RESOLUTION APPROVING THE PLAT OF SURVEY OF LOT 1 AND LOT A LORAS
ESTATES NO.2 IN THE CITY OF DUBUQUE, IOWA
Whereas, there has been filed with the City Clerk a plat of survey of Lot 1 and Lot A
Loras Estates NO.2 in the City of Dubuque, Iowa; and
Whereas, said plat provides 0 feet of frontage for Lot 1, where 60 feet is required by
Section 42-19(b) of the Subdivision Regulations; and
Whereas, said survey plat has been examined by the Zoning Advisory Commission and
has its approval endorsed thereon; and
Whereas, said survey plat has been examined by the City Council and they find that it
. conforms to the statutes and ordinances relating thereto.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. That Section 42-19(b) of the Subdivision Regulations is waived to allow
Lot 1 to have 0 feet of frontage, where 60 feet of frontage is required.
Section 2. That the plat of survey of Lot 1 and Lot A Loras Estates NO.2 is hereby
approved and the Mayor and City Clerk are hereby authorized and directed to endorse the
approval of the City of Dubuque, Iowa, upon said final plat.

Description: Plat of Survey to replat property line between Mount Calvary Cemetery and
Loras Estates Subdivision
Dear Mayor and City Council Members:
The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request. The
application, staff report and related materials are attached for your review.
Discussion
The applicant Ron Smith spoke in favor of the request, noting that several of the cemetery's
plots were found to be on his property and the submitted plat will redraw the property lines so
that the graves will not have to be relocated. Staff reviewed with the Commission that Lot 1 did
not have frontage on a street and that the applicant is requesting the Commission waive that
requirement.
The Zoning Advisory Commission discussed the request noting that Lot 1 is part of the Mount
Calvary Cemetery and that adequate access already exists to the site.
Recommendation
By a vote of 6 to 1, with Commissioner Ron Smith abstaining, the Zoning Advisory Commission
recommends that the City Council approve the request subject to waiving frontage
requirements for Lot 1.
A simple majority vote is needed for the City Council to approve the request.

SUBJECT: Plat of Survey of Lot 1 and Lot A of Loras Estates No.2
DISCUSSION
The submitted Plat of Survey of Lot 1 and Lot A of Loras Estates No.2 resubdivides
existing property owned by Ron Smith and the Mount Calvary Cemetery and
Mausoleum Association. As part of the survey work for the Loras Estates Subdivision,
it was found that a portion of the graves for Mount Calvary Cemetery were in fact on
land owned by Ron Smith. This submitted plat of survey replats the property lines to
place the aforementioned graves on property that will then be owned by Mount Calvary
Cemetery.
The submitted plat of survey is being reviewed by the Zoning Advisory Commission as
Lot 1 does not have frontage on a public or private street. The submitted plat of survey
is in all other respects in compliance with the City of Dubuque Subdivision Regulations.
RECOMMENDATION
Staff recommends that the Zoning Advisory Commission approve the plat of survey of
Lot 1 and Lot A of Loras Estates No.2, waiving the lot frontage requirement for Lot 1.
The plat of survey is in all respects in compliance with the City of Dubuque Subdivision
Regulations.
