The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request.
The application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request, reviewing the proposed text amendment to
the Institutional District.
Staff reviewed the request, noting that allowing stand-alone drug stores in an institutional
district is consistent with medical campuses, and each request will still be reviewed by
the Commission and City council as part of an amendment to a campus plan.
There were no public comments.
The Zoning Advisory Commission discussed the request, noting that the requested
change is consistent with the purpose and intent of medical institutions and would help
provide necessary services to the campus and surrounding community.
Recommendation
Bya vote of 6 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request.
A simple majority vote is needed for the City Council to approve the request.

ORDINANCE NO. 4-05
AN ORDINANCE AMENDING APPENDIX A (THE ZONING ORDINANCE) OF THE
CITY OF DUBUQUE CODE OF ORDINANCES BY ADDING DRUG STORES AS A
PERMITTED USE IN THE 10 INSTITUTIONAL DISTRICT.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCil OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Section 3-5.2(B)(1) of the Code of Ordinances is hereby amended by
adding drug stores as a permitted use in the 10 Institutional District as follows:
Additional Principal Permitted Uses for Medical Institutions. In addition to the
principal permitted uses listed above, the following additional principal uses shall
be permitted for medical institutions, but only in accordance with the limitations of
3-5.2(E) of this section.
(1) Facilities and operations for the diagnosis, care and treatment of human
health disorders, including examination or operating rooms, physical therapy
or x-ray facilities, psychiatric treatment, convalescent care, and similar

separate doctors' clinics, drugstores, or other medical facilities not owned or
operated by the principal institution, but only where such facilities are
functionally related to the institution and are included within the original
institutional district boundaries or the approved preliminary development
plan, as provided in 3-5.2(E) of this section - [36].
Section 2. The foregoing amendment has heretofore been reviewed by the Zoning
Advisory Commission of the City of Dubuque, Iowa.
Section 3. This ordinance shall take effect immediately upon publication, as provided
bylaw.

SUBJECT: Amendment to the ID Institutional District to Allow Stand-Alone Drug Store
as a permitted use.
INTRODUCTION
The requested text amendment to the ID Institutional District would allow stand-alone
drug stores to operate within a medical institutional district. The City of Dubuque has
two medical institutional districts - The Finely Hospital and Mercy Medical Center.
Medical Associates Clinic is zoned as a PUD Planned Unit Development District.
DISCUSSION
The current institutional district regulations only allow a pharmacy as an accessory use
to a medical institution and located entirely within a principal building. This regulation
has been on the books since 1985.
The institutional district does; however, allow separate doctors' clinics or other medical
facilities not owned or operated by the principal institution, but only where such facilities
are functionally related to the institution. The addition of drug stores as a permitted use
would still be functionally related to the medical institution. Planning staff believes there
are adequate safeguards established within the institutional district to protect
surrounding property from any negative impacts associated with the operation of a drug
store. The institutional district requires that an application be submitted to the City prior
to district expansion or the expansion of any new or existing structures within an
established ID District. Thus, before a drug store could be constructed within a medical
institutional district, the Zoning Advisory Commission and City Council would review the
request as part of a public hearing.
RECOMMENDATION
Planning staff recommends that the Zoning Advisory Commission review the enclosed
information and make a recommendation to the City Council regarding the proposed
text amendment to allow stand-alone drug stores within medical institutional districts.
