AN ORDINANCE AMENDING APPENDIX A (THE ZONING ORDINANCE) OF THE
CITY OF DUBUQUE CODE OF ORDINANCES, BY RECLASSIFYING HEREINAFTER
DESCRIBED PROPERTY LOCATED AT 3251 ROOSEVELT ROAD FROM R-1
SINGLE-FAMILY RESIDENTIAL DISTRICT TO CS COMMERCIAL SERVICE AND
WHOLESALE DISTRICT.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Appendix A (the Zoning Ordinance) of the City of Dubuque Code
of Ordinances is hereby amended by reclassifying the hereinafter described property as
shown on Exhibit 1, and to the center line of the adjoining public right-of-way, all in the
City of Dubuque, Iowa from R-1 Single-Family Residential District to CS Commercial
Service and Wholesale District.
Section 2. The foregoing amendment has heretofore been reviewed by the Zoning
Advisory Commission of the City of Dubuque, Iowa.
Section 3. This ordinance shall take effect immediately upon publication, as
provided by law.

Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request. The
application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request, reviewing the proposed dog kennel business and
providing additional petitions in support of the business and a brochure that listed fees and
services to be offered to pet owners. Several neighbors spoke in opposition to the request, citing
concerns of noise and odors from the large number of dogs. Neighbors also were concerned
about the wide range of uses allowed in the CS Commercial Service and Wholesale District, and
that most uses would not be compatible with the predominantly residential and agricultural uses
existing in the area. Staff reviewed surrounding zoning and land use and provided information
from the City's Animal Control Officer and the Executive Director of the Dubuque County Humane
Society. Staff distributed copies of letters and petitions in opposition to the rezoning.
The Zoning Advisory Commission discussed the request, noting that the proposed business did
not appear to be compatible with existing development of the area and that the proposed CS
zoning would represent a spot zone.
Recommendation
By a vote of 7 to 0, the Zoning Advisory Commission recommends that the City Council deny the
request.
A super majority vote is needed for the City Council to approve the request.

As with all rezoning applications, Planning Services staff researched the property
history for 3251 Roosevelt Road. General property history is found on Page 1 of
the Planning Services Department's staff report for this rezoning request.
After the public hearing notices were mailed, citizens and City staff contacted the
Planning Services Department about a history of complaints and enforcement
actions for this property. Consequently, Planning Services staff contacted the
Health Services Department and Dubuque County Humane Society for verification.
The following information was provided by the City's Animal Control Officer and
the Executive Director of the Dubuque County Humane Society. This information
is specific to the use that Julie and Jeff Harry have proposed for their property.
The attached letters are provided for your information.

This memo is in response to your inquiry about complaints I have received for the
property at 3251 Roosevelt
Over the past 4-6 weeks there have been numerous complaints forwarded to me through
the police department regarding excessive barking coming from this property. These
complaints have not come directly to my office which can be explained by the fact that
the complaints are coming in the evening and night-time hours. I have notified Ms.
Harry of these complaints either in person, by phone or by Advisory Notice.
On my visits to the Harry property prior to today's date, 1 have not been able to confirm
the complaint of excessive barking. This can be attributed to the fact that most dogs bark
when I enter their presence; therefore, determining if the barking behavior is situational
or chronic is very difficult without more observation. However, today I was called to a
neighboring property regarding a sick animal complaint During the time I was at this
property I was able to hear Ms. Harry's dogs howling and barking for 25 minutes of a 30-
minute time frame. Throughout this period, what sounded like 1-3 dogs, howled and
barked nearly continuously. There were also intermittent moments that I could hear
barking from within the sheds on her property as well.
The neighbor informed me "this is mild compared to usual".
I will be discussing this incident with Mary Rose and it may be handled with a citation. I
cannot confirm that this will happen at this time.

We have been asked by City representatives to provide infonnatjon
regarding the Dubuque Humane Society's past contacts with Julie Harty'. We
understand this infonnation will be considered by the Zoning Commission in
reviewing Ms. Harry's Application for Re-Zoning.
The Dubuque Humane Society has investigated neglect and cruelty calls in
regard to Julie Harry for numerous years, The Dubuque Humane Society has
received and subsequently investigated more neglect calls about her treatment of
animals than any other one person in Dubuque, These calls began while she lived
on Washington Street and have continued to her present location on Roosevelt
Street, The Dubuque Humane Society investigated four calls about her animals in
1999 and we've had two complaints so far this year. While she has come into
compliance to meet the minimal requirements, the Dubuque Humane Society does
have concerns about her increasing the number of animals she cares for or
opening a shelter and/or park. In addition, we note that, on Ms Harry's petition
seeking signatures in support of her plan, Ms, Harry states that the "shelter" is
"AKC sanctioned" The American Kennel Club does not sanction parks or
shelters. Rather, the AKC sanctions only shows.

Subject: Opposition to the proposal to rezone the property at 3251 Roosevelt St. from
R-1 Single-Family Residential District to CS Commercial Service and Wholesale
District.
We are opposed to the above rezoning proposal.
Noise: Sound travels exceedingly well in this rural-like area. We are already subjected to
the high-pitched yelping and howling of the current dogs at the above address. For
example, on 27 July, we listened to the dogs from approximately 11 AM until 1 :30 PM.
That same evening they began their yelping at 7:30 PM. By 8:30 PM we had enough of
their barking and retreated from our patio into our house, and turned up the stereo to drown
them out. As this illustrates, we have already had our peace disturbed and have been
denied the use of our property on occasions in the past due to the current dog population.
To rezone this property to CommerciallWholesale will sorely infringe upon our property
owners' rights to the peaceful enjoyment of our property.
Traffic: Roosevelt St. is traveled heavily during shift-changes at the John Deere Dubuque"-
Works. The residential development occurring along the Peru Road corridor has likewise
increased the traffic on Roosevelt St. This street is narrow, shoulderless, curving, and in
need of repairs due to the clayey soil erosion of the road-bed. The CommerciallWholesale
rezoning will increase the likelihood of vehicular accidents and increase street maintenance
costs.
Habitat: Separating our property from 3251 Roosevelt St. is a treed valley replete with
deer, turkey, fox, falcons, eagles, etc. This bluff and valley area is a wonderfully-intricate
ecological system increasingly subjected to the pressures of the new residential
developments between Shiras Ave. and Roosevelt St. By rezoning the Roosevelt St.
property to Commercial! Wholesale it will inevitablv lead to additional rezoning requests
which will ultimately ruin this shrinking natural area to the detriment of native species.
In summary, the negative impact on the native wildlife and increases in noise and traffic
levels will be significant if the property is rezoned. We emphatically oppose this rezoning
proposal and urge the Zoning Advisory Commission to deny the request for rezoning of
the property at 3251 Roosevelt Street from R-1 to CS.

Property History: The subject property is a one acre portion of an approximately 20
acre parcel that is primarily vacant. A portion of the property was formerly used for
agricultural purposes and still has a number of outbuildings located on it. The one acre
portion requested to be rezoned encompasses these outbuildings. A small portion of
the property has been used for a single family residence, which is currently occupied.
The single-family residence is located on the 20 acre parcel directly adjacent to the one
acre area proposed to be rezoned.
Physical Characteristics: The property to be rezoned is an approximately one acre f1ag-
shaped lot, 335 feet deep with 60 feet of frontage along Roosevelt Road. The property
slopes gently up and away from Roosevelt Road with a grade change of approximately
20 feet between Roosevelt Road and the east property line. The property is heavily
wooded on the north and east sides, abuts an open field to the south and adjoins the
Roosevelt Road right-of-way and agricultural use to the west. There are several
existing out buildings on the lot and a single-family residence directly adjacent to the lot
on its south side.
Concurrence with Comprehensive Plan: The 1995 Comprehensive Plan made no
recommendations for this area.
Impact of Request on:
Utilities: Sanitary sewer, city water and storm sewer are not available to serve this
site. The existing site relies on well water and a private septic system.
Traffic Patterns/Counts: Roosevelt Road at this location has a 60-foot right-of-way
with a 20-foot wide paved street. Roosevelt Road is designated as a Minor
Arterial. Based on 1997 lOOT counts, there are approximately 2,700 vehicle trips
per day south of the Amelia Drive intersection on Roosevelt, approximately 2,000
feet south of the subject property.

Public Services: The site is currently not served by City water or sanitary sewer.
Environment: Staff does not anticipate any adverse impact to the environment
provided adequate erosion control is provided during all phases of development
and adequate storm water control is provided as approved by the City Engineering
Division. Some uses in a CS district may generate more sewage than can
adequately be handled by a private septic system.
Adjacent Properties: The subject parcel is bordered on three sides by primarily
vacant residentially-zoned property. There are however two existing single-family
residences approximately 180 feet south of the proposed rezoning. The noise,
activity and odors 'generated by some of the permitted uses in a CS district may
have a negative impact on these residential properties.
Staff Analysis: The applicant is requesting to rezone an approximately one acre f1ag-
shaped lot within an existing 20-acre parcel along Roosevelt Road. The flag-shaped lot
has 60 feet of frontage on Roosevelt Road and is approximately 325 feet deep. The
applicant owns an existing single-family residence that will be directly adjacent to the
subject lot. The subject lot is bordered on three sides by vacant residentially-zoned
properties and actively cultivated agricultural property. There are two single-family
residences on lots that sit approximately 180 feet south of the proposed rezoning.
Access to this site will be from Roosevelt Road which is 20 feet of pavement and a 60-
foot right-of-way at this location. If rezoned, the next step for the property owners will
be to submit a site plan for City departmental review.
Staff recommends that the Zoning Advisory Commission review Section 6-1.1 of the
Zoning Ordinance that establishes criteria for review of rezoning requests.

AN ORDINANCE AMENDING APPENDIX A (THE ZONING ORDINANCE) OF THE
CITY OF DUBUQUE CODE OF ORDINANCES, BY RECLASSIFYING HEREINAFTER
DESCRIBED PROPERTY LOCATED AT 3251 ROOSEVELT ROAD FROM R-1
SINGLE-FAMILY RESIDENTIAL DISTRICT TO CS COMMERCIAL SERVICE AND
WHOLESALE DISTRICT.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Appendix A (the Zoning Ordinance) of the City of DUbuque Code of
Ordinances is hereby amended by reclassifying the hereinafter described property as shown
on Exhibit 1, and to the center line of the adjoining public right-of-way, all in the City of
Dubuque, Iowa from R-1 Single-Family Residential District to CS Commercial Service and
Wholesale District.
Section 2. The foregoing amendment has heretofore been reviewed by the Zoning
Advisory Commission of the City of Dubuque, Iowa.
Section 3. This ordinance shall take effect immediately upon publication, as provided
by law.
