SUBJECT: Ice Harbor Urban Renewal District
Site Planning will be an important element of the development of the Ice Harbor
Urban Renewal District. All the parties generally have an idea of where the key
elements of development will be located, such as the hotel, water park, and
convention center. However, at this stage it is unclear specifically where the best
place will be to build the Durrant office building.
Durrant has asked for some additional language in the development agreement that
allows them to make their final decision on whether or not to construct the building
based on the results of the site planning process. They also do not think it is clear
in the agreement that it is their choice whether they lease the two acres directly
from the City or they sublease from Platinum Hospitality Group.
I respectfully recommend that the Development Agreement be approved as
amended with the attached replacement page, first it adds the introductory section
to the last sentence before Subsection (a) of Section 3.1 (B), which reads,
"Presuming that the study concludes favorably for the Durrant office building
project," AND secondly, it adds wording later in Section 3.1 (B) that makes the
change on the option on the land lease as noted in the attachment.

sublease to the Durrant Group for the home or regional office and proprietary parking as determined by

Furthermore, plans shall be submitted by Developer indicating the location of future expansions of the
Minimum Improvements on the Property to provide 150 additional guest rooms, an 18,000 square foot
addition to the water park and additional proprietary parking (the "Phase II Improvements"). Sufficient
land to accommodate the Phase II Improvements shall be part of the initial lease area. The development
of the Phase II Improvements shall not be required unless the following conditions are satisfied:
(a) Developer obtaining commercially reasonable financing for the development and construction
of the Phase II Improvements.
(b) The occupancy average with respect to the hotel portion of the Minimum Improvements
during any consecutive twenty-four (24) month period of operations of the hotel shall be at
least 85%. Commencing the twenty-fifth (25th) month following the date Developer receives
the certificate of completion from the City for the Minimum Improvements as provided in
Section 3.4 below (the "Certificate of Completion Date"), and every month thereafter,
Developer shall make the occupancy figures for the immediately preceding twenty-four (24)
month period available to the City to review. The foregoing obligation to make available the

Planning Advisory Commission, which shall
consist of nine (9) members including a member
of the City Council designated by the City
Council, a member of the Zoning Advisory Com-
mission designated by the Zoning Advisory
Commission and seven (7) residents of the City
appointed by the City Council who shall be
qualified by their knowledge, experience and
ability to contribute to the City's long-range
planning and development efforts.
The City Council shall annually designate a
Councilmember to serve as an alternate in the
absence of the Council's designated representa-
tive and the Zoning Advisory Commission shall
annually designate a Commission member to
serve as an alternate in the absence of the
Commission's designated representative. (Ord.

information on the education, training,
experience, expectations and other quali-
fications of the applicant;

general public to comment in writing On
the qualifications of each applicant; and
(3) A formal interview by the City COllllcil to
determine the applicant's qualifications
and ability to effectively serve on the

The term of office for a resident member shall
be three (3) years or until a successor is duly

A Commission member may be removed at
any time with or without cause by a vote of two.

A vacancy occurring on the Commission
caused by resignation or otherwise, shall be
filled by appointment by the City Council for
the remainder of the unexpired term.
Members of the Commission shall serve with-
out compensation except. for actual expenses,
which shall be subject to approval by the City

Sec. 36-7. Powers:
The Commission shall have the following
powers, duties and responsibilities:

(1) To provide a leadership role in'the plan-
ning, coordinating and sponsoring of a
periodic community planning process;
(2) To coordinate and supervise the prepara-
tion and maintenance of the Comprehen-
sive Plan;
(3) To provide input to the City Manager in
the preparation of the City Manager's
recommended multi-year capital im-
provement program (CIP);
(4) To make comprehensive studies of the
present condition and the future growth
oC . the City to provide input into the
community planning process and to guide
and accomplish a coordinated, consistent
and harmonious development of the City
in accordance with the present and Cu-
ture needs thereof to the end that the
health, safety, morales, order, conve-
nience, prosperity and general welfare
may be promoted;
(5) To make or cause to be made such sur-
veys, studies, maps, plans, or charts of
the City with due regard to its relation

to neighboring territory as may be deter-
mined as necessary to carry out the pur-
poses of the Commission;
(6) To recommend amendments to all or a
part oC the Comprehensive Plan in re-
sponse to the community planning pro-
cess, upon its own initiative or upon
recommendation presented by the Zoning
Advisory Commission, but only after a
public hearing;
(7) To review proposed urban renewal plans
and urban renewsl plan amendments
and urban revitalization plans and urban
revita1ization plan amendments for con-
sistency with the Comprehensive Plan
for the City;
(8) To undertake public information efforts
to enhance public understanding of the
community planning process generally
and the Comprehensive Plan specifically;
and
(9) To undertake Crom time to time other
specific long.range planning projects
which may be referred to it by the City
Council.
The City Council shall have the authority to
establish or revise the priorities of the Commis-

The Commission shall choose annually, at its
first regular meeting of the fiscal year, one of
its memhers to act as chairperson, and another

during the chairperson's absence or disability.
The Commission shall adopt such rules and
regulations governing its organization and pro-
cedures as it may be deemed necessary.
(1) The Commission shall meet as necessary

Sec. 34-25. Solicitation And Acceptance
Of Donations:
The Commission may solicit and otherwise
accept donations and gifts of money, personal
and real property and personal services. All
such donations and gifts as received shall be-
come the property of the City for the general
use of support of park and recreation programs
of the City unless such items have been desig-
nated by the donors for specific purposes. (1976
Code, ~ 27-20)
Sec. 34-26. Membership, Appointment:
(a) The Commission shall be comprised of a
membership of seven (7) persons who shall be
appointed by the City Council for terms of three
(3) years. Four (4) members of the Commission
shall constitute a quorum for the transaction of
business. All action of the Commission shall be
by resolution and the affirmative vote of at
least four (4) members shall be necessary for
the adoption of any resolution.
(b) The expiration date for all terms of office
shall be June 30 of the appropriate year.
(c) Membership on the Commission shall be
limited to persons who are residents of the City.
(d) Vacancies caused by death, resignation or
otherwise on the Commission shall be promptly
filled by the City Council for the unexpired
term of office. (1976 Code, ~ 27-21; Ord. 63-94,
~ 3, 11-7-1994)
Sec. 34-27. Attendance:
(a) Members of the Commission shall attend
at least two-thirds ('/3) of all regularly sched-
uled and held meetings within any twelve (12)
month period. If any member does not attend

such prescribed number of meetings, it shall be
grounds for the Commission to recommend to
the City Council that the position be declared
vacant and a replacement appointed.
(b) The attendance of all Commission mem-
bers shall be entered upon the minutes of all
meetings by the secretary. (1976 Code, ~ 27-22)
Sec. 34-28. Compensation:
All members of the Commission shall serve
without compensation except for reimbursement
of necessary expenses. 0976 Code, ~ 27-23)
Sec. 34-29. Organization:
(a) The officers of the Commission shall be a
chairperson, a vice chairperson and a secretary.
All officers shall be members of the Commis-
sion.
(b) At the initial meeting of the Commission
and at the first meeting in July of each year,
the Commission shall elect the above identified
officers to serve one year terms of office. All
officers shall be eligible to serve successive
terms of office. (1976 Code, ~ 27-24)
Sec. 34-30. Meetings:
(a) The Commission shall meet not less than
bimonthly, after four thirty o'clock (4:30) P.M.
on a regularly scheduled day.
(b) Special meetings may be called by the
chairperson or at the written request of three
(3) members.
(c) All meetings shall be called and held in
conformance with the Iowa Open Meetings Law.
(d) A copy of the minutes of all regular and
special meetings of the Commission shall be
filed with the City Council within ten (0)

Created; Composition; Ap-
pointment:
There is hereby created a City Zoning Adviso-
ry Commission, which shall consist of seven (7)
residents of the City. appointed by the City

Sec.36-10.1. Appointment To Airport
Zoning Commission:
Two (2) members of the Commission shall be
appointed by the City Council to serve on the
Airport Zoning Commission. A member shall
serve out the term on the Airport Zoning Com-
mission even if the member's term on the Zon-
ing Commission has expired. (Ord. 86-95,
12-18-1995)
Sec. 36-11. Application And Appointment
Process:
The appointment process to the Commission
by the City Council shall include at least the
following:
(1) An application form requesting basic
information on the education, training,
experience, expectations and other quali-
fications ofthe applicant;
(2) Notice to and an opportunity for the
general public to comment in writing on
the qualifications of each applicant; and
(3) A formal interview by the City Council to
determine the applicant's qualifications
and ability to effectively serve on the
Commission. (Ord. 11-90, ~ 2, 2-5-1990)
Sec. 36-12. Terms; Filling Of Vacancies;
Compensation:
The term of office for members of the Zoning
Advisory Commission shall be three (8) years or
until a successor is duly appointed. Two (2) of
the initial terms shall be for a term of one year;
two (2) of the initial terms for two (2) years;
and three (8) of the initial terms for three (3)
years.
A Commission member may be. removed at
any time with or without cause by a vote of two-
thirds ('t,) of all members of the City Council.

Sec. 36-13. Powers:_
The Zoning Advisory Commission sball con-
cern itself with short-range physical planning
and shall have and possess the following pow-
ers, duties and responsibilities:
(1) To prepare and recommend a Zoning
Ordinance by exercising the powers con-
ferred by Iowa Code chapter 414, "Munic-
ipal Zoning". Such Zoning Ordinance
shall include the boundaries of the vari-
,-" -nning districts; the height, number
of stories and size of buildings and other
structures in each district; the percent-
age of ground that may be occupied;
setback requirements; the size of yards,
courts and other open space; the density
of population; the location and use of
buildings, structures, and land for trade,
industry, commercial, residential or
other purposes; and such regulations and
restrictions necessary to enforce such
zoning provisions. 'Ib this end the Zoning
Advisory Commission shall prepare a
preliminary Zoning Ordinance and hold
public hearings thereon and after such
hearings have been held, shall submit a
final Zoning Ordinance and its recom-
mendations to the City Council;
(2) To recommend to the City Council, from
time to time, as conditions require,
amendments, supplements, changes or
modifications to the Zoning Ordinance

(3) To make such surveys, studies, maps,
plans or plats of the whole or any portion

of the City and of any land outside there-
of, which in the opinion of the Zoning
Advisory Commission are consistent with
the Comprehensive Plan and are neces-
sary to carry out the purposes of the
Commission;
(4) To make recommendations to the City
Council upon plans, plats or replats of
subdivisions or resubdivisions within the
City which show streets, alleys or other
portions of the same intended to be dedi-
cated for public use;
(5) To make recommendations to the Long-
Range Planning Advisory Commission on
the preparation and maintenance of the
Comprehensive Plan;
(6) To fulfill those duties and responsibili-
ties assigned to a City Planning Commis-
sion in Iowa Code chapter 409, "Plats";
and
(7) To undertake from time to time other
specific short-range planning projects
which may be referred to it by the City
Council.

The City Council shall have the authority to
establish or revise the priorities of the Commis-

Sec. 86.14. Organization; Meeting.:
(a) The Zoning Advisory Commission shall
choose annually, at its first regular meeting of
the fiscal year, one of its members to act as
chairperson, and another of its members to act
as vice-chairperson, to perform all of the duties
of the chairperson dUring the chairperson's
absence or disability. The Commission shall
adopt such rules and regulations governing its
operation and procedure as may be deemed
necessary.

Re: Land Use Amendment of Freeway Corridor Plan
Dear Mayor and City Council Members:
The Long Range Planning Advisory Commission held a public hearing on the Land Use
Amendment of the Freeway Corridor Plan for the A.Y. McDonald Site at its May 17,2000
Commission meeting.
At the meeting, Mr. Steve Juergens, Fuerste, Coyle, Juergens & Sudmeier, reviewed the history
of the property, the freeway plan, surrounding zoning requirements, and the City staff report
regarding the land use amendment. Mr. Roy Sherman, A.Y. McDonald Corporation, was also
present for the public hearing.
Following the public hearing regarding the rezoning request, the Commission discussed the
request. The Commission unanimously determined that circumstances and conditions in the
community have sufficiently changed such that the land use amendment is consistent with the
goals and objectives of the City's Comprehensive Plan and recommends that the rezoning request
should be approved by the City Council.

Subject: North Burden Street Reconstruction
Dear City of Dubuque,
I disagree with the City engineering Division that my property will increase in value by
$5025.34 by the reconstruction of North Burden Street. I can only say that, by
reconstructing North Burden Street, it can only decrease the value of my home and the
property it is on. I believe that the increase that you r engineers have placed on my
property was done solely to make the assessment higher for the new street that you are
planning. (In fact, my property was the highest of the project.)
I would also like the City Council to look at the lots that are being assessed as unusable
(Deficiency Assessment) on the West End of North Burden Street:

Dear Councilman Robbins,
Please let this letter serve as verification that I do not in any way support the planned total
reconstruction of North Burden Street.
However, as a resident of that street, I would also like to share with you that I do not believe
installation of a sidewalk is necessary on either side of the street. This is primarily due to the fact
that North Burden Street is a dead-end street which is basically only one block long and has a
relatively low traffic base.
Councilman Robbins, a new street is definitely not needed... please consider my request for "no
reconstruction." Thank you, in advance, for your time and consideration in this matter.
