RESOLUTION APPROVING THE FINAL PLAT OF STOFFEL ACRES
SUBDIVISION IN DUBUQUE COUNTY, IOWA
Whereas, there has been filed with the City Clerk a final plat of Stoffel Acres
Subdivision in Dubuque County; and
Whereas, said plat provides 0 feet of frontage for Lots 2 and 3, where 60 feet is
required by Section 42-19 (b) of the Subdivision Regulations; and
Whereas, said plat has been examined by the Zoning Advisory Commission and
had its approval endorsed thereon; and
Whereas, said plat has been examined by the City Council and they find that it
conforms to the statutes and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That the City Council hereby waives Article IV, Design and
Improvement Standards of the Subdivision Regulations, except for Section 42-19,
Blocks and Lots.
Section 2. That Section 42-19 (b) of the Subdivision Regulations is waived to
allow Lots 2 and 3 to have 0 feet of frontage, where 60 feet is required,
Section 3. That the final plat of Stoffel Acres Subdivision is here by approved
and the Mayor and City Clerk are hereby authorized and directed to endorse the
approval of the City of Dubuque, Iowa, upon said final plat.

. Discussion
The applicant spoke in favor of the request noting that the County Planning and Zoning
Commission and County Engineer have approved the submitted plat. Staff reviewed
abutting land use and location of existing houses.
The Zoning Advisory Commission discussed the request and recommended approval
subject to waiving lot frontage requirements for Lots 2 and 3.
Recommendation
By a vote of 7 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request subject to waiving Article IV, Design and Improvement Standards,
except for Section 42-19, Blocks and Lots, and waiving frontage requirements for Lots 2
and 3.
A simple majority vote is needed for the City Council to approve the request.

Survey Plat of the Minor Subdivision of Stoffel Acres
INTRODUCTION
The applicant, Richard Stoffel, is requesting approval to subdivide a 9.43 acre lot into
three separate lots. The subject property is located on North Cascade Road in
Dubuque County, and is being reviewed by the Zoning Advisory Commission as it is
within two miles of the City's corporate limits.

DISCUSSION
The submitted plat subdivides an existing 9.43 acre parcel into three lots. Lot 1 is 1.2
acres, has 185 feet of frontage on North Cascade Road and encompasses an existing
single-family residence. Lot 2 is 1.25 acres, sits directly south of Lot 1, and has no
frontage. Lot 3 is 7.01 acres, sits directly south of Lot 2, and has no frontage. Lots 2
and 3 will be accessed from a 20-foot easement that lies along the western boundary of
Lot 1 and bisects Lot 2.
The submitted final plat of Stoffel Acres is a subdivision because it creates three lots
without the dedication of any public street or utilities. The subdivision is platted to the
center line of North Cascade Road which is typical in the county. The three lots being
platted meet City and County standards for lot area but Lots 2 and 3 do not meet City or
County standards for lot frontage. Each of the three lots will be served by private water
and septic systems.
The submitted plat of Stoffel Acres subdivision is in substantial compliance with the City
of Dubuque Subdivision Regulations with the exception of street frontage requirements.
RECOMMENDATION Staff recommend the Zoning Advisory Commission recommend
approval of the subdivision, subject to waiving Article IV, Design and Improvement
Standards, except for Section 42.19, Blocks and Lots with the exception of 42-19 (c)
required frontage.
