AN ORDINANCE AMENDING APPENDIX A (THE ZONING ORDINANCE) OF THE CITY
OF DUBUQUE CODE OF ORDINANCES BY RECLASSIFYING HEREINAFTER
DESCRIBED PROPERTY LOCATED AT 11515 ENGLISH MILL ROAD FROM DUBUQUE
COUNTY A-1 AGRICULTURAL DISTRICT TO CITY OF DUBUQUE C-3 GENERAL
COMMERCIAL DISTRICT, R-3 MODERATE DENSITY MULTI-FAMILY RESIDENTIAL
DISTRICT AND R-1 SINGLE-FAMILY RESIDENTIAL DISTRICT, WITH CONDITIONS,
CONCURRENT WITH ANNEXATION.
Whereas, Gerald and Judith Siegert have requested rezoning concurrent with
annexation to the City of Dubuque in accordance with Section 2-3 of Appendix A (Zoning
Ordinance) of the City of Dubuque Code of Ordinances; and
Whereas, this request has been found to be consistent with the Comprehensive Plan
and the Future Land Use Map of the Comprehensive Plan,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1, That Appendix A (the Zoning Ordinance) of the City of Dubuque Code of
Ordinances is hereby amended by reclassifying the hereinafter described property from
Dubuque County A-1 Agricultural District to City C-3 General Commercial District, R-3
Moderate Density Multi-Family Residential District and R-1 Single-Family Residential District
as shown on Exhibit 1, and to the center line of the adjoining right-of-way, all in the City of
Dubuque, Iowa,
SeCtion 2. The foregoing amendment has heretofore been reviewed by the Zoning
Advisory Commission of the City of Dubuque, Iowa,
Section 3. This ordinance shall take effect immediately upon publication as provided
by law, and at such time that the herein described property is legally annexed into the City of
Dubuque, Iowa.

MEMORANDUM OF AGREEMENT
.
Pursuant to the Iowa Code Section 414.5 (1993), and as an express condition of rezoning
of the property described as:
As shown on Exhibit 1, and to the center line of the
adjoining public right-of-way, all in the City of Dubuque,
Iowa.
which is the subject of Ordinance No. i-ft/ -DO, a copy of which is attached hereto and
incorporated herein by reference, the undersigned property owners, agree to the following
conditions, all of which the property owner further agrees are reasonable and are imposed
to satisfy public needs which are caused directly by the rezoning:
A) Performance Standards
1) That the applicant work with IDOT staff prior to filing of subdivision plats to
insure that IDOT's highway concept can be accommodated with minimal
disruption to any subdivision plat.
2) That multi-family housing in the area zoned R-3 shall be limited to townhouses
or condominiums.

B)
Reclassification of the Subiect Property. The City of Dubuque, Iowa may initiate
zoning reclassification proceedings to the AG Agricultural District (which rezoning
will include the removal of the performance standards in Exhibit nAn) if the property
owner fails to complete any of the conditions or provisions of this Agreement.
C) Modifications. Any modifications of this Agreement shall be considered a zoning
reclassification and shall be subject tot he provisions of the Zoning Ordinance
governing zoning reclassifications. All such modifications must be approved by the
City Council of Dubuque, Iowa.
D) Recordinq. A copy of this Agreement shall be recorded with the Dubuque County
Recorder as a permanent record of the conditions accepted as part of this rezoning
approval within ten (10) days of the adoption of Ordinance No. L/'/-t7t1-~
E) Construction. This Agreement shall be construed and interpreted as though it were
part of Appendix A of the Code of Ordinances of the City of Dubuque, also known
as the Zoning Ordinance of the City of Dubuque, Iowa.
F) This Agreement shall be binding upon the undersigned and his/her heirs, successor
and assignees.

Property History: The applicants have requested rezoning to City C-3 General
Commercial, R-3 Moderate Density Multi-Family and R-1 Single-Family Residential
concurrent with annexation. The property has been in agricultural use for decades. A
previous rezoning request was submitted by Mike Portzen and approved by the City
Council, with conditions on access, lot sizes and exclusion of a 10-acre parcel on
September 7, 1999. The annexation agreement was never executed; thus, the property
remained in the County and the rezoning was made null and void.
Physical Characteristics: The property is vacant farmland south of the Highway 20 I
Cousins Road intersection and west of English Mill Road. Topography ranges from
moderately steep slopes near Highway 20, to gently rolling along English Mill Road. A
branch of the South Fork of Catfish Creek drains the property.
Concurrence with Comprehensive Plan: This property is not an identified growth
area in the 1994-1995 Comprehensive Plan. The Comprehensive Plan includes goals
and objectives that recognize the need to annex and provide utilities to areas for future
commercial and residential growth.
This property was identified in the 1998 Annexation Study as a Priority 2: Benefitted
Area. This property was evaluated as an industrial site in the 1997 Industrial Park
Feasibility Study.

Impact of Request on:
Utilities: The property can be adequately served from a 12-inch water main along
U.S. Highway 20 and an 8-inch sanitary sewer interceptor along the South Fork of
Catfish Creek.
Traffic Patterns/Counts: The property's access is currently limited to farm
accesses off of English Mill Road. Future access to Highway 20 will likely be by
frontage roads, with no direct access to Highway 20. Alternate access to the
property may be provided via English Mill Road. Average daily traffic counts along
this section of Highway 20 are estimated to be 17,820.
The Iowa Department of Transportation (lOOT) has hired the consulting firm, HDR
Engineering, to conduct a Highway 20 Corridor Study from Devon Drive to Swiss
Valley road. The study is to consider the reconstruction of Highway 20 to provide a
free-flow of traffic with no traffic signals. Improvements that will be considered may
include the addition of interchanges and modifications to existing intersections and
frontage roads, and conversion of two-way frontage roads to one-way.
The lOOT has also established a Corridor Preservation Zone along this portion of
U.S. Highway 20. Notification of this rezoning request has been sent to the lOOT.
Public Services: Response times for City police, fire and emergency services will
be the same as or less than response times of County and volunteer services. The
City has identified that an additional or relocated fire station may be needed in the
future as the community develops to the west. The City also has identified that
annexation will require an additional snow removal route.
Environment: Erosion control, storm water management, and flood plain
development regulations will be required during and after the development.
Adjacent Properties: The property to the north is in agricultural use but has
recently been zoned for highway commercial development. The DMASWA landfill
and a construction company lie to the west. A large residential subdivision lies to
the south, and vacant farmland lies to the west. Any development will be subject to
the City's site development standards.
CIP Investments: A 12-inch water main was installed along Highway 20 in 1998.
An 8-inch sanitary sewer interceptor will be extended along the South Fork of
Catfish Creek in 1999.
Staff Analysis: The Zoning Advisory Commission previously reviewed a similar
request by the applicants at their February 2, 2000 meeting. The current request has
been modified to include an R-3 district as a buffer between Barrington Lakes
Subdivision and the proposed C-3 General Commercial zoning to the east. In addition,

the applicants have agreed to maintain the same lot widths as those in Barrington
Lakes Subdivision where the proposed R-1 zoning borders Barrington Lakes
Subdivision.
The applicant has requested rezoning from County A-1 Agricultural to City C-3 General
Commercial, R-3 Moderate Density Multi-Family Residential and R-1 Single-Family
Residential District concurrent with annexation. The C-3 General Commercial District is
intended for highway-oriented businesses along arterials and highways. The R-3
Moderate Density Multi-family Residential District allows a range of residential housing
and between one and six dwelling units per lot. The R-1 Residential District is intended
for single-family homes.
The Comprehensive Plan includes objectives for annexation of additional land for
commercial and residential development. The property in question is not specifically
identified on the Future Land Use Map as a growth area, however it was included as
growth Area 5 in the Annexation Study, which designated it for a mixture of single-
family, commercial and open space.
Access to Highway 20 likely will be via frontage roads, without direct access to Highway
20; however, the final configuration of any intersection or controlled access rests with
the Iowa Department of Transportation (lOOT). Planning for development of the
property, therefore, is dependent on the results of the lOOT Highway 20 Corridor Study.
Access to the site is also available from English Mill road. The Zoning Advisory
Commission will review future street layouts once preliminary plats are submitted.
The Iowa Department of Transportation has been sent a letter advising them of the
receipt of this rezoning request. Planning staff anticipates a reply by the Commission's
May 3 meeting.
The proposed rezoning includes approximately 99.5 acres of commercial property, 6.5
acres of multi-family property and 116 acres of single-family residential property. The
property proposed for C-3 zoning is adjacent to U.S. Highway 20 and surrounds
property already zoned C-3 that is owned by Dubuque Metropolitan Area Solid Waste
Agency
Staff recommend that the Commission review Section 6-1.1 of the Zoning Ordinance
that establishes the criteria for review of zoning requests.

'The residents of Ilaningtoo lakes have always been concemed that any rezoning and annel0tion
near our area be carefully examined. The subject request is no exception.
Representatives of our AssodatiOn met with Mr. Herrig and Gerald and Judith SIegert In recent
weekS to negotiate what we believe is a workable resolutiOn to the connk:ts resident in prior
rezoning requests. Our agreement Is outlined below:
In the area to be rezoned R-l, any lot that borders Barrington Lakes win have a lot width
that matches the CXlfTeSIlOnding lot in Barrington Lakes.
Although our AssoCiation would prefer a green space buffer betWeelI Banington lakes
and the proposed C-3 area, we are wilrmg to a<<ept the R-3 area as proposed. We
would, however, prefer a stipulatiOn that the R-3 area be limited to townhoUse or
condo constnx:tlon rather than multi-family apartments. These 'owned" properties are
much better suited to the adjacent R-l of BaningtOlllakes. We realize that this is at
the diScrelion of the commiSSioners.
With these stipulationS, the Barrington Lakes Property oWf1el"s Association will not oppose the

The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request.
The application, staff report and related materials are attached for your review.
Discussion
John Herrig, representing Gerald and Judith Siegert, spoke in favor of the request, stating
that they have met with adjacent property owners from Barrington Lakes Subdivision and
have been able to address their concerns. Mr. Herrig also stated that there was a need in
the community for additional commercially and residentially zoned property. Several
residents spoke in opposition to the proposed multi-family and commercial zoning, citing
concerns with aesthetics and loss of property value. Staff reviewed the history of the
rezoning request for the subject property and Iowa Department of Transportation (lOOT)
recommendations.
The Zoning Alivisory Commission discussed the request, noting that the property fronting
on U.S. Highway 20 is most conducive to commercial zoning and that the R-3 zoning serves
as a transition zone between the Barrington Lakes Subdivision and the commercial zoning.
Recommendation
By a vote of 6 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request with two (2) conditions. Conditions recommended by the Commission

1. That the applicant work with lOOT staff prior to filing of subdivision plats to insure that
lOOT's highway concept can be accommodated with minimal disruption to any
subdivision plat.
2. That multi-family housing in the area zoned R-3 shall be limited to townhouses or
condominiums.
A super majority vote is needed for the City Council to approve the request as written
objections have been received from more than 20% of owners of property within 200 feet.

DUBUQUE CODE OF ORDINANCES PROVIDING FOR THE REGULAR
MEETINGS OF THE CITY COUNCIL BY CHANGING THE MEETING
DATES FOR JULY, 2000
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF DUBUQUE, IOWA:
Section 1. Sec. 2-22 of the City of Dubuque Code of__
Ordinances is amended to read as follows:
Sec. 2-22. Meetings-Date.
Regular meetings of the council shall be held on the first
and third Monday of each month and special meetings may be
called from time to time by the mayor or a majority of the
members of the council. When the day fixed for any regular
meeting of the council falls upon a day designated as a legal or
national holiday, such meeting shall be held at the same hour on.
the next succeeding day not a holiday. .
Notwithstanding the foregoing)the regular meetings' for
July, 2000 shall be the first Wednesday and the third Monday.
Section 2. This Ordinance shall take effect upon
publication.

AN ORDINANCE AMENDING APPENDIX A (THE ZONING ORDINANCE) OF THE CITY
OF DUBUQUE CODE OF ORDINANCES BY RECLASSIFYING HEREINAFTER
DESCRIBED PROPERTY LOCATED AT 11515 ENGLISH MILL ROAD FROM DUBUQUE
COUNTY A-1 AGRICULTURAL DISTRICT TO CITY OF DUBUQUE C-3 GENERAL
COMMERCIAL DISTRICT, R-3 MODERATE DENSITY MULTI-FAMILY RESIDENTIAL
DISTRICT AND R-1 SINGLE-FAMILY RESIDENTIAL DISTRICT, WITH CONDITIONS,
CONCURRENT WITH ANNEXATION.
Whereas. Gerald and Judith Siegert have requested rezoning concurrent with
annexation to the City of Dubuque in accordance with Section 2-3 of Appendix A (Zoning
Ordinance) of the City of Dubuque Code of Ordinances; and
Whereas, this request has been found to be consistent with the Comprehensive Plan
and the Future Land Use Map of the Comprehensive Plan.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Appendix A (the Zoning Ordinance) of the City of Dubuque Code of
Ordinances is hereby amended by reclassifying the hereinafter described property from
Dubuque County A-1 Agricultural District to City C-3 General Commercial District, R-3
Moderate Density Multi-Family Residential District and R-1 Single-Family Residential District
as shown on Exhibit 1, and to the center line of the adjoining right-of-way, all in the City of
Dubuque, Iowa.
Section 2. The foregoing amendment has heretofore been reviewed by the Zoning
Advisory Commission of the City of Dubuque, Iowa.
Section 3. This ordinance shall take effect immediately upon publication as provided
by law, and at such time that the herein described property is legally annexed into the City of
Dubuque, Iowa.

MEMORANDUM OF AGREEMENT
Pursuant to the Iowa Code Section 414.5 (1993), and as an express condition of rezoning
of the property described as:
As shown on Exhibit 1, and to the center line of the
adjoining public right-of-way, all in the City of Dubuque,
Iowa.
which is the subject of Ordinance No. if t/ -00, a copy of which is attached hereto and
incorporated herein by reference, the undersigned property owners, agree to the following
conditions, all of which the property owner further agrees are reasonable and are imposed
to satisfy public needs which are caused directly by the rezoning:
A) Performance Standards
1) That the applicant work with lOOT staff prior to filing of subdivision plats to
insure that lOOT's highway concept can be accommodated with minimal
disruption to any subdivision plat.
2) That multi-family housing in the area zoned R-3 shall be limited to townhouses
or condominiums.
B)
Reclassification of the Subiect Property. The City of Dubuque, Iowa may initiate
zoning reclassification proceedings to the AG Agricultural District (which rezoning
will include the removal of the performance standards in Exhibit "A") if the property
owner fails to complete any of the conditions or provisions of this Agreement.
C) Modifications. Any modifications of this Agreement shall be considered a zoning
reclassification and shall be subject tot he provisions of the Zoning Ordinance
governing zoning reclassifications. All such modifications must be approved by the
City Council of Dubuque, Iowa.
D) RecordinQ. A copy of this Agreement shall be recorded with the Dubuque County
Recorder as a permanent record of the conditions accepted as part of this rezoning
approval within ten (10) days of the adoption of Ordinance No. .:;'4/-tJtJ-~
E) Construction. This Agreement shall be construed and interpreted as though it were
part of Appendix A of the Code of Ordinances of the City of Dubuque, also known
as the Zoning Ordinance of the City of Dubuque, Iowa.
F) This Agreement shall be binding upon the undersigned and his/her heirs, successor
and assignees.
