Council met in special session at 4: 1 0 p.m. at Four Mounds
Present: Mayor Duggan, Council Members Buol, Cline, Markham, Michalski, Nicholson,
Robbins, City Manager Michael Van Milligen
Mayor Duggan read the call and stated this is a special session of the City Council called for
the purpose of holdling a goal setting session.
The City Council discussed their strategic plan for 2000 - 2006 and their goals and priorities
for the next eighteen months.
There being no further business, upon motion meeting adjourned at 7:30 p.m.

Dear Mr . and !'virs. Albert Doland:

As you know, my spouse and I bought the property adjacent to yours approximately two
and one half years ago. As you know, I operate a private dog kennel and am in the process
of starting a non-profit shelter and recreational facility for dogs and their owners. In recent
months, I have reduced the number of dogs I own due to my busy schedule and the time
necessary to get my operation off the ground.
Much to my dismay, I have had the local police and various other agencies on my
property six times in the last six weeks due to complaints from neighbors concerning
barking and other "disturbances", All the officers and agency personnel could find no
legitimate grounds for any of these complaints, and have expressed to me that they are
becoming somewhat tired of coming to my property for no legitimate reason. With this in
mind, I have contacted both the City Attorney and County Attorney and relayed to them
my frustration with this situation. It has become quiet bothersome to have police on my
property repeatedly when there is no concert reason for these "nuisance" and
"disturbance" calls to local law enforcement. All the legal parties I spoke with agree that
the calls are unnecessary, and that there is no reason for them.
With this in mind, I have contacted a private attorney. This letter is serving notice to you
that ifthe calls to the Police Department and other local agencies continue I will be forced
to file harassment charges. I would assume after this letter that the calls to police and local
agencies would cease.

THAT IS LOCATED ON 3251 ROOSEVELT IN APRIL OF 1998. JULIE
AND HER FAMILY MOVED INTO THE HOME ON MAY 15 1998, WE
CLOSED ON THE PROPERTY ON OCT. 13, 1998. AT THE TIME OF
PURCHASE THIS PROPERTY WAS ZONED AGRICULTURAL.

Dubuque's many institutional facilities.
It is the intent of this Ordinance that
this District shall only be applied to
facilities possessing the characteristics of
an institutional use set forth in this

distinguish institutions from other land
use activities. The most significant fea.
ture of institutions is their tendency to
function as substantially separate com-
munities within the City. They maintain
a large and definable resident population

for both its resident and transitory popu-

I have enc 1 osed several pages of past correspondence re 1 ated to a
petition by residents on Peru Road that was directed to the City
Council.
My interpretation of the zoning regulations was that a greyhound kennel
would be allowed on the basis -of continuous agricultural uses on the
property prior to and after rezoning to R-l Single-Family District.
There was no attempt to evaluate whether such a use would be a nuisance
to its environs.
Although the City Council discussed the possible need to amend the
Zoning Ordinance with regard to agricultural uses, no study is now
underway. If you or anyone else is interested in zoning text
amendments, our offi ce woul d ass i st you wi th an app 1 i cat i on to the
Planning and Zoning Commission and City Council.
Chapter 7 of the City Code regul ates "Animals and Fowl". Amendments to
this part of the City Code would be adopted by the City Counci 1. You
would direct your suggestion for code changes to the City Council
through the offi ce of the City Cl erk. It wou 1 d be usefu 1 to provi de a
copy of your request to the Health Services Division. Health Services
has responsibility for administration of the animal control section of
the code.

I NTRODUCTI ON
On October 5, 1987 residents on Peru Road in the Kennedy-Larches Subdivision
and the Kennedy Subdivision presented a petition to the City Council. Their
petition listed complaints about a kennel operating at the address above.
The applicable zoning definitions and regulations are herein discussed.
BACKGROUND
1) The residence and accessory buildings of this address are located on Lot
1 of SW 1/4 of SW 1/4 of SW 1/4, Sect ion T89N-R2E. The lot contai ns
approximately 5.8 acres. The buildings include one single family
residence, three small farm-type barns and one garage. The buildings
appear on aeri a1 photographs as far back as 1975 and must be much 01 der
than that.
2) The property is zoned R-l Single Family Residential District. The
property was zoned to this district in May, 1983.
3) No structure requiring building permits have been constructed since
annexation in the City.
4) Aeri a1 photographs i ndi cate that 1 and north of the buil di ngs has been
used for agricultural purposes continuously from 1975 to the present
time. At the time of being zoned R-l the non-residential buildings and
agricultural use of the property became lawful non-conformities. No
evidence has been found to suggest that the protections of lawful
non-conformities have lapsed.
5) There are several unique characteristics of agricultural uses.
Buildings and land may be used for a variety of activities that
contribute to agricultural production. For example, the same field may
contain livestock that is grazing then be planted for crops and returned
to grazing in the same year. Portable houses or pens may be placed in a
field for raising animals several times a year. Land may be set aside
for comp1 i ance wi th federal agri cultural programs or conservation
purposes. These vari ab 1 e act i vi ties are accompli shed wi thout erecting
permanent structures.

If one accepts thi s as bei ng the character of agri culture then an exact
cessation of anyone use is very difficult to establish for purposes of
ending non-conforming protections.
6) The Zoning Ordinance lists as pennitted uses the "raising of livestock"
and "animal husbandry". My interpretation is that raising domestic
animals of any type would be allowed under an agricultural district.
The previ ous ana lys is as di scussed in #5 suggests that even a
non-confonning use of agriculture has certain rights to use land and
structures for various uses including a change from grazing of cattle or
swine, to confining dogs, cats or rabbits. There is no more "commercial
nature" if the animals change from cattle to dogs. All animal husbandry
consists of breeding, feeding and care for the animals until which time
they are traded or sold.
7) Staff site inspections were conducted on October 9, 1987. We found that
no fences or accessory structures are in violation of zoning
requirements for the R-1 Oistrict. No signs or other non-residential
structures have been erected. No "i ntens ifi cat i on" has occurred that
would require additional parking spaces.
ANALYSIS
Agricultural uses have been in continuous operation on the site since
annexation into the City. The R-1 zoning made the agricultural uses and
structures lawful non-conformities. No clear guidelines or standards exist
in the Zoning Ordinance which limit the variability of use inherent in an
active fann. There is a risk that this variability would allow a pasture to
alternatively be used for sheep, dogs, swine, horses, goats and so on. Each
animal may create different impacts on its surroundings. These impacts may
be odor, noi se, dust or soil eros i on. The an ima 1 s tend to concentrate
themselves on the site where there is water, food or shelter.
The current ordi nance provi des few protect ions for other 1 and uses that are
near established agricultural uses. The City Council may judge that the
si tuati on warrants addi t i onal defi nit ions, standards and regul at ions for non-
confonning agricultural uses or agricultural uses near residential uses.
CONCLUS ION
The agri cul tura 1 use cont i nues as a non-conformi ng use.

RE: Peru Road Greyhound Kennel Petition
Dear Mayor and Council Members:
I have received today a copy of Development Planner
Dennis Slaughter's memorandum to Community Development Dir-
ector Jim Burke regarding the Petition about the Greyhound
Kennel on Peru Road. .
I have independently come to the same conclusion that
Dennis did, specifically, that the present use of the prop-
erty for dog kennels is a lawful use under the appropriate
provisions of the zoning ordinance.
I have been unable to find any Iowa cases which spe-
cifically address the question of what does or does not con-
stitute an agricultural use of property, or whether or not
the operation of a dog kennel is or is not a agricultural
use of property. In any event, those questions should be
resolved from an interpretation of the terms of the partic-
ular zoning ordinance.
Under the zoning ordinance, the property which is the
subject of the Petition is governed by the agricultural
classification.

A permitted use, under the zoning ordinance, in an agri-
cultural district is the raising of livestock and "animal
husbandry. "
"Animal husbandry" is defined by most dictionaries as
the raising of "domestic animals." "Domestic animals" are
animals which are tame. See, for example, Webster's Col-
legiate Dictionary.
