of interst to our community and its future.
The City Clerk's Office, City Hall, 50 West 13th Street. Dubuque, IA accepts applications for any Board and/or
Commission at any time, and the application slays active for one year from the date of receipt in the Clerk's
Office.

414.5 Changes - protest.
The regulations, restrictions, and boundaries may,
from time to time, be amended, supplemented,
changed, modified, or repealed. Notwithstanding
section 414.2, as a pan of an ordinance changing
land from one zoning district to another zoning dis-
trict or an ordinance appro\-ing a site development
plan, a council may impose conditions on a property
owner which are in addition to existing regulations
if the additional conditions have been agreed to in
writing by the property owner before the public hear-
ing required under this section or any adjournment
of the hearing. The conditions must be reasonable
and imposed to satisfy public needs which are direct-
ly caused by the requested change. In case, however,
of a written protest against a change or repeal which
is filed with the city clerk and signed by the owners
of twenty percent or more of the area of the lots in-
cluded in the proposed change or repeal, or by the
owners of twenty percent or more of the property
which is located y,ithin two hundred feet of the exte-
rior boundaries of the property for which the change
or repeal is proposed, the change or repeal shall not
become effective except by tbe favorable vote of at
least tbree-fourths of all the members of the council.
The protest, if filed, must be filed before or at the
public bearing. The pro\isions of section 414.4 rela-
tive to public hearings and official notice apply
equally to all changes or amendments.

414.6 Zoning commission.
In order to avail itself of the powers conferred by
this chapter, the council shall appoint a commission,
to be known as the zoning commission, to recom-
mend the boundaries of the various original districts,
aod appropriate regulations and restrictions to be
enforced therein. Where a city plan commission al-
ready exists, it may be appointed as the zoning com-

mission. Such commission shall. with due diligence.
prepare a preliminary repon and hold public hear-
ings thereon before submitting its final repon; and
such council shall not hold its public hearings or take
action until it has received the final repon of such
comI:1ission. After the adoption of such regulations.
restrictions, and boundaries of districts, the zoning
commission may, from time to time, recommend to
the council amendments, supplements, changes, or
modifications.

The council shall provide for the appointment of
a board of adjustment and in the regulations and re-
strictions adopted pursuant to the authority of this
chapter shall pro..ide that tbe said board of adjust-
ment may in appropriate cases and subject to appro-
priate conditions and safeguards make special ex-
ceptions to the terms of the ordinances in harmony
Vwith its general purpose and intent and in accor-
dance with general or specific rules therein con-
tained and provide that any property owner ag-
grieved by the action of the council in the adoption
of such regulations and restrictions may petition the
said board of adjustment direct to modify regula-
tions and restrictions as applied to such property
owners.
The council may provide for its review of van.
ances granted by the board of adjustment before
their effective date. The council may remand a deci.
sian to grant a variance to the board of adjustment
for further study. The effective date of the variance
is delayed for thirty days from the date of the re-

The boaroof adjustment shall consist of five or
seven members as determined by the council. Mem-
bers of a five-member board shall be appointed for
a term of five years, excepting that when the board
shall first be created one member shall be appointed
for a term of five years, one for a term of four years,
one for a term of three years. one for a term of two
years, and one for a term of one year. Members of a
seven.member board shall be appointed for a term
of five years, eIcept when the board sball first be cre-

414.9 Rules - meetings - general proce.

The board shall adopt rules in accordance with
the provisions of any ordinance adopted pursuant
to this chapter. Meetings of the board shall be held
at the call of the chairperson and at such other
times as the board may determine. Such chairper-
son, or in the chairperson's absence, the acting
chairperson, may administer oaths and compel the
attendance of witnesses. All meetings of the board
shall be open to the public. The board shall keep
minutes of its proceedings, showing the vote of
each member upon each question, or if absent or
failing to vote, indicating such fact, and shall keep
records of its examinations and other official ac-
tions, all of which shall be immediately filed in the
office of the board and shall be a public record.

414.10 Appeals.
Appeals to the board of adjustment may be taken
by any person aggrieved or by any officer, depart-
ment, board, or bureau of the municipality affected
by any decision of the administrative officer. Such
appeal shall be taken within a reasonable time as
provided by the rules of the board by filing with the
officer from whom the appeal is taken and with the
board of adjustment a notice of appeal specifying
the grounds thereof. The officer from whom the ap-
peal is taken shall forthwith transmit to the board
all the papers constituting the record upon which
the action appealed from was taken.

414.11 Effect of appeal.
An appeal stays all proceedings in furtherance of
the action appealed from, unless the officer from
whom the appeal is taken certifies to the board of
adjustment after the notice of appeal shall have
been filed with the officer that by reason of facts
stated in the certificate a stay would in the officer's
opinion cause imminent peril to life or property. In
such case proceedings shall not be stayed other-
wise than by a restraining order which may be

granted by the board of adjustment or by a court
of record on application on notice to the officer from
whom the appeal is taken and on due cause shown.

414.12 Powers.
The board of adjustment shall have the following
powers:
1. To hear and decide appeals where it is al-
leged there is error in any order, requirement, deci.
sion, or determination made by an administrative
official in the enforcement of this chapter or of any
ordinance adopted pursuant thereto.
2. To hear and decide special exceptions to the
terms of the ordinance upon which such board is
required to pass under such ordinance.
3. To authorize upon appeal in specific cases
such variance from the terms of the ordinance as
will not be contrary to the public interest, where
owing to special conditions a literal enforcement of
the provisions ofthe ordinance will result in unnec-
essary hardship, and so that the spirit ofthe ordi-
nance shall be observed and substantial justice
done.

414.13 Decision on appeal.
In exercising the above-mentioned powers such
board may, in conformity with the provisions of
this chapter, reverse or affirm, wholly or partly, or
may modify the order, requirement, decision, or de-
termination appealed from and may make such
order requirement, decision, or determination as
ought to be made, and to that end shall have all the
powers of the officer from whom the appeal is
taken. .

414.14 Vote required.
The concurring vote of three members of the
board in the case of a five-member board, and four
members in the case of a seven-member board,

pass under any such ordinance or to effect any
variation in such ordinance.

MENT ADVISORY COMMISSION

There is hereby crested a community develop-
ment advisory commission whose primary pur-
pose shall be to provide for citizen participation
in the development and evaluation of the city of
Dubuque's community development block grant
C'CDBG") program.
The commission shall comprise nine (9) mem.
bers; four (4) members shall be residents of
census tracts and block groups where at least
fifty one percent (51%) of the residents are
low/moderate income perSODS 8S determined by
the United States department of commerce,
bureau of the census; four (4) members shall be
residents of the community at large; and one
member shall be that member of the housing
commission designated by the housing commis-

Sec. 15.47. Application And Appointment
Process:
The process of appointment to the commission
by the city council shall include at least the
following elements:
(1) Submission of an application form con-
taining the requested information on the
qualifications and expectations of the
applicant; and
(2) Notice to and an opportunity for the
general public to comment, in writing, on
the qualifications of each applicant; and

(3) A formal interview by the city council to
determine the applicant's qualifications
and ability to serve effectively on the
commission.
Individuals who, by their professional or
personal experience or interest, are knowledge.
able of the development needs of the community
at large and of low and moderate income per-
sons in particular shall be considered qualified
to serve on the commission, subject to city coun-
cil review and consideration of other applicable

Compensation:
The term of office for a commission member
shall be three (3) years except as set forth be-
low.
The initial terms of the commission shall be
as follows:
(1) For each of the five (5) residents of the
five (5) census tracts with the lowest
median household income as determined
by the U.S. department of commerce,
bureau of the census; one shall be ap-
pointed for an initial term of one year,
two (2) shall be appointed for an initial
term of two (2) years; two (2) shall be
appointed for an initial term of three (3)
years.
(2) For the three (3) community at large
residents; one shall be appointed for an
initial term of one year, one shall be
appointed for an initial term of two (2)
years, and one shall be appointed for an
initial term of three (3) years.
(3) For the one member of the housing com-
mission designated by the housing com-
mission, the initial term shall be one
year.
A commission member may be removed at any
time with or without cause by a vote of two-
thirds ('I,) of all members of the city council.

A vacancy occurring on the commission
caused by resignation or otherwise, shall be
filled by appointment of the city council for the
remainder of the unexpired term.
Members of the commission shall serve with-
out compensation except for actual expenses,

Sec. 15-49. Duties And Responsibilities;
General:
The commission shall have the following
duties and responsibilities:
(1) To conduct public hearings in accordance
with the minimum standards established
in the CDBG program's citizen participa-
tion plan to ensure meaningful citizen
input in the planning. implementation
and assessment of the city's CDBG pro-
gram;
(2) To provide for and encourage the partici-
pation of low and moderate income per-
SODS who reside in designated areas of
slum and blight and residents of low and
moderate income neighborhoods. as de.
fined by the city council, in the planning,
implementation and assessment of the
CDBG program;
(3) To identify community development
needs, particularly the needs of persons
of low and moderate income;
(4) To serve in an advisory role upon the
request of the city council in policy deci-
sions regarding funding priorities and
program development and implementa-
tion;
(5) To monitor and evaluate program activi-
ties to advise whether identified commu-
nity development objectives have been
met;
(6) To undertake public information efforts
to educate the citizenry of the availabili-

ty of CDBG funded programs and to
provide for a greater understanding of
the city's community development ef~
forts;
(7) To assist in the preparation of the state-
ment of community development objec-
tives and projected use of funds, amend-
ments thereto and required reports in-
cluding, but not limited to, the annual
grantee performance report (GPR) and
the annual comprehensive housing assis-
tance strategy (CRAS);
(8) To serve in an advisory role to the city
manager in the review of complaints and
grievances received in accordance with
the procedures established in section
15-52 of this article; and
(9) To support, upon request, the efforts of
the city council and other city commis-
sions in the assessment of the general
development needs of the community.

The city council shall have the authority to
establish or revise the priorities of the commis-

The commission shall participate in the fol-
lowing described grievance procedure estab-
lished by the city council for the community
development block grant program:
(1) All complaints regarding the community
development block grant (CDBG) pro-
gram shall be handled in accordance
with the following described grievance
procedure.
a. Any aggrieved person shall file a
grievance with the city manager.
Grievances shall be filed in a timely
manner and must be received by the
city manager within one year of the
alleged occurrence.
