A RESOLUTION ACCEPTING A CONVEYANCE OF PROPERTY ON
KLINGENBERG TERRACE TO THE CITY OF DUBUQUE
Whereas, the City of Dubuque entered into an Acquisition Agreement with Jeff P.
Conard and Jennifer L. Conard pursuant to which Jeff P. Conard and Jennifer L. Conard
agreed to convey a part of Lot 2 of 2 of 13 except the northerly five feet thereof of Siege
Subdivision, in the City of Dubuque, Iowa, as shown on the Acquisition Plat thereof; and
Whereas, Jeff P. Conard and Jennifer L. Conard have executed a conveyance of
said property.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA:
Section 1. The City Council of the City of Dubuque, Iowa, hereby approves of,
accepts and consents to the Warranty Deed from Jeff P. Conard and Jennifer L. Conard,
copies of which are attached hereto, as required by Iowa Code Section 569.7.
Section 2. The Mayor is hereby authorized and directed to execute and
acknowledge on behalf of the City of Dubuque any instruments in connection herewith.

SUBJECT: Klingenberg Terrace - Acceptance of Warranty Deed
INTRODUCTION
Enclosed are resolutions accepting warranty deeds for right-of-way purchases for the
Klingenberg Terrace Retaining Wall Reconstruction Project.
DISCUSSION
.
Additional right-of-way for Klingenberg Terrace was required during construction to match
the existing terrain on two properties adjacent to Kleine Street. These purchases vary in
width from three to seven feet. This additional right-of-way will allow for proper
installation of the new retaining wall.
Enclosed are warranty deeds for the parcels needed for the pavement widening and wall
reconstruction for the project. Included are the following warranty deeds:
Jeff P. & Jennifer L. Conard
A part of Lot 2 of 2 of 13 of Siege Subdivision
except the northerly five feet thereof.
Shannon Felderman
Part of the balance of Lot 12 of Siege Subdivision.
RECOMMENDA TION
The above properties have been purchased by the City, and the Warranty Deeds should
be accepted by the City Council. I would recommend adoption of the enclosed resolutions
accepting the deeds.

The City Council is requested to adopt the attached resolutions accepting the warranty
deeds from Conard and Felderman.

RESOLUTION NO. 173-00
A RESOLUTION ACCEPTING A CONVEYANCE OF PROPERTY ON
KLINGENBERG TERRACE TO THE CITY OF DUBUQUE
Whereas, the City of Dubuque entered into an Acquisition Agreement with Shannon
Felderman, pursuant to which Shannon Felderman agreed to convey a part of the balance
of Lot 12 of Siege Subdivision in the City of Dubuque, Iowa, as shown on the Acquisition
Plat thereof; and
Whereas, Shannon Felderman has executed a conveyance of said property.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
DUBUQUE, IOWA: .
Section 1. The City Council of the City of Dubuque, Iowa, hereby approves of,
accepts and consents to the Warranty Deed from Shannon Felderman, copies of which are
attachedJ'lereto,auequiredbyJowlil Code_Sectio_n 569.7.
Section 2. The Mayor is hereby authorized and directed to execute and
