The City of Dubuque Zoning Advisory Commission has reviewed the above -cited request. The
application, staff report and related materials are attached for your review.
Discussion
The applicant, Allen Weber, spoke in favor of the request. He reviewed his request with the
Commission noting that he would like to purchase a small portion of his neighbor's lot to
eliminate the encroachment of his detached garage.
Staff reviewed the request, noting that the lot is substandard in both frontage and lot size. He
said that the lot had been platted in an effort to eliminate an encroachment and to provide the
required setbacks for a detached accessory structure.
There were no public comments.
The Zoning Advisory Commission discussed the request, and felt it was appropriate.
Recommendation
By a vote of 4 to 0, the Zoning Advisory Commission recommends that the City Council approve
the Plat of Survey for Lot 1 -1 & 2 -1 Gillespie's Third Addition subject to waiving the lot frontage
and area requirements for Lot 2 -1.
A simple majority vote is needed for the City Council to approve the request.

INTRODUCTION
The submitted Plat of Survey for Lot 1 -1 & 2 -1 Gillespie's Third Addition subdivides an
existing 11 -acre lot, splitting off 465 square feet of area so as to eliminate the
encroachment of a detached garage.
DISCUSSION
The detached garage was built by Mr. Allen Weber in June of 2003 and it was
subsequently discovered that a corner of the garage encroached on to the property
owned by Mr. Ralf Schreyer at 1005 W. 32nd Street. The lot split and subsequent sale
of Lot 2 -1 of Gillespie's Third Addition will serve to place the garage entirely on the
Weber's property. The lot split will also provide the minimum 6 foot side yard setback
required for detached accessory structures in an R -1 Single - Family Residential zoning
district.
Lot 2 -1 is substandard in that it does not have the minimum 5,000 square feet of area or
50 feet of frontage on a platted street required by subdivision standards set forth in the
Unified Development Code. Even if consolidated with the Weber's property (Lot 1 of
Biederman Place), it still would continue to be substandard as the Weber's property also
has no frontage on a platted street. It is not necessary that Lot 2 -1 be labeled
"nonbuildable" as a portion of the garage is already built on the lot joining it to the
Weber's property.
RECOMMENDATION
Staff recommends that the Zoning Advisory Commission approve the Plat of Survey for
Lot 1 -1 & 2 -1 Gillespie's Third Addition, waiving Section 11 -14 Block of the Unified
Development Code, Blocks & Lots.

RESOLUTION NO. - 11
RESOLUTION APPROVING THE PLAT OF SURVEY LOT 1 OF LOT 1 AND LOT 2 OF
LOT 1 OF GILLESPIE'S THIRD ADDITION IN THE CITY OF DUBUQUE, IOWA.
Whereas, there has been filed with the City Clerk the Plat of Survey Lot 1 of Lot 1 and
Lot 2 of Lot 1 of Gillespie's Third Addition in the City of Dubuque, Iowa; and
Whereas, said Plat of Survey provides 0 feet of frontage for Lot 2 of Lot 1 on a public
street and 465 square feet of lot area, where 50 feet of frontage and 5,000 square feet of lot
area are required by Section 11 -14 of Title 16 of the City of Dubuque Code of Ordinances,
Unified Development Code; and
Whereas, said Plat of Survey has been examined by the Zoning Advisory Commission
and had its approval endorsed thereon; and
Whereas, said Plat of Survey has been examined by the City Council and they find that it
conforms to the statutes and ordinances relating to it.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Section 11 -14 of Title 16 of the City of Dubuque Code of Ordinances,
Unified Development Code, is waived to allow 0 feet of frontage on a public street and 465
square feet of lot area where 50 feet of lot frontage and 5,000 square feet of lot area is required
for Lot 2 of Lot 1.
Section 2. That the Plat of Survey Lot 1 of Lot 1 and Lot 2 of Lot 1 of Gillespie's Third
Addition is hereby approved and the Mayor and City Clerk are hereby authorized and directed to
endorse the approval of the City of Dubuque, Iowa upon said Plat of Survey.
