AN ORDINANCE AMENDING APPENDIX A (THE ZONING ORDINANCE) OF THE CITY
OF DUBUQUE CODE OF ORDINANCES BY RECLASSIFYING HEREINAFTER
DESCRIBED PROPERTY LOCATED AT 3030 BRUNSKILL ROAD FROM AG
AGRICULTURAL TO PUD PLANNED UNIT DEVELOPMENT DISTRICT AND A PR
PLANNED RESIDENTIAL DISTRICT DESIGNATION AND ADOPTING A
CONCEPTUAL DEVELOPMENT PLAN, WITH CONDITIONS.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:

Section 1. Appendix A (the Zoning Ordinance) of the City of Dubuque Code of
Ordinances is hereby amended by reclassifying the hereinafter described property from
AG Agricultural and R-1 Single-Family Residential Districts to PUD Planned Unit
Development District with a PR Planned Residential District designation and adopting a
conceptual development plan, a copy of which is attached to and made a part hereof for
the property designated as PR Planned Residential on the conceptual development plan,
to the center line of the adjoining public right-of-way, all in the City of Dubuque, Iowa.
Section 2. Pursuant to Iowa Code Section 414.5 (1993), and as an express the
condition of the reclassification, the undersigned property owner agrees to the following
conditions, all of which the property owners further agree are reasonable and imposed to
satisfy the public needs that are caused directly by the zoning reclassification:
A. Use ReQulations.
The following regulations shall apply to all uses made of land in the above
described PUD District:
1) Principal permitted uses for PR Planned Residential District shall be
limited to twenty (20) condominium dwelling units in ten (10) two-unit
buildings [11].
2) Accessory uses shall include any use customarily incidental and
subordinate to the principal use it serves.

B. Lot and Bulk Regulations.
Development of land in the PUD District shall be regulated as follows:
1) All residential structures shall be constructed in substantial compliance
with the attached conceptual development plan.

2) Maximum height for all structures shall be 30 feet.
C. Performance Standards.
The development and maintenance of uses in this PUD District shall be
established in conformance with Section 3-5.5 of the Zoning Ordinance and
the following standards:
1) Erosion control devices shall be provided during all phases of construction
of the PR Planned Residential District development.
2) Parking requirements for allowed uses shall be as per the parking group
for the designated use, in accordance with Section 4-2 of the Zoning
Ordinance.
3) Sidewalks shall be provided adjoining all new public streets.
4) Storm water control facilities will be installed as per City Engineering
requirements.

5) Final site development plans shall be submitted in accordance with
Section 4-4 of the Zoning Ordinance prior to construction of any buildings
and parking lots.
D. ODen Space and Recreational Areas
Those areas not designated on the conceptual development plan for
development shall be maintained as open space, as defined by Section 8 of
the Zoning Ordinance by the property owner and/or association.
E. Sign Regulations.
Signs in the PUD District shall be regulated as follows in accordance with the
R-1 Single-Family Residential District sign regulations of the Zoning
Ordinance.
F. Transfer of Ownership
Transfer of ownership or lease of property in this PUD District shall include in
the transfer or lease agreement a provision that the purchaser or lessee
acknowledges awareness of the conditions authorizing the establishment of
the district.

G. Reclassification of Subiect PrODertv.
The City of Dubuque, Iowa, may initiate zoning reclassification proceedings to
the AG Agricultural District and R-1 Single-Family Residential District in
accordance with Section 6 of the Zoning Ordinance if the property owner fails
to complete or maintain any of the conditions of this ordinance.

H. Modifications.
Any modifications of this Ordinance must be approved by the City Council in
accordance with zoning reclassification proceedings of Section 6 of the Zoning
Ordinance.
I. Recording.
A copy of this ordinance shall be recorded at the expense of the property
owner(s) with the Dubuque County Recorder as a permanent record of the
conditions accepted as part of this reclassification approval within ten (10)
days after the adoption of this ordinance. This ordinance shall be binding
upon the undersigned and his/her heirs, successors and assigns.
Section 3. The foregoing amendment has heretofore been reviewed by the Zoning
Commission of the City of Dubuque, Iowa.

Section 4. The foregoing amendment shall take effect upon publication, as provided
bylaw.

This memo transmits a revised ordinance and conceptual development plan for the
PUD Planned Unit Development rezoning request of David Patzer for his property at
3030 Brunskill Road. .

At their May 15, 2000, public hearing on this request, the City Council tabled this
request to their June 5, 2000, meeting to allow staff and Mr. Patzer to modify the PUD
request.
The City Council has a motion on the table to approve the PR Planned Residential
portion of the PUD, and to deny the PO Planned Office portion of the PUD. The
attachments reflect this motion. The PO portion has been deleted.
Under Iowa Code, the property owner must agree in writing to the rezoning conditions
prior to the close of the public hearing.

in Section 27, T89N, R2E, to the center line of the adjoining public right-of-way, all
in the City of Dubuque, Iowa.

B. Lot and Bulk Reaulations.
Development of land in the PUD District shall be regulated as follows:
1) The existing house in PO Planned Office District may be expanded as
an office to either the north or the west, but not both, with the exterior of
any addition to be completed as shown in the attached Exhibits A or B.
2) All multi-family residential structures in PR Planned Residential District
shall be constructed in substantial compliance with the attached
conceptual development plan.
3) Maximum height for all structures shall be 30 feet.
C. Performance Standards.
The development and maintenance of uses in this PUD District shall be
established in conformance with Section 3-5.5 of the Zoning Ordinance and
the following standards:
1) Erosion control devices shall be provided during all phases of
construction of the PR Planned Residential District development.
2) Parking requirements for allowed uses shall be as per the parking group
for the designated use, in accordance with Section 4-2 of the Zoning
Ordinance.
3) Sidewalks shall be provided adjoining all new public streets.
4) Storm water control facilities will be installed as per City Engineering
requirements.
5) Final site development plans shall be submitted in accordance with
Section 4-4 of the Zoning Ordinance prior to construction of any
buildings and parking lots.
D. Open Space and Recreational Areas
1) Those areas not designated on the conceptual development plan for
development shall be maintained as open space, as defined by Section
8 of the Zoning Ordinance by the property owner and/or association.

Signs in the PUD District shall be regulated as follows:
1) Signs shall be allowed in the PO Planned Office District in accordance
with the OS Office Service District sign regulations of the Zoning
Ordinance.
2) Signs shall be allowed in the PR Planned Residential District in
accordance with the R-1 Single-Family Residential District sign
regulations of the Zoning Ordinance.
F. Transfer of Ownership
Transfer of ownership or lease of property in this PUD District shall include in
the transfer or lease agreement a provision that the purchaser or lessee
acknowledges awareness of the conditions authorizing the establishment of
the district.
G. Reclassification of Subiect Propertv.
The City of Dubuque, Iowa, may initiate zoning reclassification proceedings
to the AG Agricultural District and R-1 Single-Family Residential District in
accordance with Section 6 of the Zoning Ordinance if the property owner fails
to complete or maintain any of the conditions of this ordinance.
H. Modifications.
Any modifications of this Ordinance must be approved by the City Council in
accordance with zoning reclassification proceedings of Section 6 of the
Zoning Ordinance.
I. RecordinQ.
A copy of this ordinance shall be recorded at the expense of the property
owner(s) with the Dubuque County Recorder as a permanent record of the
conditions accepted as part of this reclassification approval within ten (10)
days after the adoption of this ordinance. This ordinance shall be binding
upon the undersigned and his/her heirs, successors and assigns.
Section 3. The foregoing amendment has heretofore been reviewed by the Zoning
Commission of the City of Dubuque, Iowa.
Section 4. The foregoing amendment shall take effect upon publication, as
provided by law.

Purpose: The applicant is proposing a rezoning of the subject parcel to a Planned Unit
Development to allow the conversion of an existing house into an office and to develop
the balance of the 11.9 acre site for residential purposes with the construction of 10
two-unit condominium buildings for a total of 20 dwelling units.
Property History: The applicant submitted a rezoning request for the single-family
home and the 1.7 acre parcel that it sits on from R-1 Single-Family Residential to OS in
the summer of 1999. That request was denied by the City Council at their July 19th
meeting. The applicant also submitted a request in January, 2000, to rezone the 1.7
acres to OS and the 10-acre parcel to the rear to R-3 Moderate Density Multi-Family
District. The applicant has now withdrawn that request and submitted a Planned Unit
Development for the Commission's review.
Physical Characteristics: The subject parcel totals 11.9 acres, with frontage on
Brunskill Road. The property is generally flat where it abuts Brunskill Road, but slopes
to the west.

Conformance with Comprehensive Plan: This area was not designated as part of
the 1995 Comprehensive Plan.
Staff Analysis:
Streets: The proposed development includes the construction of two short cul-de-
sacs that will be built to City standards of 31 feet of paving and 50 feet of right-of-
way and dedicated to the City of Dubuque. Access to the office building will be
directly from Brunskill Road while the proposed two-unit condominium buildings will
access the proposed public streets.
Sidewalks: Sidewalks will be installed on the new public streets as required by the
City of Dubuque Subdivision Regulations.
Parking: The proposed development includes a 14-space parking lot adjacent to
the office. In addition, each condominium will be required to have two off-street
parking spaces.
Lighting: All new lighting will be required to be of a cut-off design to minimize
adverse impacts to adjacent property.
Signage: None has been proposed at this time.
Bulk Regulations: All new residential structures will be located in substantial
compliance with the submitted conceptual development plan and in all other
respects comply with the R-2 Two-Family Residential District standards.
Permeable Area (%) & Location (Open Space): The proposed development covers
approximately between 40-45% of the property with impermeable surface. The
proposed development includes walking trails through the development. In
addition, a substantial amount of open space is retained in the southwest corner of
the site and along the west boundary of the development.
Landscaping/Screening: The proposed development includes the planting of
additional trees and shrubs as a screen along the north property line of the
development and the retention of existing trees to the north of the existing house.
Phasing of development: The existing house would be converted to an office first
with development of the residential portion done in two phases.
Impact of Request on:
Utilities: Existing utilities are adequate to serve the site.

Traffic Patterns/Counts: Brunskill Road is classified as a collector street and
carries approximately 1,040 vehicle trips per day based on 1997 counts by the
IDOT.
Public Services: Existing public services are adequate to serve the site.
Environment: No adverse impacts to the environment are anticipated provided
adequate erosion control is provided during all phases of construction and that
storm water detention is provided as shown on the submitted conceptual plan.
Adjacent Properties: If approved, the proposed rezoning will increase the number
of vehicle trips on Brunskill Road. The ambient light level may increase with the
addition of new outdoor lights and as the area develops, the view from existing
houses will change from an open space area to a residential area.
CIP Investments: None proposed.
Staff Analysis: The applicant is requesting rezoning of the subject property from R-1
Single-Family Residential and AG Agricultural to a PUD Planned Unit Development with
a PO Planned Office and PR Planned Residential District designation. The proposed
development by Dave Patzer will provide for the conversion of the existing house at
3030 Brunskill Road to an office for Scan Communications and the construction of up to
10 two-unit condominium buildings providing for a total of 20 dwelling units arranged
along two short cul-de-sacs that will be built to City standards and dedicated to the City
of Dubuque.
The proposed conversion of the existing single-family house to an office will include in
the future a small expansion to either the north side or west side of the single-family
structure, but would not include both. A parking lot will also be created to the north of
the existing house at a future date with access directly to Brunskill Road.
The proposed streets will be built to City standards with 31 feet of paving and 50 feet of
right-of-way. Sidewalks wil be required along both sides of the public streets. The
proposed residential development will also include a walking trail through the
development as well as a gazebo located between units #5 and #6. The City
Engineering Division has reviewed the proposed location of the street access to
Brunskill Road and is comfortable that there is adequate site visibility at this point.
The proposed development will be hooked up to City water and sewer, and provide a
storm water detention area between units #4 and #7, and in all respects, meet City of
Dubuque standards for utility extension and connection.
Planning staff have estimated the number of additional vehicle trips the proposed
Patzer development will generate. The proposed office will generate approximately 3.5
vehicle trips per employee. Staff understand that initially there will be five employees at

this location; thus, will generate approximately 18 vehicles trips per day. The 20
condominium units will develop approximately 117 vehicle trips per day. Brunskill Road
currently carries 1,040 vehicle trips per day based on 1997 counts by lOOT. The
proposed development will add approximately 135 additional vehicle trips per day to
that total.
Staff recommend the Zoning Advisory Commission review Section 3-5.5(F) that
establishes approval standards for PUD applications.

Description: To rezone property from AG Agricultural District and R-1 Single-Family
Residential District to PUD Planned Unit Development with a PO Planned
Office and a PR Planned Residential designation.
Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request.
The application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request, indicating that the request is compatible with
surrounding residential properly and that the conversion of the house to an office will
maintain the outward appearance of a residence. He felt that the proposed planned district
will not overburden Brunskill Road with additional traffic and will not adversely impact the
value of adjacent properly. Several residents spoke in opposition to the request, stating
they had concerns regarding additional traffic on Brunskill Road, negative impact on
properly values and the introduction of an office use in an otherwise residential
neighborhood. Staff reviewed the history of rezoning applications for the subject property.
Staff noted that there were adequate City services available to serve the proposed
development.
The Zoning Advisory Commission discussed the request, noting that the proposed
residential development was consistent with existing development in the neighborhood and
that the proposed office, if restricted to Scan Communications, will not adversely impact the
neighborhood.

Recommendation
By a vote of 7 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request, with the conditions noted in the attached PUD district ordinance,
including:
1) the principal permitted use in the PO district is limited to Scan Communications
Group, Inc.;
2) the principal permitted use in the PR district is limited to 20 condominium units in
two-unit buildings; and
3) the existing house in the PO district may be expanded to the north or the west, but
not both, and exterior work must be completed as shown in Exhibit A or Exhibit B.
A super majority vote is needed for the City Council to approve the request, as written
objections by the owners of 20 percent or more of the property within 200 feet of the
rezoning request has been received. As of April 10, 2000, written objections equalled about
43% of the property within 200 feet of the rezoning request.
