INTRODUCTION
The purpose ofthis memo is to recommend that the City waive its JAIBG grant
allocation of $12,630 and allow that funding to go to the Dubuque Decat project.
BACKGROUND
The City of Dubuque received notice that our allocation for the JAIBG grant is $12,630.
In order to receive that grant, we would be required to submit a plan for using the funds
in one or more ofthe 12 different purpose areas allowed under the grant.
The County receives an allocation of approximately $6,000, and the Dubuque Decat
Project coordinated by DHS receives about $60,000.
Last year, the City and County signed a waiver, which allowed their respective funding to
go to the Decat project. Most of the funding last year was used to "purchase" 4 beds for
juvenile detention at the Northeast Iowa Detention facility in Waterloo. That assures
Dubuque County of having access to at least that many beds as needed for detention.
DISCUSSION
The Decat planning committee is again planning programs for their JAIBG money. The
programs will include a Victim Restitution program, truancy prevention, after school
programming at two schools, funding for Four Mounds programs for youths in need,
substance abuse testing for juveniles in the Four Oaks program, and a program
specifically designed for prevention and treatment of delinquency in juvenile females.
All these programs fit within the allowed purpose areas.

The County plans to again assign their claim to funding to the Decat project. Having the
programs planned and monitored at a single point is more efficient that having each of us
set up the required planning committee, write a plan, and initiate a new program.
RECOMMENDATION
I recommend that the City of Dubuque assign its allocation to the Dubuque Decat Project.

Dear Mayor Duggan:
This letter initiates the process to award the second year funding for the JAIBG program to qualifying units of
local government for fiscal year 2001. The goal of JAIBG is to reduce juvenile delinquency, improve the
juvenile justice system, and increase accountability for juvenile offenders. The Division of Criminal and
Juvenile Justice Planning (CJJP) is the designated state agency for the program. I am writing to provide you
with specific information concerning the funding requirements and process for awarding JAIBG allocations to
eligible units of local government. This is not a competitive grant process. You qualify, and if you choose to
participate by complying with the requirements outlined in this packet of information, the City of Dubuque will
receive the funds.
The City of Dubuque has qualified for a direct allocation in the amount of$12,630. The amount was calculated
from a formula specified in the JAIBG Guidance Manual using the most recent reported law enforcement
expenditures and part 1 violent crime data. This amount may be increased if any funds from the current year's
projects are not expended. CJJP Will notify you in writing if there is an increase of allocations. Of the
allocation, 10% may be~eli for administrative costsassociated with JAIBG. The following components are
necessary pieces of the JAIBG application.
The application includes the following instructions and forms that need to be completed to receive the
allocation:
· Intent Form - Due date: June 9, 2000, even if the plan is not submitted on that date. See below.
· Juvenile Crime Enforcement Coalition membership list
· Coordinated Enforcement Plan for Reducing Juvenile Crime
· Assurance/Certification of purpose area distribution of funds
Applicants seeking to initiate programming by July 1, 2000 must submit the JAlBG Plan by June 9, 2000
at 4:30 p.m. Applicants desiring a later start date must submit the Plan at least three weeks prior to the
proposed start date. The latest date for application submission is September 8, 2000, to allow for a start
date of October 1, 2000. Regardless of the start date, the project period will end on JUNE 30, 2001. All
monies must be spent by June 30, 2001.

Enclosed, along with the application, is a listing of the qualifying cities and counties and their JAmG
allocation. To qualify, the allocation to the unit of local government must exceed $5,000. In addition, the local
decategorization project governance boards will be receiving allocations.
Since the local decategorization project governance board will also be planning for their allocation, you are
encouraged to consult with them. The decategorization coordinator for your area is Sue Davison, telephone
number 319-557-8251. The decategorization projects are working to develop a comprehensive plan for youth
development and juvenile justice. The coordination of JAmG with this effort would assist in the development
of the comprehensive plan.

For Qualifying Units of Local Government
Overview
The State of Iowa has received a second year of a federal block grant from the Office of Juvenile
Justice and Delinquency Prevention (OJJDP) in the amount of $2,898,200, to develop programs that
promote greater accountability in the juvenile justice system. The goals of the program are to reduce
juvenile delinquency, improve the juvenile justice system, and increase accountability for juvenile
offenders. Again, the funds must be spent in one or more of twelve program purpose areas (see
below). The Division of Criminal and Juvenile Justice Planning (CJJP) continues to be the state
designated agency to receive the federal funds. This application is not a competitive grant process.
Units oflocal government qualify, based on a formula (described in Distribution of Funds), and may
participate by complying with the requirements outlined in this application. To receive the amount
determined by the mandated formula, the application instructions must be followed.
Funds Must be Spent in One or More of these Twelve Prol!:ram Purpose Areas
Purpose area 1: Building, expanding, renovating, or operating temporary or permanent juvenile
correction or detention facilities, including training of correctional personnel.
Purpose Area 2: Developing and administering accountability-based sanctions for juvenile offenders.
Purpose area 3: Hiring additional juvenile judges, probation officers, and court-appointed defenders,
and funding pre-trial services for juveniles, to ensure the smooth and expeditious administration of the
juvenile justice system;
Purpose area 4: Hiring additional prosecutors, so that more cases involving violent juvenile offenders
can be prosecuted and backlogs reduced;
Purpose area 5: Providing funding to enable prosecutors to address drug, gang, and youth violence
problems more effectively;
Purpose area 6: Providing funding for technology, equipment, and training to assist prosecutors in
identifying and expediting the prosecution of violent juvenile offenders;
Purpose area 7: Providing funding to enable juvenile courts and juvenile probation offices to be more

Purpose area 8: The establishment of court-based juvenile justice programs that target young firearm
offenders through the establishment of juvenile gun courts for the adjudication and prosecution of
juvenile firearms offenders;
Purpose area 9: The establishment of drug court programs for juveniles so as to provide continuing
judicial supervision over juvenile offenders with substance abuse problems and to provide the
integrated administration of other sanctions and services;
Purpose area 10: Establishing and maintaining interagency information-sharing programs that enable
the juvenile and criminal justice system, schools, and social services agencies to make more informed
decisions regarding the early identification, control, supervision, and treatment of juveniles who
repeatedly commit serious delinquent or criminal acts;
Purpose area 11: Establishing and maintaining accountability-based programs that work with
juvenile offenders who are referred by law enforcement agencies, or which are designed, in
cooperation with law enforcement officials, to protect students and school personnel from drug, gang,
and youth violence; and,
Purpose area 12: Implementing a policy of controlled substance testing for appropriate categories of
juveniles within the juvenile justice system.
Distribution of Funds
JAIBG guidelines specify that a percentage of the funds will pass-through directly to units of local
government (cities and counties). In Iowa, state government has 73% ofthe financial burden for the
administration of juvenile justice. Based on the financial analysis demonstrating the financial burden,
OJJDP has approved for 27% of the funds to be distributed to units oflocal government. The
distributions to units of local government are based on a formula of the combination of law
enforcement expenditures and the annual number of Uniform Crime Report part I violent crimes
reported by each unit oflocal government for the most recent year for which data are available. Units
oflocal government whose allocations are at least $5,000 qualify for a direct allocation. A total of 28
units of local government qualify. Approximately $500,000 will be distributed to the 28 units of local
government.
Use of Funds
Grant funds available under the Juvenile Accountability Incentive Block Grant Program may be used
to support all budget categories identified in the budget page forms provided in this document. Eight
primary budget categories are allowed, including salaries, personal benefits, contract services, travel,
training and tuition, equipment, supplies and operating expenses, and other expenses. All lAIBG
funds must be expended for programs within the 12 authorized Purpose Areas. Questionable costs or
costs not addressed clearly via these cost categories should be gauged against the following cost
restrictions to determine whether they are acceptable:
a. Grant funds cannot be used to supplant other federal, state, or local funds supporting existing
programs or activities.
b. Grant funds cannot be expended for the payment of real estate mortgages or taxes; dues to
organizations or federatiop.s; costs for social activities not related to the purpose of this program;
costs related to political activity; interest costs; fines, penalties, law suits, or legal fees;
contingencies such as pending litigation, possible liabilities, et~,; and~tributions and donations;
c. Grant funds cannot be used for the purchase of fixed assets such as automobiles, computer
equipment, or fixtures unless such purchases have been specifically approved by CJJP during or
after the contract negotiation period of this grant award process.
d. Grant funds cannot be used for out of state travel unless such travel has been specifically approved
by CJJP during or after the contract negotiation period of this grant award process.
e. Up to 10% of the allocation may be used as administrative costs.

Grant funds may be used to support only those specific cost items specified and agreed to in a
contract between CJJP and the applicant. All of the above-listed cost restrictions apply to any
agreements or contracts between the applicant and other entities whose activities or services are to be
supported with grant funds from these programs.
Note: Construction Costs. If, under Purpose Area 1, a unit of local government or regional
coalition uses funds to construct a permanent juvenile corrections facility, the unit of local
government or regional coalition must provide at least 50% of the total cost of the project.
State Plan
Consistent with the Congressional intent that these funds be responsive to the particular needs of local
communities, the following approach has been developed with input from the chief juvenile court
officers, decategorization coordinators, Iowa League of Cities, Iowa State Association of Counties
(ISAC), Iowa Association of Sheriffs and Deputies, and the Iowa Association of Chiefs of Police.
. Approximately $1,850,000 will be allocated to the 39 Decategorization (decat) governing boards
and to Ida County. The decat governing boards shall submit plans to CJJP for approval and for
authorization of allocations. The allocations to the decats will be based on the formula of child
population ages 5-17, as used for DHS delinquency funds, and must be expended in one or more of
the 12 program purpose areas. The decat governance boards shall invite representatives from law
enforcement, county attorney's office, and city government within their decat area to participate in
the planning for the JAIBG funds, in addition to the required juvenile court, Department of Human
Services, and county representatives. The JAIBG plans will become part of the respective annual
decat plan.
The decats have the option to combine funds with a unit of local government or another decat and
develop one JAlBG plan.
· Approximately $250,000 of the funds will be available through a request for application (RF A)
process, specifically for drug courts.
Time Frames for Application
Applicants seeking to initiate programming by July I, 2000 must submit the complete application and
required attachments must be received by 4:30 p.m. on June 9, 2000. Applicants desiring a later start
date must submit the Plan at least three weeks prior to the proposed start date. The latest date for
application submission is September 8, 2000, to allow for a start date no sooner than October I, 2000.
Regardless of the start date, the project period wilIend on JUNE 30, 2001. All monies must be spent
. by June 30, 2001: dw needS the original application with an original signature, tI1.erefore, no-fax ore-
mail copies are able to be accepted at this time. All applicants must submit the INTENT OF
QUALIFYING UNIT OF LOCAL GOVERNMENT form (see Section I and page 9) by June 9,
2000.

Application Requirements
I. Intent Form - Pal!e 9
All qualifying cities and counties must decide on one of four options regarding the way JAlBG funds
are allocated:
1. Accept a Direct Allocation. To accept and receive a reimbursable allocation, qualifying units of
local government must complete and submit an application by the deadline. See Section II, III, and
"IV for specific application requirements.
2. *Waiver of Allocation. To waive a direct allocation and request another qualifying unit of local
government or decategorization governance board to receive the allocation, a Statement of
Agreement (page 10) must be completed, signed by both entities, and attached to the Plan of the
qualified entity to receive the allocation.
3. * Acceptance of a Waived Allocation. In addition to accepting your allocation, to accept a waived
allocation from another qualifying unit of local government, a Statement of Agreement (page 10)
must be completed, signed by both entities, and attached to the Plan. The Statement of Agreement
requires that the entity that is waiving the funds participated in the development of the Plan.
4. Decline. To decline to participate in the Juvenile Accountability Incentive Block Grant Program, a
. qualifying unit oflocal government declines to submit a Plan. The State would reallocate the funds
. among all participating eligible applicants, or would otherwise distribute the allocation(s) for the
development of services that have a statewide impact.
*Qualified units of local government may waive funds to another qualified unit of local government or
a decategorization governance board. The qualified units of local government are listed with their
estimated allocations in Attachment C.
The attached Intent Form must be completed and submitted by June 9, 2000.

In the effort to craft one coordinate local plans, qualifying units of local government will be
expected to take advantage of the existing community planning initiatives completed by relevant,
multi-agency or community-wide planning groups, including but not limited to decategorization

governance boards, comprehensive strategy planning teams, empowerment area boards,
S.A.F.E. coalitions, substance abuse prevention block grant planning groups, workforce
development act youth councils, public health assessment teams, SUCCESS 4, community
planning boards, etc.).
IV. Criteria for the Coordinated Enforcement Plan To Reduce Juvenile Crime
All coordinated enforcement plans to reduce juvenile crime must address one or more of the twelve
JAIBG purpose areas. There is no page minimum or maximum. Use as many pages as necessary to
describe the plan in the following format:

b. Need for the program
A description of the current situation and needs assessment.
Provide data to identifY the scope of the existing juvenile crime problem.
IdentifY the purpose area(s) that will be addressed (See description of purpose areas).

d. Evaluation methodology
How will the effectiveness be measured?

Complete the attached matrix. Additional pages may be added. (An example is also attached.)

The budget items must be tied to the activities in the narrative. Follow the instructions in
attachment B. If the budget exceeds the JAIBG allocation, show the source(s) of additional
funds. All funds must be expended for programs within the 12 authorized JAIBG Purpose
Areas.
Certifications and Assurances
Federal guidelines require the following certifications and/or assurances from each ofthe qualifying
units oflocal government. These requirements give units oflocal government a choice. Please refer to
the accompanying forms.
· Either assure that not less than 45% is allocated for JAIBG purpose areas 3 through 9, and not less
than 35% is allocated for JAIBG purpose areas 1,2, and 10; OR certifY that the interests of public
safety and juvenile crime 'control would be better served by expending JAIBG funds in a

V. Administrative Issues
Waiver of deficiencies
The division reserves the right to waive minor deficiencies in a proposal. The decision as to whether a
deficiency will be waived or will require the rejection of an application will be solely within the
discretion of the division. Failure to comply with or respond to any part of this application may result
in the rejection of an application.
Contract aereement
All applicants will be notified in writing of the program's funding decisions and whether CJJP is
offering a contract regarding their application. CJJP reserves the right to fund all, part of or none of
the application.
Redistribution of funds
CJJP reserves the right to recapture and redistribute funds based upon projected expenditures, if it
appears that funds will not be expended by a sub grantee according to the conditions of their contract.
Amendments
The division reserves the right to modifY this application at any time. In the event the division amends,
adds to, or deletes any portion of the application, an amendment will be provided to all applicants who
received the original application.
CODvriehts
By submitting an application, the applicant agrees that the division may copy the application for
purposes offacilitating the evaluation of the application or to respond to a request for public records.
The applicant consents to such copying by submitting an application and warrants that any copying
will not violate the rights of any third party.
Cost of ADDlication
The division is not responsible for any costs incurred by an applicant which are related to the
preparation or delivery of an application or any other activities carried out by an applicant related to
this application.
ProDertv of the Division
All applications become property of the division.
Public Records
All information submitted by'an applicant may be treated as a public record by the division unless the
. applicant properly requests that the information be treated as confidentiaI-informationat the-time then -
application is submitted. Public records will be copied as necessary to comply with Iowa's public
record law. By submitting an application the applicant grants the divison the right to make the
required copies of the application. Any request for confidential treatment of information must
enumerate the specific grounds in Iowa Code chapter 22 which support treatment of the material as
confidential.
Reiection of ADDlications
At any time prior to the execution of a written contract, the division reserves the right to reject any or
all applications received by reason of this request for applications, in whole or in part, for any reason.
Issuance of this application in no way constitutes a commitment by the division to award a contract.

Release of Claims
With the submission of an application, each applicant agrees that it will not bring any claim or have
any cause of action against the division or the State of Iowa based on any misunderstanding concerning
the information provided herein or based on the division's failure to provide the applicant with
information.
Restrictions on Gifts and Activities
Iowa Code chapter 68B contains laws which restrict gifts which may be given or received by stated
employees and requires certain individuals to disclose information concerning their activities with state
government. Applicants are responsible for determining the applicability of this chapter to their
activities and are responsible for compiying with these requirements.
Appeals
Applicants have the right to appeal the funding decisions based upon a showing that the rules and
procedures governing the grant selection process have not been properly applied. The appeal process
begins on the postmarked date of the written notification to the applicant of the CJJP's decision.
Appeals should be in writing and filed with the Administrator of CJJP within ten calendar days of the
date of written notification of funding decisions to the applicant. It is the responsibility of the
applicant to assure that appeals are received by 4:30 p.m. on or before the tenth day of the appeals
process. Appeals received after 4:30 p.m. on the tenth day will not be reviewed.

Certification of Distribution of JAIBG Funds within the Purnose Areas
Qualifying units oflocal government (cities/counties) receiving lAIBG funds from the State must
provide an assurance that, other than funds set aside for administration (up to 10%), not less than 45%
is allocated for lAIBG Purpose Areas 3 through 9, and not less than 35% is allocated for program
purpose areas 1,2, and 10 (see the attached 12 lAIBG purpose areas). This allocation is required
unless the unit of local government certifies to the State that the interests of public safety and juvenile
crime control would be better served by expending its funds in a proportion other than 45 and 35
percent minimums. Such certification shall provide information concerning the availability of existing
structures or initiatives within the intended areas of expenditure (or the availability of alternative
funding sources for those areas), and the reasons for the unit of local government's alternative use. All
program funds must be expended for programs within the 12 authorized lAIBG purpose areas.

ASSURANCES
A. ASSURANCES OF COMPLIANCE WITH CIVIL RIGHTS ACT OF 1964
No person shall, on the grounds ofrace, creed, color, national origin, gender or sexual orientation be
excluded from participation in, be refused the benefits of, or be otherwise subjected to discrimination
under agency grants awarded pursuant to P.L. 93-415 or any project or program supported by such
grants. Subgrantees must comply with the provisions and requirements of Title VI of the Civil Rights
Act of 1964 and regulations issued by the Department of Justice thereunder as a condition of award of
federal funds and continued grant support.
B. THE HATCH ACT
Federal law prohibits certain partisan political activity by an officer or employee of the State or local
agency if his/her principal employment is in connection with an activity which is financed in whole or
part by loans or grants made by the United States or a Federal Agency. The law is enforced by the
United States Civil Services Commission.
C. PROCUREMENT OF SPECIAL EQUIPMENT
The Division of Criminal and Juvenile Justice Planning expects that the subgrantees will procure such
special equipment being purchased in whole or in part with grant funds by that method, authorized by
state law or local ordinance, which results in the lowest price of goods of the kinds or type required.
D. NATIONAL HISTORIC PRESERVATION ACT OF 1966
This project application either will not have an effect on a site listed on the National Register of
Historic Places or the applicant has notified the Division of Criminal and Juvenile Justice Planning that
such a site is or will be involved.
E. APPLICABILITY OF STATE AND FEDERAL POLICIES
All conditions, rules and regulations of federal and state governments which relate to the
administration of public funds and financial accounting shall apply to subgrantees and contractors of
the Division of Criminal and Juvenile Justice Planning.
F. NON-SUPPLANTING REQUIREMENT
Federal and state funds made available through this program may not be used to supplant federal, state
. imd local funds that would have been available in the absence oflliisprogram's aid. In complying
with this requirement, the Division of Criminal and Juvenile Justice Planning will rely on written
certification by State agencies and local government units to the effect that program funds have not
been used in place of other federal, state and local funds.
G. REPORTS
The subgrantee shall submit quarterly financial reports and quarterly progress reports indicating
activities undertaken, expenditures, and general progress of the project for which the subgrant was
awarded. In addition to the above reports, a final report (using the same report forms: dealing with the
evaluation of the entire project will be needed. This will include data needed to verify the success or
failure of the project and a statement as to the effectiveness of the project.

H. BUILDING ACCESSIBILITY AND USE BY PEOPLE WITH DISABILITIES
Any construction, design or alteration of a building or facility which will be used by the public or
which may result in the employment or residence of people with disabilities must comply with the
regulations issued by Federal Agencies, including the Department of Justice, under the Americans with
Disabilities Act of 1990.
1. AMENDMENTS TO THE APPLICATION
The division reserves the right to modify this application at any time. In the event the division amends,
adds to, or deletes any portion of the application, an amendment will be provided to all applicants who
received the original application.
J. COST OF PROPOSAL
The division is not responsible for any costs incurred by an applicant which are related to the
preparation or delivery of an application or any other activities carried out by an applicant related to
this application.
K. COPYRIGHTS
By submitting an application, the applicant agrees that the division may copy the application for
purposes offacilitating the evaluation of the application or to respond to a request for public records.
The applicant consents to such copying by submitting an application and warrants that such copying
will not violate the rights of any third party.
1. PUBLIC RECORDS
All information submitted by an applicant may be treated as a public record by the division unless the
applicant properly requests that the information be treated as confidential information at the time the
proposal is.submitted. Public records will be copied as necessary to comply with Iowa's public record
law. By submitting a proposal the applicant grants the division the right to make the required copies of
the proposal. Any request for confidential treatment of information must enumerate the specific
grounds in Iowa Code chapter 22 which support treatment of the material as confidential.
M. RESTRICTIONS ON GIFTS AND ACTIVITIES
Iowa Code chapter 68B contains laws which restrict gifts which may be given or received by state
. n. employees and requires certain individuals to_disclose information concerning their activities with state
govermnent. Applicants are responsible for determining the applicability of this chapter to their
activities and are responsible for complying with these requirements.
N. RELEASE OF CLAIMS
With the submission of a proposal, each applicant agrees that it will not bring any claim or have any
cause of action against the division or the State of Iowa based on any misunderstanding concerning the
information provided herein or based on the division's failure to provide the applicant with
information.

O. OTHER CONDITIONS
The Applicant also understands and agrees: (1) that any funds received as a result of this application
shall be subject to the conditions and other policies, regulations and rules issued by the Division of
Criminal and Juvenile Justice Planning for the administration of JAIBG projects; (2) that funds
awarded are to be expended only for the purposes and activities covered by the Applicant's approved
application and budget; (3) that the funds may be terminated in whole or in part at any time that the
Division of Criminal and Juvenile Justice Planning finds a substantial failure to comply with
contractual conditions or with regulations promulgated by the Division; and (4) that appropriate
records and accounts will be maintained and made available for audit as prescribed by the Division.

Budget Sheet Instructions
Block 1. SALARIES: Identify anyone to be paid as a salaried position on this grant.
Give title of individual, the annual salary, the percent of time he/she will devote to this
project and the amount requested.
Example: Title: Counselor; Salary: $15,000.00; % oftime: 10%; Request: $1,500.00
Block 2. PERSONNEL BENEFITS: List any personnel benefits that are associated with
the salary section. These could include Social Security, Worker's Compensation,
unemployment Compensation, and health insurance.
Block 3. CONTRACT SERVICES: State name, address, hourly or daily rate for all
individual contract or consultant services. For contracts with firms, state type of contract
and total cost. A subcontract budget sheet must be completed for each
subcontract listed.
Block 4. TRAVEL: Itemize all in-state and out-of-state travel. Include costs for meals,
lodging and mileage. Grant recipients are bound by the State of Iowa rates. These
limitations are .24 per mile for travel, $23 per day for meals: $5 breakfast; $6 lunch; $12
dinner. Grant funds may not be used for out-of-state travel not specified in this
application.
Block 5. TRAINING AND TUITION: For training seminars and schools, the number of
personnel, the amount of tuition, the name of the institution and the place must be
shown.
Block 6. EQUIPMENT: Itemize each item(s) to be purchased including the description
and costs.
Block 7. SUPPLIES AND OPERATING EXPENSES: Operating expenses must be
enumerated separately, such as rent, telephone, office machine rental, etc. Expendable
office supplies may be shown as a lump sum, such as paper, pens, pencils, staples, etc.
Indirect costs may bean allowable expense if the applicant prclVides documenta!ioll
from- a Cogniiant federal agency that identifies an indirect cost rate approved by that
federal agency for the applicant. Applicants without such an approved indirect cost rate
must allocate and justify all proposed costs among the eight primary budget categories.
Block 8. OTHER: Include any proposed expenses that do not fit within any of the
above-listed categories. Other costs may include, but are not limited to, stipends to
youth and audit fees.
