Subject: West End Conunercial Subdivision Final Plat
I would like to address the Council on the issue that the City of Dubuque accept the lot
that the storm water detention basin is built on as City property and pass on any future
expense pertaining to this detention basin to the lots that are showing in the final plat,
except for the lot in the flood plain, rather than the developer keeping title to this lot and
setting up a commercial association to deal with future expense for operation, as this
causes a fair amount of set up procedures, bookkeeping, monitoring problems, annual
taxes and on and on.
Other problems could be what if the association ignored maintenance or othe issues, or if
they didn't pay property tax on the parcel and was sold on tax sale or the City took it for
back taxes, the City wouldn't have a resolution to backcharge individual lots for
maintenance and upkeep, or if the lot was sold to a shell cooperation or someone who
didn't care.
As you can see there is a fair amount of problems could occur doing it this way rather
than being fair and handling like residential subdivision and elimenate the unnecessary
work ~~ . . lems.
