Assistant City Engineer Gus Psihoyos recommends City Council approval for the Mayor
to execute the Iowa Department of Transportation Funding Agreement for the
Southwest Arterial / U.S. Highway 20 Traffic Capacity Improvement Study.
The projected cost to complete the Southwest Arterial / U.S. Highway 20 Traffic
Capacity Improvement Study is $312,145. The Iowa Department of Transportation will
fund 50% of the projected study cost and the City will fund the remaining 50 %.
I concur with the recommendation and respectfully request Mayor and City Council
approval.

INTRODUCTION
The enclosed resolution authorizes the Mayor to execute the Iowa Department of
Transportation (Iowa DOT) Funding Agreement (Agreement No. 2012 -16 -011) for the
Southwest Arterial / U.S. Highway 20 Traffic Capacity Improvement Study.
BACKGROUND
With the future completion of the Southwest Arterial, the Arterial is projected to increase
U.S. Highway 20 daily traffic volumes by 8,200 vehicles west of the Northwest Arterial in
Year 2030 affecting overall traffic operations. The Southwest Arterial is also projected to
decrease the U.S. Highway 20 daily traffic volumes by 1,800 vehicles east of the
Southwest Arterial. Based on a comparison of the 2001 existing volumes and the
projected 2030 No Build volumes, the average annual growth rate for the U.S. Highway
20 corridor is 1.85 percent (assuming no major capacity expansion along U.S. Highway
20).
DISCUSSION
The City of Dubuque in joint partnership with the Iowa Department of Transportation
(Iowa DOT) have agreed to initiate a Traffic Capacity Improvement Location Study
along U.S. Highway 20, between the Southwest Arterial / Seippel Road interchange and
the Northwest Arterial, whereby the Iowa DOT will be the lead agency for the study.
The initial scope and limits of the study will further defined but are anticipated to include
the following; future traffic capacity analysis of the U.S. 20 corridor between Southwest
Arterial / Seippel Road interchange and the Northwest Arterial, evaluate future
improvement including vertical alignment design, concept level templating, frontage

road connections, lane requirements, ITS improvements, intersection and interchange
alternative type and location, determining approximate construction impacts,
determining potential environmental impacts, determining property acquisition impacts
and preparing a construction cost estimate.
The study will also include the completion of the Environmental Assessment (EA)
Addendum and National Environmental Policy Act (NEPA) Decision documentation.
RECOMMENDATION
I recommend that the City Council adopt the enclosed resolution and authorize the
Mayor to sign the Funding Agreement (Agreement No. 2012 -16 -011) with the Iowa DOT
to complete the Southwest Arterial / U.S. Highway 20 Traffic Capacity Improvement
Study.
BUDGET IMPACT
The cost to complete Southwest Arterial / U.S. Highway 20 Traffic Capacity
Improvement Study is as follows:

ACTION TO BE TAKEN
I respectfully request that the City Council adopt the attached resolution and authorize
the Mayor to sign the Iowa Department of Transportation Funding Agreement
(Agreement No. 2012 -16 -011) for the Southwest Arterial / U.S. Highway 20 Traffic
Capacity Improvement Study.

RESOLUTION APPROVING THE IOWA DEPARTMENT OF TRANSPORTATION
FUNDING AGREEMENT (AGREEMENT NO. 2012 -16 -011) FOR THE SOUTHWEST
ARTERIAL / U.S. HIGHWAY 20 TRAFFIC CAPACITY IMPROVEMENT STUDY
Whereas, the City of Dubuque (City) in joint partnership with the Iowa
Department of Transportation (Iowa DOT) have agreed to initiate a Traffic Capacity
Improvement Location Study (Project No. NHSN -20 -9 (215)-- 2R -31) along U.S.
Highway 20, between the Southwest Arterial / Seippel Road interchange and the
Northwest Arterial within Dubuque County, Iowa.
Whereas, the Iowa DOT will be the lead agency for the study per the terms of the
funding agreement.
Whereas, the Iowa DOT will fund 50% of the projected study cost and the City

NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF DUBUQUE, IOWA:
Section 1. That said Funding Agreement (Agreement No. 2012 -16 -011)
between the City of Dubuque and the Iowa Department of Transportation be approved
for the Southwest Arterial / U.S. Highway 20 Traffic Capacity Improvement Study in
Dubuque.
Section 2. That the Mayor be authorized and directed to execute two copies of
Iowa DOT Funding Agreement (Agreement No. 2012 -16 -011) for the Southwest Arterial
/ U.S. Highway 20 Traffic Capacity Improvement Study in Dubuque.

for US 20 within the City of Dubuque. The study includes efforts to complete the additional
conceptual development, and Environmental Assessment Addendum, and a National Environmental
Policy Act Decision Document associated with a capacity improvement project on US 20 from east
of the proposed Southwest Arterial interchange to the middle fork of the Catfish Creek.

This Agreement, is entered into by and between the Iowa Department of Transportation, hereinafter
designated the "DOT ", and the city of Dubuque, Iowa, a Local Public Agency, hereafter designated the
"LPA" in accordance with Iowa Code Chapters 28E, 306, 306A and 313.4 as applicable;
The DOT proposes to develop a location study for U.S. 20 within the city of Dubuque, in Dubuque
County, Iowa; and
The study includes efforts to complete the additional conceptual development, and Environmental
Assessment Addendum, and a National Environmental Policy Act Decision Document associated with a
capacity improvement project on U.S. 20 from east of the proposed Southwest Arterial interchange to the
middle fork of the Catfish Creek.
The DOT and the LPA are willing to jointly participate in said project, in the manner hereinafter provided;
and
This Agreement reflects the current concept of this project which is subject to modification by mutual
agreement between the DOT and the LPA; and
Therefore, it is agreed as follows:
1. Project Information
a. The DOT shall be the agency for carrying out the provisions of this agreement and will administer a
consultant contract to prepare a report to evaluate the capacity improvement options on U.S. 20 in
Dubuque.
b. The LPA will be given the opportunity to review and comment on the draft report as well as the final
report prior to releasing information to the public.
c. Any extra work order shall be approved by the DOT and the LPA prior to its inclusion in the consultant
contract. The responsibility for the extra work will be negotiated at that time.
d. The DOT and LPA shall notify each other of all meetings, hearings, and review sessions held relating
to this project. Said notifications will be provided at least five (5) days in advance of the event and
shall be made to the designated representative.
2. Project Costs
a. The total cost of the study is estimated at $312,145. The LPA agrees to reimburse the DOT for 50%
of the total actual cost of the study.
b. The LPA shall reimburse the DOT for the LPA share of the project costs estimated at $156,072.50.

The amount paid by the LPA upon completion and proper billing by the DOT will be determined by the
actual cost of the study.
c. The DOT will submit itemized billings to the LPA for the balance due each month. The LPA agrees to
promptly reimburse the DOT for these costs. Should the reimbursed costs become delinquent for
ninety (90) days or more, this Agreement and the associated work may be terminated until such time
as adequate reimbursement is made.
d. The DOT will bear all costs except those allocated to the LPA under other terms of this Agreement.
3. General Provisions
a. The LPA shall maintain records, documents, and other evidence in support of the work performed
under the terms of this agreement. All accounting practices applied and all records maintained will be
in accordance with generally accepted accounting principles and procedures. Documentation shall be
made available for inspection and audit by authorized representatives of the DOT and / or the Federal
Highway Administration (FHWA), or their designees at all reasonable times. The LPA shall provide
copies of said records and documents to the DOT upon request. The LPA shall also require its
contractors to permit authorized representatives of the DOT and / or the FHWA to inspect all work
materials, records, and any other data with regard to agreement related costs, revenues and
operating sources. Such documents shall be retained for at least 3 years from the date of FHWA
approval of the final amendment / modification to the project in the FHWA's Fiscal Management
Information System (FMIS). Upon receipt of such approval by FHWA, the DOT will notify the LPA of
the record retention date.
b. In accordance with Iowa Code Chapter 216, the LPA shall not discriminate against any person on the
basis of race, color, creed, age, sex, sexual orientation, gender identity, national origin, religion,
pregnancy, or disability.
c. If any part of this agreement is found to be void and unenforceable then the remaining provisions of
this agreement shall remain in effect.
d. This agreement is not assignable without the prior written consent of the DOT.
e. It is the intent of both (all) parties that no third party beneficiaries be created by this Agreement.
f. In case of dispute concerning the terms of this agreement, the parties shall submit the matter to
arbitration pursuant to Iowa Code Chapter 679A. Either party has the right to submit the matter to
arbitration after ten (10) days notice to the other party of their intent to seek arbitration. The written
notice must include a precise statement of the disputed question. The DOT and the LPA agree to be
bound by the decision of the appointed arbitrator. Neither party may seek any remedy with the State
or Federal courts absent exhaustion of the provisions of this paragraph for arbitration.
g.
This Agreement may be executed in (two) counterparts, each of which so executed will be deemed to
be an original.
h. This Agreement, as well as the unaffected provisions of any previous agreement(s), addendum(s),
and /or amendment(s); represents the entire Agreement between the LPA and DOT regarding this
project. All previously executed agreements will remain in effect except as amended herein. Any
subsequent change or modification to the terms of this Agreement will be in the form of a duly
executed amendment to this document.
