The City of Dubuque Zoning Advisory Commission has reviewed the above -cited request. The
application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request noting that he is purchasing a small piece of
property from his neighbor and incorporating into his residential lot.
Staff stated that as the plat is within 2 miles of the City of Dubuque, Zoning Advisory
Commission review is required. Staff said that the applicant is asking to waive the lot frontage
for Lot 2, which is currently being used as a septic field and will, therefore, not be built on. Staff
recommended approval of the plat, subject to waiving lot frontage requirements.
There were no public comments.
The Zoning Advisory Commission discussed the request. Commissioners asked why the lots
will not be consolidated to provide frontage. Staff noted that consolidation would be an added
expense and the existing lot that will become Lot 2 does not have frontage currently, and that
the drainage field serves the adjacent lot, hence, the two lots are bound together.
Recommendation
By a vote of 4 to 0, the Zoning Advisory Commission recommends that the City Council approve
the Final Plat of Pine View Subdivision, subject to waiving the lot frontage requirement for Lot 2.
A simple majority vote is needed for the City Council to approve the request.

INTRODUCTION
The submitted Final Plat of Pine View Subdivision subdivides an existing 4.18 acres of
land into three parcels. The City of Dubuque is reviewing this final plat as it is within two
miles of the city of Dubuque corporate limits that requires review by both the City and
County of Dubuque.
DISCUSSION
The submitted Final Plat of Pine View Subdivision is designed to create an additional
building lot, Lot 3, by subdividing a portion of what is currently Lot 4 Eugene Tigges
Subdivision and Lot 2 of 2 of 1 NW 1/4, NE 1/4, Section 31, T89N, R2E. Lot 2 is owned by
the owner of Lot 2 of 1 of 2 NW 1/4, NE 1/4, Section 31, T89N, R2E, which has frontage
on Old Highway Road.
The submitted Final Plat is in compliance with the Unified Development Code except for
Lot 2 not having frontage on a public or private street. The original parcel that Lot 2 was
comprised of did not have frontage on a street either. Planning staff have no objection
to Lot 2 having no frontage as the septic drain field for the adjacent residence is located
on Lot 2, and thus would require that the lot be further subdivided to create a buildable
lot.
RECOMMENDATION
The Planning Services staff recommends the Final Plat of Pine View Subdivision in
Dubuque County be approved subject to waiving the lot frontage requirement for Lot 2.
The submitted final plat is in all other respects in compliance with the Unified
Development Code.

RESOLUTION NO. 316 — 11
RESOLUTION APPROVING THE FINAL PLAT OF PINE VIEW SUBDIVISION IN
DUBUQUE COUNTY, IOWA.
Whereas, there has been filed with the City Clerk the Final Plat of Pine View Subdivision
in Dubuque County, Iowa; and
Whereas, said Final Plat provides 40 feet of frontage for Lot 2 on a public or private
street, where 50 feet is required by Section 11 -14 of Title 16 of the Dubuque County Code of
Ordinances, Unified Development Code; and
Whereas, said Final Plat has been examined by the Zoning Advisory Commission and
had its approval endorsed thereon; and
Whereas, said Final Plat has been examined by the City Council and they find that it
conforms to the statues and ordinances relating to it.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE DUBUQUE
COUNTY, IOWA:
Section 1. That Section 11 -14 of Title 16 of the City of Dubuque Code of Ordinances,
Unified Development Code, is waived to allow 40 feet of frontage on a public or private street for
Lot 2.
Section 2. That the Final Plat of Pine View Subdivision is hereby approved and the
Mayor and City Clerk are hereby authorized and directed to endorse the approval of the City of
Dubuque, Iowa upon said Final Plat.
