City Planner Address: City Hall. 50 W. 13th Street Telephone: 589-4210 RESOLUTION NO. 391-00 RESOLUTION APPROVING THE PLAT OF SURVEY LOT 1 OF LIGHTNING RIDGE IN DUBUQUE COUNTY, IOWA Whereas, there has been filed with the City Clerk the plat of survey Lot 1 of Lightning Ridge in Dubuque County; and Whereas, said plat provides 0 feet of frontage for Lot 1, where 60 feet is required by Section 42-19 (b) of the Subdivision Regulations; and Whereas, said plat has been examined by the Zoning Advisory Commission and had its approval endorsed thereon; and Whereas, said plat has been examined by the City Council and they find that it conforms to the statutes and ordinances relating thereto. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That the City Council hereby waives Article IV, Design and Improvement Standards of the Subdivision Regulations, except for Section 42-19, Blocks and Lots. Section 2. That Section 42-19 (b) of the Subdivision Regulations is waived to allow Lot 1 to have 0 feet of frontage, where 60 feet is required, due to the platting of a 30-foot access easement to Lot 1. Section 3. That the plat of Survey Lot 1 of Lightning Ridge is here by approved and the Mayor and City Clerk are hereby authorized and directed to endorse the approval of the City of Dubuque, Iowa, upon said final plat. . 21st Passed, approved and adopted this 21st day of August , 2000. Plat of Survey - Lot 1 of Lightning Ridge TO: INTRODUCTION The Zoning Advisory Commission is being asked to review the plat of survey of Lot 1 of Lightning Ridge, which is in Dubuque County within two miles of the City of Dubuque. Plats within the two mile extra jurisdictional area require joint review by the City and the . County. DISCUSSION The plat of survey of Lot 1 of Lightning Ridge plats off a two-acre parcel that will be served by an existing farm lane. The owner of the property will be Dan Conlan who is splitting off this parcel from the existing farm. The farm lane currently serves the existing farm house. The applicant is asking that the Zoning Advisory Commission waive the requirement for frontage on a public or private street. The proposed plat includes the platting of a 30-foot access easement that will insure adequate access to the new lot. RECOMMENDATION Planning Staff recommends that the plat of survey of Lot 1 of Lightning Ridge be approved and that the lot frontage requirement for Lot 1 be waived as the submitted plat only provides for one additional dwelling unit and that the proposed 30-foot access easement is sufficient to provide access to the new home as well as the existing farm property. Dear Mayor and City Council Members: The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request. . The application, staff report and related materials are attached for your review. Discussion The applicant spoke in favor of the request, stating that the plat allows for construction of a single-family home. Staff reviewed the plat, noting that the proposed lot will be served by the existing farm access and that any further subdivision of the property will require construction of a street to County standards. The Zoning Advisory Commission discussed the request, noting that access to one additional lot is sufficient. Recommendation By a vote of 7 to 0, the Zoning Advisory Commission recommends that the City Council approve the request, with the waiver of lot frontage for Lot 1, and City Design and Improvement Standards. A simple majority vote is needed for the City Council to approve the request.
