
Department can investigate this corner and potentially could install signage to warn
motorists, if warranted. Another option is to reconstruct the corner to improve visibility,
which would include purchasing additional right -of -way. The City Council directed City
staff to place Liberty Avenue on the Five -Year Street Construction Program.
A third issue was the potential for damage to the existing roadway from the passage of
heavy trucks associated with construction of the 15 new single - family homes. The
Engineering Department has indicated that as with any new development, there is the
potential for damage to existing City infrastructure, including streets. The City
Engineering Department and Public Works Department will monitor the roadway during
and after construction to determine if any damage has been done to the roadway.
The Fire Department has requested that because of the width of the existing Liberty
Avenue, that on- street parking be restricted from the north side of the street. The City
Manager and the City Council have the authority to restrict parking on City streets. This
restriction will be handled separately.
The submitted Final Plat of Liberty Subdivision is in compliance with the preliminary plat
and the Unified Development Code, and staff recommends the City Council approve
the Final Plat as submitted.

RESOLUTION NO. 310-11
A RESOLUTION AUTHORIZING THE APPROVAL OF THE FINAL PLAT OF LIBERTY
SUBDIVISION IN THE CITY OF DUBUQUE, IOWA
Whereas, there has been filed with the City Clerk a Final Plat of Liberty
Subdivision in the City of Dubuque, Iowa; and
Whereas, upon said final plat appears a street to be known as Liberty Court (Lot
A) together with certain public utility, storm sewer and water main easements, which the
owner by said final plat has dedicated to the public forever; and
Whereas, the preliminary plat has been examined by the Zoning Advisory
Commission and had its approval endorsed thereon; and
Whereas, said final plat has been reviewed by the City Planner and had her
approval endorsed thereon; subject to the owner's agreeing to the conditions noted in
Section 3 below; and
Whereas, said final plat has been examined by the City Council and they find
that it conforms to the statutes and ordinances relating to it, except that streets and
public utilities have not yet been completely constructed or installed.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the dedication of Liberty Court (Lot A) and the easements for
public utilities, storm sewer and water mains, as they appear on said final plat, be and
the same are hereby accepted; and
Section 2. That the Final Plat of Liberty Subdivision is hereby approved by the
Mayor and City Clerk are hereby authorized and directed to endorse the approval of the
City of Dubuque, Iowa, upon said final plat, provided the owners of said property herein
named, execute their written acceptance hereto attached agreeing:

(a) To reduce Liberty Court (Lot A) to grade and to construct
longitudinal sub - drain, concrete curb and gutter with concrete
paving with integral curb, all in accordance with the City of
Dubuque standard specifications, all in a manner acceptable to the
City Engineer, in conformance with construction improvement plans
approved by the City Engineer, and inspected by the City Engineer.
(b) To install sanitary sewer main and sewer service laterals into each
individual lot, water main and water service laterals into each
individual lot, storm sewers and catch basins, street lighting with all
appurtenances, and erosion control devices all in accordance with
the City of Dubuque standard specifications, all in a manner
acceptable to the City Engineer, and in accordance with
construction improvement plans approved by the City Engineer,
and inspected by the City Engineer.
(c) To connect storm water facilities to an approved storm water
detention facility in a manner acceptable to the City Engineer, in
accordance with the City of Dubuque standard specifications
approved by the City Engineer, and inspected by the City Engineer.
(d) To construct said improvements, prior to the two (2) years from the
date of acceptance of this resolution, at the sole expense of the
owners, or future owner.
(e) To maintain the public improvements, for a period of two (2) years
from the date of the acceptance of those improvements by the City
Council of the City of Dubuque, Iowa, at the sole final expense of
the owners, or future owner.
And, further provided that said Graceland, LLC, as owners of said property, shall
secure the performance of the foregoing conditions provided in this Section by providing
guarantees in such form and with such sureties as may be acceptable to the City
Manager of the City of Dubuque, Iowa.
Section 3. Sidewalk installation shall be the responsibility of the owner
abutting the public rights -of -way, including lots with multiple frontages, as required by
City Code 10 -1 -2.
Section 4. The maintenance expenses incurred by the City of Dubuque for the
storm water detention facility on Lot B Liberty Subdivision shall be assessed against the
lot owners of Liberty Subdivision as indicated in the preliminary plat, in equal amounts,
and the City Manager shall certify such costs to the City Clerk, who in turn shall
promptly certify such costs to the Dubuque County Treasurer, and such costs shall then
be collected with and in the same manner as general property taxes in accordance with
provisions of law.

Section 5. That the final acceptance of the public improvements shall occur
upon certification of the City Engineer to the City Council that the public improvements
have been completed in accordance with the approved improvement plans and City
standards and specifications and accepted by City Council Resolution.
Section 6. That in the event Graceland, LLC, fails to execute the acceptance
and furnish the guarantees provided in Sections 2 and 3 hereof within 180 days after
the date of this Resolution, the provisions hereof shall be null and void and the
acceptance of the dedication and approval the plat shall not be effective.
