RESOLUTION DISPOSING OF CITY INTEREST IN MONROE AVENUE (A/K/A
LOUISE LANE), DUBUQUE, IOWA
Whereas, pursuant to resolution and published notice of time and place of
hearing, published in the Telegraph Herald, a newspaper of general circulation
published in the City of Dubuque, Iowa on 97,1(. day of ~ , 2000,
the City Council of the City of Dubuque, Iowa met on the t/ /9'""IC day of ~~
, 2000, at 6:30 p.m. in the Public Library Auditorium, 11~.
Locust, Dubuque, Dubuque, County, Iowa to consider the proposal for the sale of real
estate described as:
Lots C, D, E, and F of Maple Leaf Addition No.2 in the City of Dubuque,
Dubuque County, Iowa
Whereas, the City Council of the City of Dubuque, Iowa overruled any and all
objections, oral or written to the proposal to sell such real estate, except for easement
as noted.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That the sale of City of Dubuque real property described as Lot C
to Robert Fuerst and be contingent upon the payment of $100.00, Lot D to Ken Birch
and be contingent upon the payment of $100.00, and Lots E and F to Janet Balk and
be contingent upon the payment of $400.00, plus cost of publication, platting and
filing fees. Conveyance shall be by Quit Claim Deed.
Section 2. The City of Dubuque reserves unto itself a perpetual easement
including the right of ingress and egress thereto, for the purpose of erecting, installing,
construction, reconstructing, repairing, owning, operating, and maintaining water,
sewer, drainage, gas, telephone, t.V. cable, and electric lines as may be authorized by
the City of Dubuque, Iowa, as shown on the Plat of Survey of Lots C, D, E, and F of
Maple Leaf Addition No.2.

Section 3. That the Mayor be authorized and directed to execute three Quit
Claim Deeds, and the City Clerk be and is hereby authorized and directed to deliver
said deeds of conveyance to Robert Fuerst, Ken Birch, and Janet Balk upon receipt of
the purchase price in full.
Section 4. That the City Clerk be and is hereby authorized and directed to
record a certified copy of this resolution in the office of the City Assessor, Dubuque
County Recorder and Dubuque County Auditor.

SUBJECT: Vacating Petition - Monroe Avenue (a/k/a Louise Lane)
INTRODUCTION
This is in response to a request from Ken Birch for the vacating of Monroe Avenue
(a/k/a Louise Lane).
DISCUSSION
The attached plat shows the areas proposed on Monroe Avenue to be vacated. Mr.
Birch wishes to purchase the property to allow further development of his property.
The abutting properties are owned by Robert Fuerst, Janet Balk, Mark and Deb Meyer,
and Ken Birch, who have all consented to the vacating.
The area to be vacated will be divided into four lots numbered C, D, E, and F of Maple
Leaf Addition No.2. Sanitary sewer and watermain exist on Lots C and E. Perpetual
easement rights will be reserved on the entire Lots C and E and portions of Lots D and
F for maintenance of the existing sanitary sewer and watermain, and other utilities.
The City has no public purpose to retain the right-of-way.
The property has been valued at $ .30 per square foot, for a total of $2,475.00. Credit
was granted for surveying and platting costs, reducing the purchase price to $600.00.
RECOMMENDATION
The City has no plans for the utilization of the Monroe Avenue (a/k/a Louise Lane) to
be vacated, except for reserving the sanitary sewer and watermain easements as
noted.
I would recommend that the areas indicated by Lots C, D, E, and F of Maple Leaf
Addition No.2 on the attached plat be vacated, and that a public hearing be set for the
disposition of the City's interest in the subject area on June 19, 2000. I would further
recommend that the purchase price be established at $600.00, plus platting,
publication and filing fees.

ACTION TO BE TAKEN
The recommendation of the City Manager should be approved and a public hearing
should be scheduled on the disposal of the property through adoption of the enclosed
resolutions and ordinance.
