RESOLUTION APPROVING THE PLAT OF SURVEY LOT 1, LOT 2 AND LOT 3 OF
HARBOR VIEW PLACE IN THE CITY OF DUBUQUE, IOWA
Whereas, there has been filed with the City Clerk the Plat of Survey Lot 1, Lot 2 and Lot 3
of Harbor View Place in the City of Dubuque, Iowa; and
Whereas, said plat of survey provides 21 feet of frontage for Lot 1 and 13.25 feet of
frontage for Lot 3, where 60 feet is required by Section 42-19(b) of the Subdivision Regulations;
and
Whereas, said plat of survey has been reviewed by the Zoning Advisory Commission its
approval endorsed thereon, and
Whereas, said plat of survey has been examined by the City Council and they find that it
conforms to the statutes and ordinances relating to it.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Section 42-19(b) of the Subdivision Regulations is waived to allow Lot 1
to have 21 feet of frontage and Lot 3 to have 13.25 feet of frontage, where 60 feet of frontage is
required.
Section 2. That the plat of survey Lot 1, Lot 2 and Lot 3 of Harbor View Place is hereby
approved and the Mayor and City Clerk are hereby authorized and directed to endorse the
approval of the City of Dubuque, Iowa, upon said plat of survey.

Final Plat of Harbor View Place
INTRODUCTION
The submitted final plat for Harbor View Place subdivides an existing parcel of land into
three lots to accommodate construction of the new Chamber of Commerce building and
Third Street Parking Ramp. The Zoning Advisory Commission is reviewing the plat as
it creates three lots, one of which does not have sufficient lot area or lot frontage.
DISCUSSION
The submitted final plat provides for the construction of a new Chamber of Commerce
building and allows for access from Main Street to the new Third Street Parking Ramp
to be constructed by the City of Dubuque. The plat is not in compliance with the City's
Subdivision Regulations, in terms of lot area or lot frontage for Lot 1 and Lot 3. Lot 1
will allow vehicle access between Main Street and the parking ramp, while Lot 3 will
allow for pedestrian access to the parking ramp.
RECOMMENDATION
Staff recommends that the Zoning Advisory Commission approve the final plat of
Harbor View Place subject to waiving the lot frontage and lot area requirements for Lot
1 and Lot 3.

The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request.
The application, staff report and related materials are attached for your review.
Discussion
City of Dubuque Associate Planner Kyle L. Kritz spoke in favor of the request, stating the
submitted plat facilitates development of the subject parcel and provides access to the new
3rd Street parking ramp.
The Zoning Advisory Commission discussed the request, noting that the two parcels that
have insufficient frontage will be retained by the City of Dubuque to provide vehicle and
pedestrian access to the 3rd Street parking ramp.
Recommendation
By a vote of 7 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request, with the waiver of lot area and lot frontage for Lot 1 and Lot 3.
A simple majority vote is needed for the City Council to approve the request.

MEMORANDUM OF DEVELOPMENT AGREEMENT
An Amended and Restated Development Agreement by and among the City of Dubuque,
Iowa, an Iowa municipal corporation, of Dubuque, Iowa, Harbor View Development, LLC, an
Iowa limited liability company of Dubuque, Iowa and the Dubuque Area Chamber of
Commerce, an Iowa not-for-profit corporation, of Dubuque, Iowa was made regarding the
following described premises:
Lot 2 of Harbor View Place in Original Town in the City of Dubuque,
Dubuque County, Iowa, according to the recorded plat thereof,
together with all easements, tenements, hereditaments, and
appurtenances belonging thereto.
The Amended and Restated Development Agreement was signed on the 21 st day of
August, 2000 and contained covenants, conditions and restrictions concerning the sale and use of
said premises.
This Memorandum of Development Agreement is recorded for the purpose of
constructive notice. In the event of any conflict between the provisions of this Memorandum and
the Amended and Restated Development Agreement itself, executed by the parties, the terms and
provisions of the Amended and Restated Development Agreement shall prevail. A complete
counterpart of the Amended and Restated Development Agreement, together with any
amendments thereto, is in the possession of the City of Dubuque and may be examined at its
offices as above provided.
