City Planner Address: City Hall. 50 W. 13th Street Telephone: 589-4210 RESOLUTION NO. 239-00 RESOLUTION ANNEXING CERTAIN PROPERTY Whereas, Gerald and Judith Siegert, property owners, have voluntarily petitioned for annexation of approximately 222 acres of property lying outside of the corporate limits of the City of Dubuque, Iowa, as shown in Exhibit A; and Whereas, Chapter 368 of the Code of Iowa authorizes the extension of City limits in situations of this character by adoption of a resolution after notification as required by State regulations; and Whereas, this request has been found to be consistent with the Comprehensive Plan and the Future Land Use Map of the Comprehensive Plan; and Whereas, the future growth and development of the City of Dubuque, Iowa, make it desirable that said property be made part of the City of Dubuque, Iowa. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That the territorial limits of Dubuque, Iowa, be, and they hereby are extended to include the property legally described as shown in Exhibit A. Section 2. The territory hereby annexed shall become a part of the Third Precinct of the First Ward of the City of Dubuque, Iowa. Section 3. That the City Clerk shall file this resolution, all exhibits and the petition for voluntary annexation with the State of Iowa in accordance with State regulations. A 10-acre site on English Mill Road, where their home and farm buildings are located, is not included in their annexation request. The property owners are requesting annexation in conjunction with rezoning to C-3 General Commercial for the western 99.5 acres, R-3 Moderate Density Multi-Family Residential for 6.5 acres between the C-3 zone and Barrington Lakes Subdivision, and R-1 Single-Family Residential for the remaining 116 acres, for future development. They plan to develop their property into commercial and residential subdivisions. The Siegerts do not have any development plans at this time. Physical Characteristics: The property is served by farm access off of English Mill Road. Topography ranges from moderately steep slopes near Highway 20, to gently rolling along English Mill Road. A branch of the South Fork of Catfish Creek drains the property. A high pressure natural gas line bisects the site. Conformance with Comprehensive Plan: The 1995 Comprehensive Plan did not include this property as a potential growth area on the Future Land Use Map. Annexation and residential/commercial development of this property, however, is consistent with the goals and objectives established for the Land Use and Urban Design Element and the Housing Element of the Comprehensive Plan. The Comprehensive Plan includes goals to facilitate annexation and rezoning to planned and orderly growth outside the City's boundaries at the time the Plan was adopted. . . . . ANNEXATION STAFF REPORT Page 2 The property was identified as a Priority 2: Benefitted Area in the 1998 Annexation Study. The property also was evaluated as a possible industrial site in the 1997 Industrial Park Development Feasibility Study. Impact of Request on: Utilities: Existing utilities in the area can be extended to and are capable of handling anticipated development of the subject property. There is a 12-inch water main along Highway 20, and an 8-inch sanitary sewer along the South Fork of Catfish Creek. Traffic Patterns/Counts: The property currently has access to both Highway 20 and English Mill Road. Future access to Highway 20 will likely be by frontage roads, with no direct access to Highway 20. Alternate access to the property may be provided via English Mill Road. Average daily traffic counts along this section of Highway 20 are estimated to be 17,820. lOOT and City staff have discussed concept plans for corridor preservation and controlled access along Highway 20 from Old Highway Road to Swiss Valley Road. lOOT staff held an informational meeting on a proposed Corridor Preservation Zone (CPZ) for Highway 20 on February 3, 2000. The lOOT Commission approved the CPZ on March 7, 2000. A portion of the Siegert farm is in the CPZ. Public Services: Response time for police, fire, and emergency services will be the same as or less than the response times of County and volunteer services. The City has identified that an additional or relocated fire station may be needed in the future as the community develops to the west. The City also has identified that annexation will require an additional snow removal route as development warrants. Environment: No adverse impact to the environment is anticipated if adequate erosion control measures are provided during all phases of construction and appropriate storm water control is provided as part of the development. Adjacent Properties: The property to the north is in agricultural use but has been recently zoned for highway commercial development. The DMASWA landfill and a construction company lie to the east. A large residential subdivision, Barrington Lakes, lies to the south, and vacant farmland lies to the west. The proposed rezoning would continue the commercial development pattern along Highway 20 and the residential development pattern of the large subdivision to the south. CIP Investments: A 12-inch water main was installed along Highway 20 in 1998. An 8-inch sanitary sewer interceptor was extended along the South Fork of the Catfish Creek in 1999. . . . . ANNEXATION STAFF REPORT Page 3 Staff Analysis and Recommendation: The subject property is in Dubuque County. The applicants have requested annexation of 222 acres concurrent with rezoning to C-3 General Commercial, R-3 Moderate Density Multi-Family Residential, and R-1 Single- Family Residential. Gerald and Judith Siegert are the property owners. The Siegerts have requested annexation concurrent with rezoning to facilitate future development of the property with commercial and residential subdivisions. On September 7, 1999, the City Council approved the rezoning and annexation of 213 acres of the 222 acres included in this request. Ten acres adjoining Barrington Lakes Subdivision were not included in that annexation. The September, 1999 approval was on the condition that developer Michael Portzen purchase the property from the Siegerts by December 6, 1999. That purchase did not take place, so that annexation request is now null and void. Since the 1999 rezoning was contingent on the annexation, that rezoning is null and void as well. Any access to Highway 20 will likely be by frontage roads, with no direct access to Highway 20. Alternate access to the property may be provided via English Mill Road. Access to Highway 20 will be controlled by the IDOT and the City. The subject property was not identified as growth areas on the 1995 Comprehensive Plan. However, growth areas were characterized as vacant, developable land that can be served by City utilities. The Comprehensive Plan anticipated that the identified growth areas might not be the only areas for future growth, and includes goals regarding annexation and rezoning of land for residential and commercial uses. The property was identified in the 1998 Annexation Study as a Priority 2: Benefitted Area. Benefitted Areas were recommended for annexation because they benefit from extension of City infrastructure. In this case, the extension of a water main along Highway 20 and a sanitary sewer interceptor along the South Fork of Catfish Creek benefit this property. In addition, this property was evaluated as a possible industrial park site in the 1997 Industrial Park Development Feasibility Study. It was dropped from consideration in favor of the 900 acres that the City purchased at the County Farm, along Cousins Road and along Highway 61/151. Staff recommends that the City Council approve the annexation request. The proposal provides the City with additional land for growth, and with the ability to control that growth through City regulations. An application, map, resolution and staff report are attached for City Council review and approval. DISCUSSION Mr. and Mrs. Siegert are asking to annex their 222 acre farm in conjunction with rezoning for a future commercial and residential development. A 10-acre site on English Mill Road, where their home and farm buildings are located, is not part of this annexation request. The Siegerts do not have any development plans at this time. The Siegerts have requested C-3 General Commercial zoning for 99.5 acres, R-3 Moderate Density Multi-Family Residential for 6.5 acres, and R-1 Single-Family Residential for the remaining 116 acres. The Zoning Advisory Commission recommended approval of this rezoning request, with conditions, after a public hearing on May 3, 2000. The annexation request meets the State requirements of a minimum of 50 feet of adjacency. Since the property lies more than two miles from the corporate limits of another city, the City Council can approve the annexation. IOWA fEES rjJ 4/& City Hall. 50 W. 13th Street Telephone: 589-4210 RESOLUTION NO. 239-00 RESOLUTION ANNEXING CERTAIN PROPERTY Whereas, Gerald and Judith Siegert, property owners, have voluntarily petitioned for annexation of approximately 222 acres of property lying outside of the corporate limits of the City of Dubuque, Iowa, as shown in Exhibit A; and Whereas, Chapter 368 of the Code of Iowa authorizes the extension of City limits in situations of this character by adoption of a resolution after notification as required by State regulations; and Whereas, this request has been found to be consistent with the Comprehensive Plan and the Future Land Use Map of the Comprehensive Plan; and Whereas, the future growth and development of the City of Dubuque, Iowa, make it desirable that said property be made part of the City of Dubuque, Iowa. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF DUBUQUE, IOWA: Section 1. That the territorial limits of Dubuque, Iowa, be, and they hereby are extended to include the property legally described as shown in Exhibit A. Section 2. The territory hereby annexed shall become a part of the Third Precinct of the First Ward of the City of Dubuque, Iowa. Section 3. That the City Clerk shall file this resolution, all exhibits and the petition for voluntary annexation with the State of Iowa in accordance with State regulations.
