Dear Mr. McCann:
I am writing on behalf of the City of Dubuque regarding Dubuque's voluntary
annexation of approximately 704.5 acres. Please transmit this request to the
Chairperson and members of the City Development Board for consideration at the
Board's next meeting. Ten copies of this correspondence are enclosed.
On May 13, 2004, the Board approved the annexation of this territory to Dubuque, upon
condition that the City of Dubuque make every reasonable effort to secure an
agreement with the City of Asbury and the owners of Parcel 13-j, Parcel 13-k, Parcel
13-1, Parcel 13-m, Parcel 1 , and that part of Parcel 2 lying north of Asbury Road to
provide for severance of those parcels from Dubuque and the annexation of those
parcels into Asbury. The Board also required that no later than October 4, 2004, the
City of Dubuque would report to the Board on the status of Dubuque's efforts to secure
an agreement providing for the severance of the parcels from Dubuque and their
annexation to Asbury.
The City of Dubuque filed a Status Report with the Board for consideration at the
October 14th meeting. At that meeting, the Board voted to accept this report as the City
of Dubuque's compliance with the Board's directive.
The City of Dubuque stands ready to proceed with the pending severance requests for
Parcel 13-j, Parcel 13-k, Parcel 13-1, and Parcel 13-m from Dubuque and the voluntary
annexation of these parcels to Asbury; however, Dubuque is unable to do so because of
the appeal filed by Asbury.
Contrary to the assertion by Asbury, the severance request of the Board was directory
and not mandatory, and certainly not a condition to approval of the annexation. The
Board clearly indicated that the owners of these parcels had the freedom to choose to
sever from or annex to Dubuque.
