This is a claim for damages for personal injuries sustained by
the claimant in a fall near a construction site.
According to the report of Public Works Director and City
Engineer Mike Koch, this claim relates to a project that was under
construction by Portzen Construction. The improvement contract
includes the standard form of contracts and bonds typical of City
projects, which require the contractor to hold the City harmless
from any claims for damage or injuries resulting from that work.
It is the recommendation of Mr. Koch that this claim be forwarded
to Portzen Construction for processing, and the Legal Department
concurs with that recommendation.

SUBJECT: Claim of Linda M. Federonich, 2106 Kleine Street
This claim relates to the Klingenberg Terrace Retaining Wall Reconstruction Project
which is under construction by Portzen Construction. The improvement contract
includes the standard form of contracts and bonds typical of City projects, which
require the contractor to hold the City harmless from any claims for damage or injuries
resulting from the work, and also a $2,000,000 Liability Insurance Policy.
Therefore, it is the recommendation of the City Engineering Division that this claim for
personal injuries be forwarded to Portzen Construction for further
consideration/processing.
