ORDINANCE NO. 38-00
AN ORDINANCE AMENDING APPENDIX A (THE ZONING ORDINANCE) OF
THE CITY OF DUBUQUE CODE OF ORDINANCES BY RECLASSIFYING
HEREINAFTER DESCRIBED PROPERTY LOCATED AT 511 GARFIELD
AVENUE FROM R-2A ALTERNATE TWO-FAMILY RESIDENTIAL DISTRICT TO
OR OFFICE RESIDENTIAL DISTRICT
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That Appendix A (the Zoning Ordinance) of the City of Dubuque Code
of Ordinances is hereby amended by reclassifying the hereinafter described property
from R-2A Alternate Two-Family Residential District to OR Office Residential District, to
wit:
Lot 1 of Lot 1 of Lot 3 of the Subdivision of Mineral Lot 113A, and to the
center line of the adjoining public right-of-way, all in the City of Dubuque,
Iowa.
Section 2. The foregoing amendment has heretofore been reviewed by the
Zoning Advisory Commission of the City of Dubuque, Iowa.
Seciton 3. This ordinance shall take effect immediately upon publication, as
provided by law.

Property History: The property has been used as a residence since its construction.
Physical Characteristics: The subject property has frontage on Garfield Avenue and
also has access to a City alley at the rear of the property. The property is
approximately 170 feet deep by 72 feet wide.
Concurrence with Comprehensive Plan: The 1995 Comprehensive Plan did not
designate this area.
Impact of Request on:
Utilities: Existing utilities are adequate to serve the proposed development.
Traffic Patterns/Counts: Garfield Avenue is designated as a residential street and
there are no current traffic counts available.
Public Services: Existing public services are adequate to serve the subject
property.
Environment: Staff do not anticipate any adverse impact to the environment.
Adjacent Properties: The applicant proposes to rehab the existing building at 511
Garfield into a 20-unit room and boarding house for low and moderate income
residents. The conversion may create additional vehicle trips to and from the
property; however, the conversion will bring the existing structure up to current
building code requirements.

Staff Analysis: The applicant, Scott A. Potter, is proposing to rehab the building at 511
Garfield into a 20-unit rooming and boarding house. The requested rezoning to OR
Office Residential will allow the proposed rehab provided that adequate off-street
parking is provided, based on the Zoning Ordinance requirement of .75 per tenant.
The OR Office Residential District allows for residential dwellings as well as general
offices, churches and schools. The OR district is intended to serve as a transition zone
between commercial, single and two-family residential areas through the adaptive re-
use of existing building stock, which would typically be residential in character.
The subject parcel borders C-2 Commercial property on the south and there is an R-3
zoned parcel on the other side of the alley from the subject parcel.
Planning staff have reviewed the proposed rooming and boarding house and there is
adequate room in the rear of the lot for off-street parking. Any additional off-street
parking will require that it be constructed to City standards and that adequate drainage
and erosion control be provided as per Zoning and Engineering standards.
Planning staff recommend that the Zoning Advisory Commission review Section 6-1.1
of the Zoning Ordinance that establishes criteria for reviewing rezoning requests.

The City of Dubuque Zoning Advisory Commission has reviewed the above-cited request.
The application, staff report and related materials are attached for your review.
Discussion
The applicant spoke in favor of the request, noting that the proposed rezoning will allow
redevelopment of the subject property to provide affordable dwelling units. Staff reviewed
surrounding zoning and land use noting the subject property is adjacent to C-2
Neighborhood Commercial zoning.
The Zoning Advisory Commission discussed the request noting that the proposed zoning
does provide a transition between commercial zoning and the residential district to the
north, and is a positive development for the community.
Recommendation
By a vote of 7 to 0, the Zoning Advisory Commission recommends that the City Council
approve the request.
A simple majority vote is needed for the City Council to approve the request.
