RESOLUTION APPROVING THE FINAL PLAT OF LOTS 1, 2, A, B, C, AND D OF MAPLE LEAF
ADDITION NO.3 IN THE CITY OF DUBUQUE, IOWA.
Whereas, there has been filed with the City Clerk a final plat of Lots 1, 2, A, B, C, and D of
Maple Leaf Addition No.3, in the City of Dubuque, Iowa; and
Whereas, said plat provides 0 feet of frontage for Lots 2, A, B, C, and D and less than
6,000 square feet of lot area for Lots 2, A, Band C, where 60 feet and 6,000 square feet is
required, respectively, by Section 42-19(b) of the Subdivision Regulations; and
Whereas, said final plat has been examined by the City Zoning Advisory Commission and
had its approval endorsed thereon; and

Whereas, said final plat has been examined by the City Council and the City Council finds
that the same conforms to the statutes and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE,
IOWA:
Section 1. That Section 42-19(b) of the Subdivision Regulations is waived to allow Lots 2,
A, B, C and D to have 0 feet of frontage, where 60 feet of frontage is required, and to allow Lots
2, A, B, and C to have less than 6,000 square feet of lot area.
Section 2. That the final plat of Lots 1, 2, A, B, C and D of Maple Leaf Addition No.3 is
hereby approved and the Mayor and City Clerk are hereby authorized and directed to endorse the
approval of the City of Dubuque upon said final plat.

Exhibit "A"
The alley had been abandoned. The property was taxed to "unknown owner." Fuerst
purchased the property through a tax sale. Fuerst then obtained a tax deed. Fuerst has an
agreement with the adjacent neighbors to deed alley property adjacent to their own individual
properties to them in an attempt to clean up this area. Upon approval of the plat, the deeds
conveying the properties to the adjacent owners will be issued.

Final Plat of Lots 1, 2, A, B, C and D of Maple Leaf Addition NO.3
INTRODUCTION
The submitted final plat provides for the subdivision and conveying of an abandoned
alley to adjacent property owners. The applicant, Robert A. Fuerst, is resubdividing the
westerly 7 feet of Lot 27, Lot 28, Lot 29 and the northeasterly 20 feet of Lot 30.
DISCUSSION
Attached to this memorandum is exhibit A which explains the purpose of the submitted
plat. In addition to clearing up the ownership of the abandoned alley, the applicant,
Robert A. Fuerst, is also resubdividing Lots 28, 29 and 30. In doing so, Lot 28 will have
insufficient frontage on a public street and insufficient lot area, where 60 feet and 6,000
square feet is required. The new lot lines will not create any non-conformities in terms
of existing buildings and setbacks from the new property lines. The Zoning Advisory
Commission is being asked to waive lot frontage and lot area for Lot A, Lot B, Lot C,
Lot D and Lot 2 of Maple Leaf Addition.
The submitted final plat clears up the ownership of an abandoned alley and while it
does create a lot with insufficient lot area and lot frontage as required by the City of
Dubuque Subdivision Regulations, it also resolves an issue where the house at 659
Louella Lane (Lot 1) encroaches on the property at 665 Louella Lane (Lot 2). The
newly replatted Lots 1 and 2 places each structure on its own lot and maintains
required setbacks between property lines and each structure.
RECOMMENDATION
Planning staff recommends that the Zoning Advisory Commission approve the
submitted final plat of Lots 1, 2, A. B, C and D of Maple Leaf Addition NO.3.

The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request.
The application, resolution and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request, noting that the plat subdivides an abandoned
alley and incorporates it into his property and neighboring property. Staff reviewed the
request, stating that while Lot 2 will not have frontage on a street, there is adequate access
to the property and all setbacks are met.
The Zoning Advisory Commission discussed the request, noting that they were asked to
waive lot frontage and lot area.
Recommendation
By a vote of 7 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request, with the waiver of lot frontage and lot area for Lots A, B, C, D and 2.
A simple majority vote is needed for the City Council to approve the request.
