Rezoning Request for 3030 Brunskill Road
ZONING UPDATE
The Zoning Commission concurred with the request of Patzer
Communications Group, Inc. to rezone the house located at 3030 Brunskill Road
to P.O. (Planned Office Business).
The Council has set a public hearing on Monday, May 15, 2000, at 6:30
P.M. at the Council Chambers, located on the 3'd floor of the Public Library, to ,ac't 'on
the Zoning Commission recommendation.
It is CRITICAL that YOU attend this meeting to demonstrate a united front
to keep our area zoned as single-family residence. The rezoning of the
residence at 3030 Brunskill Road should be the ONLY issue. The planned unit
development that Mr. Patzer has proposed on the land behind and along side of
3030 Brunskill Road are duplexes and similar to the StQcks condos. We can live
with that. We cannot allow unrelated business establishments to get a foothold
in the area. This is not a home occupation business because its owner lives 160
miles away in New Berlin, Wisconsin. We have to stress that Doinl!

Dear Mr. Duggan:
We have been residents at 2855 Brunskill Road for over 44 years. At the time
we moved here. we were in the country and the area was mostly agricultural with ten
other single-family residences. When Goerdt Construction located in the. area, it was
achieved due to lack of zoning.
When our area was up for annexation to the city of Dubuque. we were
encouraged to vote in favor of annexation. In return. the city of Dubuque promised us
zoning protection. When Goerdt Construction went bankrupt, the property was
subsequently occupied as a single-family residence and. due to city zoning action; the
property reverted to single family residence (S.F.R.) only. The promised zoning
protection was granted. Now. however, the promise needs to be backed up once again
to prevent spot zoning in our residential neighborhood.
In the past. an attempt had been made to change one of the original homes (on
Brunskill Road) from S.F.R. to C-1, which was denied. The property was located just
behind the Hoffman House Restaurant and the Midway Motor Lodge. When the elderly
woman could no longer live in her home and care for the property, Midway and the
Hoffman House purchased the property. They demolished the house and created a
park-like area in order to preserve the residential ambiance.

I am a homeowner living at 3060 Deerwood Circle.We purchased ourcondofiveyearsagobecauseofthesingle-family residence zoning.Weappreciatedthequietnessofthearea,the low traffic on Brunskill Road andpeaceofnatureinthearea.I am very upset that the Zoning Commission hasagreedtorezonethehouselocatedat3030BrunskillRoadtoPlannedOfficeBusiness.
I would like to voice my concern and hope that each of the city councilmemberswillvoteagainstthisrezoningattheMondayMay15meeting.That one office building will only be the beginning of many relatedproblemsforthecity,such as traffic problems,wear and tear on the road,accidents,etc.Also,who knows where the business ventures will end onthisroad.We could be looking at another Cedar Cross Road and thatcertainlyhasit’s share of problems.
Please vote no on this issue.People in this area will appreciate it very much.

When Patzer Communications initially applied to rezone the property known as
3030 Brunskill Road, he stated that it would be staffed by just a few (maybe three or
.,
four) employees and had no plans for expansion. His application was rejected by a vote
of 7-0. Nothing in the neighborhood has changed to date except for the growth in S.F.R.
However, Patzer's plans have changed. His current plans illustrate further expansion.
He now proposes an addition to the house and a 12-space parking lot. It is particularly
noteworthy that the house already has off-street parking for, at least, six vehicles.
The Brunskill area has increased from eleven single-family residences to 50 over
the years. There is, yet another, single-family development in the planning process that
will add 18 units, each consisting of two (owner-owned) single-family residences. The
aforementioned area is Bob Stacks P.U.D., to which no objections were made because it
contains no encroachment of business of any kind in a residential area.
There are many areas available in the Dubuque vicinity at which the Patzer
Communications Group, Inc. can locate. Had Mr. Patzer consulted one of the many
reputable reaitors in Dubuque, he would have discerned this. In fact, why hasn't the
property that Buesing & Associates are planning to develop at the southeast corner of
Asbury Road and Northwest Arterial (with planned office area) even been considered as
a viable alternative?
The Zoning Commission implied that we would have to object to the entire plan
presented at the Commission's pUblic hearing, citing specific reasons for objecting to the
whole proposal. That has placed us in a "catch 22" position. While our desire is to have

single-family development in the area, we are forced,\to the entire proposal when our
only objection is to zoning changes that would allow a business encroachment on our
neighborhood. We hope that you can accept the P.U.D. part but deny the P.O. part of
the proposal. If not, we respectfully insist that you keep the city of Dubuque's promise to
us of zoning protection and, therefore, deny the entire plan presented.

This letter is in response to the proposed zoning change at 3030 Brunskill Road. We
have resided at 2933 Brunskill Road for 20 years. This area has always been designated
for residential expansion of the city. The city has demonstrated this by repeatedly
refusing to change the zoning on other properties near 3030 Brunskill Rd. This
property is a residence for a single family and should remain as such. A change in zoning
for this property would be an injustice to all of the residents living in this area.
Everyone who is familiar with the intersection at Cedar Cross and the Frontage Road
that becomes BrunskiJJ Road knows that this intersection is not r'p,ble of handling the
additional traffic that would be generated by a change in the zoning.
Mr. Patzer came to our front door last summer to let us know what his intentions for
the area were. What he is proposing now is exactly what he told us he was not going
to do. He does not live here; why should he care what the neighbors think. Not only
does Mr. Patzer not live in Dubuque. he doesn't even live in Iowa.
It is difficult to believe that the zoning commission voted 7-0 against Mr. Patzer last year
and now recently voted 7-0 in favor of Mr. Patzer's proposal Something is not as it
should be. We urge you to vote against a zoning change to Planned Office Business.

Secause we volunteer coach and have prior commitments, we are unable to attend lbe
1"hlic hearing this evening, however we did want 10 bring up a couple of points lbat we
have been thinking about regarding the rezoning of property On Brunskill Road.

We think that it is greaT that certain neighborhoods now have new parks and that other
J/eighborhoods have had their parks renovaled. How wonderful for the children nearby
these parks who now have safe, open places to play. For our children 10 ride their bikes
tl> a neighborhood park, they have to either cross Highway 20 to Flora Park, or ride the
entire length of Fremont Ave. Or Cedar Cross Road to Valentine Park. Please try this
s6metime. We just got our first neighborhood street light about one year ago, the street
~eeper goes by ever so rarely, people regularly drive by at about 35 to 45 m.p.h. in
what is supposed to be a 25 m.p.h. speed zone, and the nearest intersection is increasingly
"'tmgesled. In a neighborhood where we should be considering park accessibility and
s~eed control, we now have to be concerned with encroaching business, Please
tindersland our frustration at being a forgotten neighborhood, recognized only now

~ecause Mr. Patzner prefers office space in a residential district. There must be other
sltes in Dubuque suited to the needs of Mr. Patzner's business and employees; his
r~zoning request is not ill the best interest of the area.

Oak Meadow Community Association is a homeowner's association located off the 2800
block of Brunskill Road. This association consists of 16 members and their residences on
Oak Meadow Court. As president of Oak Meadow Community Association, I am acting
on behalf of all the members of the association.
We, as a group, are against the rezoning of the property at 3030 Brunskill Road to a
Planned Office designation. We do NOT have any objection to the Planned Unit
Development proposed at this same location. Our wishes were also made known to the
Zoning Advisory Commission in the form of petition against this rezoning.
Our feeling is that this is residential area and should remain as such. Past attempts to
rezone property in this general area to commercial designations were denied. We feel
that this too should be denied.
