The application, staff report and related materials are attached for your review. Discussion The applicant, Dave Schneider, Schneider Surveying, spoke in favor of the request. He said he has been working with Premier Bank to replat a foreclosed lot. He said that the bank was told that they need to establish a legal plat of survey acceptable to the County Auditor's office. Staff noted that the City had reached an agreement with Premier Bank regarding provision of easements that would enable the City to access and maintain City utilities. Staff recommended approval of the plat subject to waiving lot frontage requirements. There were no public comments. The Zoning Advisory Commission discussed the request, and felt it was appropriate. Recommendation By a vote of 4 to 0, the Zoning Advisory Commission recommends that the City Council approve the request, of the Plat of Survey Asbury Plaza No. 16 subject to waiving the lot frontage requirement for Lot 2. A simple majority vote is needed for the City Council to approve the request. DISCUSSION The submitted Plat of Survey of Asbury Plaza No. 16 facilitates the transfer of Lot 1 to Premier Bank and Lot 2 will be owned by Blue Sky, Inc. Premier Bank purchased the property that will be Lot 1 at a Sheriffs sale and the submitted plat of survey is intended to facilitate the closing of that transaction. The submitted Plat of Survey includes easements for public utilities and existing roadways that will be dedicated to the City when development of this area begins again. . The submitted Plat of Survey of Asbury Plaza No. 16 is in compliance with the Unified Development Code except for Lot 2 not having frontage on a public or private street. The property included in Lot 2 (125 acres) will eventually have frontage on the future extension of Plaza Drive. RECOMMENDATION Planning staff recommends that the Plat of Survey for Asbury Plaza No. 16 be approved subject to waiving lot frontage requirements for Lot 2.
