Duggan and Members of the City Council C" 0' DATE: February 17, 2005 RE: Claim Against the City of Dubuque by Ken Kieffer Claimant Date of Claim Date of Loss Nature of Claim Ken Kieffer 02/10/05 12/16/04 Property Damage This is a claim in which the claimant alleges that the basement of his home located at 1577 Geraldine Drive was flooded due to concrete debris blocking his sewer lateral. According to the report of John Klostermann, Street & Sewer Maintenance Supervisor, records show that the Operations and Maintenance Department was notified of a possible sewer problem at 11 :30 on December 16, 2004. When the crew arrived, they found that the City's main line was not plugged but found some concrete debris located in front of the lateral connection that serves claimant's home. The debris was removed and service restored. Mr. Klostermann reports that Operations & Maintenance records indicate no history of problems with this sewer line and therefore recommends denial of this claim due to the lack of prior knowledge. Our records show that we were notified of a possible sewer problem at 11 :30 a.m. on December 16, 2004. When the crew arrived, they found that our main line was not plugged but found some concrete debris located in front of the lateral connection that serves Mr. Kieffer's home. The debris was removed and service restored in a timely manor. Our records show that we do not have a history of problems with this line. It is therefore my recommendation to deny the claim due to the lack of prior knowledge.
