SUBJECT: Sale of City Lot 1, Clark's Sub 2, (966 Liberty Street)
A request has been received from Roger and Ann Pickel to purchase Lot 1, Clark's Sub
2 (966 Liberty Street), which lot is located adjacent to their property. Finance Director
Ken TeKippe states that the City has no plans for the utilization of said property, except
for reserving the utility and access easements as noted, and recommends sale of the
property for a purchase price of $2,500, plus publication and filing fees. It is further
recommended that a public hearing be set for March 7, 2005.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
Roger and Ann Pickel, 944 Liberty St. have requested the purchase of Lot 1, Clark's
Sub 2, (966 Liberty St.). The lot is located adjacent to their property on a dead end cul-
de-sac. A copy of the Pickel's letter requesting the purchase is attached.
DISCUSSION
The attached vicinity map shows the proposed area to be disposed of. In June 1998,
the City of Dubuque undertook demolition of structures and removal of construction
materials, debris, trees and brush from property that was obtained via a forfeiture
proceeding by the U.S. Attorney's office. The abutting property is owned by Roger and
Ann Pickel. The existing parcel is not a city street or alley that needs to be vacated.
The Pickel's have maintained the property for several years. The appraisal of the
property was $10,000 less the cost to remove foundations (unknown amount). In
addition, the purchaser would need to incur expense to cap wells if they plan to
construct a home.
I have visited with the other adjoining property owners, Stonehill Care and John and
Betty Fitz who are not interested in the property, except for access easement along
easterly 20 feet of said lot.
RECOMMENDATION
The City has no plans for the utilization of Lot 1, Clark's Sub 2, (966 Liberty St.) to be
disposed of except for reserving the utility and access easements as noted.
I would recommend that a public hearing be set for the disposition of the City's interest
in Lot 1, Clark's Sub 2, (966 Liberty St.) on February 21, 2005. I would further
recommend that the purchase price be established at $2,500, plus publication and filing
fees.
ACTION TO BE TAKEN
The recommendation of the City Manager should be approved and a public hearing
should be scheduled on the sale of the property by adoption of the enclosed resolution.

RESOLUTION OF INTENT TO DISPOSE OF CITY INTEREST IN LOT 1
CLARK'S SUB 2 IN THE CITY OF DUBUQUE, IOWA (966 LIBERTY ST.)
Whereas, the City of Dubuque is the owner of Lot 1 Clark's Sub 2 in the City of
Dubuque, Iowa (966 Liberty St.) (the Property): and
Whereas, Roger and Ann Pickel have requested to purchase the Property; and
Whereas, the City Council of the City of Dubuque, Iowa has tentatively determined
that the property is no longer required for public use, and that the sale of the property
should be approved.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. The City Council of the City of Dubuque intends to dispose of its
interest in Lot 1 Clark's Sub 2 in the City of Dubuque, Iowa (966 Liberty St.), reserving
easements of record.
Section 2. The conveyance of Lot 1 Clark's Sub 2 in the City of Dubuque, Iowa
(966 Liberty St.), subject to easements of record, to Roger and Ann Pickel be contingent
upon the payment ,of $2,500, plus publication and filing fees.
Section 3. The City Clerk is hereby authorized and directed to cause this
Resolution and a notice to be published as prescribed by Iowa Code Section 364.7 of a
public hearing on the City's intent to dispose of the foregoing-described real property, to
be held on the 7th day of March ,2005, at 6:30 o'clock p.m. at the public library
auditorium, 11th & Locust, Dubuque, Iowa.
Passed, approved and adopted this 21st day of Februarv, 2005.

Dear Mr. TeKippe:
I am writing in response to your letter dated January 13th, 2005, requesting that we submit a written offer for the possible
acquisition of the lot located at 966 Liberty St - Lot 1, Clark's Sub 2. We are submitting a written offer, but first, I would like to
address a couple of the issues raised in your letter.
First, we do understand that the City has incurred expenses due to the cleanup of this property and the installation of a cul-de.
sac. We feel both, however, were overdue. We greatly appreciate the difficulty as well as the great effort and follow-up that
went into cleaning up the Sharkey property. But we were witnesses to the massive and continual buildup of junk over the
years when we know that we and other neighbors were calling to complain and it appeared that little follow-up was done by the
City to address or fix this problem. We feel this probably greatly Increased the cleanup costs. And we feel that the installation
of the cul.de-sac was necessary, due to the fact that without it, the City garbage, recycling and salt trucks have for years had to
back down the street until they reached an empty driveway in which to turn around.
Second, you mentioned in your letter to us that "you have maintained the property for a number of years similar to other
citizens who maintain platted alleys and the area between property lines and streets." What we did to improve this property
over the past 5 to 6 years amounted to much more than "maintenance". This property was a mess of weeds, broken glass,
rocks and other debris that had worked through the soil from what they ended up burying here after everything of Sharkey's
was torn down. It took years of cleaning, weeding, seeding and mowing this property to get this land to what it is today. We
don't feel this was simply "maintenance". It cost us time and money and hard work, not to mention saving the City some costs
by not having to send a maintenance crew to this property the past 5 or 6 years.
Lastly, you mentioned that the appraised value of the property was $10,000 . minus the cost to remove the foundation
(unknown). I talked to people from three separate excavating companies (Mark Fondell from Fondell Excavating, Mike Besler
from McClain Excavating and Dave Fondell from Dubuque Excavating) and they all gave me roughly the same information. The
average cost to dig a foundation runs about $5,000. and by what we described as being buried on this property, they believed
the costs of running into such issues could double or even triple the cost of digging a foundation. This could easily make the
feasibility of building on this property too costly for many people. And probably especially in this area of town which is not
exactly a high growth or high property value area. We have no such intention to build so (hopefully), will never run into the
costs of having to clean up what is buried on this property.
In light of the above.mentioned circumstances. we VJould like to extend an offer of $2,500 for the purchase of this property,
plus the recording and filing costs you mentioned of about $100.
