Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited
request. The application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request reviewing the proposed rezoning to facilitate
relocation of his used car lot.
Staff reviewed surrounding zoning and land use.
There was one public comment regarding the impact of a used car lot on adjacent
property and existing shortage of on-street parking.
The Zoning Advisory Commission discussed the request, noting that conditions have
not significantly changed in the neighborhood to warrant rezoning.
Recommendation
By a vote of 6 to 0, the Zoning Advisory Commission recommends that the City Council
deny the request.
A simple majority vote is needed to concur with the recommendation for denial. A super
majority vote is needed for the City Council to approve the request.

AN ORDINANCE AMENDING APPENDIX A (THE ZONING ORDINANCE) OF THE CITY
OF DUBUQUE CODE OF ORDINANCES BY RECLASSIFYING HEREINAFTER
DESCRIBED PROPERTY lOCATED AT 1960 WHITE STREET FROM R-3 MODERATE
DENSITY MULTI-FAMilY RESIDENTIAL DISTRICT TO C-4 DOWNTOWN
COMMERCIAL DISTRICT
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCil OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Appendix A (The Zoning Ordinance) ofthe City of Dubuque Code of
Ordinances is hereby amended by reclassifying the hereinafler-described property from R-3
Moderate Density Multi-family Residential District to C-4 Downtown Commercial District to wit:
The south 45 feet of the north Yo of the middle 1/5 of City lot 488, the south 45 feet
of the south Yo of the north middle 1/5 of City lot 488, the north % of the north
middle 1/5 of City lot 488 and the south 1 foot 2 inches of the north 1/5 of City lot
488, and to the centerline of the adjoining public right-of-way, all in the City of
Dubuque, Iowa.
Section 2. The foregoing amendment has heretofore been reviewed by the Zoning
Advisory Commission of the City of Dubuque, Iowa.
Section 3. This ordinance shall take effect immediately upon publication, as provided by
law.

Property History: The property has served as a residential lot since the original house
was built in 1900.
Physical Characteristics: The lot to be rezoned, when consolidated with the existing lot
at the corner of 20th and White Streets, will be 5,124 square feet in area. The lot will
have 40 feet of frontage along White Street and 100 feet of frontage along 20th Street.
The lot has 65 feet of adjacency along the alley that affords the only vehicular access.
The lot is level.
Concurrence with Comprehensive Plan: Goal 2.3 of the Land Use Element states,
"To provide opportunities for neighborhood commercial centers, to assure compatibility
with residential property." Goal 6.2 of the Land Use Element states, "To buffer and
protect incompatible uses from each other."
Impact of Request on:
Utilities: Existing utilities are adequate to serve the site.
Traffic Patterns/Counts: 2001 Iowa Department of Transportation average daily
traffic counts indicate 8,700 vehicle trips per day on White Street just north of the
subject property and 7,300 vehicle trips per day on 20th Street just east of the
subject property.
Public Services: Existing public services are adequate to serve the site.
Environment: Staff does not anticipate any adverse impact to the environment
during the proposed development of this lot.

SECTION 3. DISTRICT REGULATIONS
3-3. Commercial District.
3-3.4. C-4 Downtown Commercial District.
(A) General purpose and description. The C-4 District is intended to accommodate the older
commercial areas of the city by permitting a large variety of unrelated uses that developed
prior to effective planning techniques. Such uses are characterized by older structures,
deficient traffic and parking patterns, and little open space or green area. The regulations for
this District are designed too encourage the maintenance of existing uses and the private
reinvestment and redevelopment of new commercial uses by providing a wide variety of uses
and liberalize bulk, yard and parking requirements. The C-4 District is not intended to have
any application in undeveloped or newly developing areas of the City.
(B) Principal permitted uses. The following uses shall be permitted in the C-4 District.
(I) Churches, convents, and monasteries-[7].
(2) Public and private/parochial schools approved by Iowa State Board of Public Instruction
(K-12)-[IO].
(3) Public or private parks, golf courses, or similar natural recreation areas-[47].
(4) Railroads and public or quasi-public utilities including substations-[47].
(5) Residential uses above the first floor only-[6].
(6) Housing for the elderly and persons with disabilities (not identified with (5) above)-[3].
(7) Mortuaries/funeral home-[I2].
(8) NoncQmmercial art galleries-[13].
(9) Museum/libraries-[I3].
(10) Schools of private instruction-[ 4].
(II) Private clubs-[20].
(12) General offices-[l4].
(13) Medical office/clinic-[36].

(D) Conditional uses. The following conditional uses are permitted in the C-4 District, subject to
the provisions of Section 5 of this Ordinance and are the minimum requirements for
application to the Board of Adjustment for a conditional use permit:
(I) Drive'-inlcarry-out restaurant, provided that:

(2) Drive-up automated bank teller, provided that: _
