This is a claim for reimbursement of expenses the claimant
incurred when her car was towed from 10th and Main Streets.
According to the report of Assistant Police Chief Terry
Lambert, the vehicle was not properly registered at the time the
driver was stopped for a seat belt violation. The vehicle was left
at 10th and Main Street for nine days, accumulating traffic tickets
and necessitating the towing of the vehicle. It is Assistant Chief
Lambert's recommendation that the claim be denied. The Legal
Department concurs with his recommendation.

Dear Ms. Gulick,
Regarding the claim filed by Ms. Diane Grub, I have learned the following,
On April 19, 2000 officers stopped a Chev Cavalier bearing Missouri license
plate number 473 BAF. The driver, Jennifer D. Ely, 12-23-80 giving a local
address of 2570 Asbury Rd. Dubuque was cited for not wearing a seat belt, no
proof of insurance and fraudulent use of license plates as the registration
information which came back to the officer indicated the plates belonged on a
vehicle other than the Cavalier on which they were displayed. They were shown
to belong on a 1991 Mercury.
The plates were removed from the vehicle and were placed into evidence. A copy
of the Property in Custody form was given to Ms. Ely. The vehicle itself was
left parked at the location of the traffic stop, lOth & Main Streets.
The officer set a court appearance date of April 26, 2000.
On April 28, 2000 at 7,15 A.M. after having been parked in the same location
since the date of the initial traffic stop the Cavalier was towed by the Wenzel
Towing Service for an accumulated number of parking tickets.
At some point in time either Ms. Grob or Ms. Ely reportedly came to the Law
Enforcement Center at which time they displayed a document which was believed
to be an application for title and license showing the transfer of the
plate from the Mercury to the Chevrolet. This document is dated January 12,
1999. Some time later a certificate of title, dated May 3, 2000 was produced
indicating the vehicle had just recently been titled in the State of Missouri.
According to the Clerk of Court, Ms. Ely had her charge of Failure to Produce
Proof of Insurance charge dismissed on May 4, her charge of Not Wearing a Seat
Belt she was found Guilty on May 9 and was assessed a fine of $34.50, which has
not been paid and her charge of False Use of Registration dismissed on May 10.
I would conclude from all this that at the time of the traffic stop the vehicle

in question had not been properly registered. Had the application for title
and license been filed when it was first prepared, (Jan 12, 1999)
the appropriate paperwork would have been completed and the registration check
done by the officers would have shown the plates to be on the proper vehicle.
The title again shows it to be issued on May 3, 2000.
Had the vehicle been moved prior to April 28 it would not have accumulated an
excessive number of parking tickets and would not have been towed.
