ORDINANCE NO. 37-00
AN ORDINANCE AMENDING APPENDIX A (THE ZONING ORDINANCE) OF
THE CITY OF DUBUQUE CODE OF ORDINANCES BY RECLASSIFYING
HEREINAFTER DESCRIBED PROPERTY LOCATED AT THE NORTHEAST
CORNER OF NEVADA STREET AND YM-YWCA DRIVE FROM OR OFFICE
RESIDENTIAL DISTRICT TO R-1 SINGLE-FAMILY RESIDENTIAL DISTRICT
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That Appendix A (the Zoning Ordinance) of the City of Dubuque Code
of Ordinances is hereby amended by reclassifying the hereinafter described property
from OR Office Residential District to R-1 Single-Family Residential District, to wit:
Lot 1 and Lot 1-A of Murphy's Subdivision, Lot 2 of Lot 7 and Lot 2 of Lot 8
of Reeder Langworthy's Subdivision, and to the center line of the adjoining
public right-of-way, all in the City of Dubuque, Iowa.
Section 2. The foregoing amendment has heretofore been reviewed by the
Zoning Advisory Commission of the City of Dubuque, Iowa.
Section 3. This ordinance shall take effect immediately upon publication, as
provided by law.

Property History: The subject property was used for a combination of residential
and office uses in the past. As part of the reconstruction of lower Dodge Street, the
property was acquired by IDOT. After finishing the construction of new Highway 20 as
well as the frontage road named YM-YWCA Drive, the property was put up for auction.
. Physical Characteristics: The subject parcel has frontage on Nevada and YM-YWCA
Drive. The property generally slopes toward the southeast.
Concurrence with Comprehensive Plan: The 1995 Comprehensive Plan did not
designate this area.
Impact of Request on:
Utilities: Existing utilities are adequate to serve the site.
Traffic Patterns/Counts: Nevada Street is designated as a residential street, while
the YM/YWCA Drive is a frontage road for U.S. Highway 20. No traffic counts are
available for either street.
Public Services: Existing public services are adequate to serve the site.
Environment: Staff do not anticipate any adverse impact to the environment
provided adequate erosion control is provided during construction of the single-
family home.

Adjacent Properties: Staff do not anticipate any adverse impact to adjacent
property as the surrounding area is primarily developed for residential uses.

Staff Analysis: The applicants are proposing the rezoning of the subject parcel from
OR Office Residential to R-1 Single-Family Residential district. The subject property is
on the north east corner of Nevada Street and YM-YWCA Drive which serves as a
frontage road along the north side of U.S. Highway 20.
The property was formerly used for a single-family home and an insurance business
prior to its purchase by IDOT as part of the Highway 20 Reconstruction Project. The
surrounding property is used for a mixture of single- and two-family residential
properties on the east, west and north sides.
This area of Dodge Street will be the first section landscaped as part of the City's
approximately $1 million dollar effort to improve the aesthetics of this major corridor
through the City.
Staff recommend that the Zoning Advisory Commission review Section 6-1.1 of the
Zoning Ordinance that establishes criteria for the review of rezoning requests.

The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request.
. The application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request, noting that proposed rezoning will make it
possible to construct two homes for Habitat for Humanity. Staff reviewed surrounding
zoning and land use for this section of U.S. Highway 20.
The Zoning Advisory Commission discussed the request, noting that the proposed zoning
is consistent with surrounding zoning and land use.
Recommendation
By a vote of 7 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request.
A simple majority vote is needed for the City Council to approve the request.
